Following significant industry pushback, the Oregon Health Authority (OHA) announced on Tuesday that the agency has officially dropped its efforts to double licensing fees for the state\u2019s psilocybin services program.<\/p>\n

In an email to industry stakeholders, the agency wrote that, \u201cbased on feedback OHA has received through the Oregon Psilocybin Advisory Board (OPAB), rule advisory committees (RACs) and rulemaking public comment period, the agency will not adopt final rules as a result of this rulemaking process.\u201d<\/p>\n

The initially proposed changes came amidst a multi-billion dollar statewide budgetary shortfall in Oregon, and per OHA\u2019s own language included in the now-dropped rule change acknowledged that if implemented, the fee hikes \u201cmay reduce the overall number of licensees and create a more significant program budget shortfall.\u201d<\/p>\n

In the wake of the initial proposal, industry stakeholders across the Beaver State spoke out in force, arguing that such a substantial fee hike could potentially cripple the first legal, state regulated psychedelic access program in the United States.<\/p>\n

In response to news that the OHA was dropping the rule change altogether, Center for Psychedelic Policy Founder Sam Chapman noted that while psilocybin services are yielding positive results with few adverse effects, the work to refine the system\u2019s financial structure will continue.<\/p>\n

\u201cWe asked Governor [Tina] Kotek to give the legislature time to get this right, and now they have it,\u201d said Chapman in a statement provided to Psychedelic State(s) of America.<\/p>\n

State-licensed psilocybin facilitator, Rulemaking Advisory Committee member and military veteran Amy Charlesworth echoed Chapman\u2019s sentiments, while highlighting future concerns over freedom of speech based on other rule changes previously proposed by OHA.<\/p>\n

\u201cOHA dropping<\/a> this rulemaking is a win, but it does not mean we\u2019ve won,\u201d Charlesworth said in a statement to Psychedelic State(s) of America.<\/p>\n

\u201cProposed OAR [regulations] would have restricted licensees from \u2018promoting\u2019 or \u2018encouraging\u2019 unlawful or unregulated activity,\u201d Charlesworth noted, \u201cincluding by \u2018providing information or instruction related to home cultivation.\u2019<\/p>\n

\u201cThat is not regulation of what happens inside a licensed service center.\u201d Charlesworth added, \u201cIt reaches what we write, teach, publish, and say in public.\u201d<\/p>\n

\u201cUnder that language,\u201d she expounded, \u201ca facilitator could reasonably fear losing their license over a book, a class, a podcast, a harm-reduction conversation, or a social media post.\u201d<\/p>\n

\u201cIf OHA brings these provisions back,\u201d Charlesworth vowed, \u201cwe will be ready to challenge them.\u201d<\/p>\n

As for the long game, Chapman noted in a press release that while \u201cthe program is working. The fee structure isn\u2019t.\u201d<\/p>\n

\u201cBetween now and the 2027 session,\u201d Chapman added, \u201cthe Center for Psychedelic Policy is conducting an independent economic analysis to answer a simple question: can psilocybin therapy be just as effective as the treatments Oregon already pays for, if not more so, at a fraction of the cost?\u201d<\/p>\n

\u201cIf the answer is yes,\u201d Chapman concluded, \u201cthe question stops being how Oregon pays for this program and starts being why we aren\u2019t investing more in it.\u201d<\/p>\n

\u201cBetter outcomes for less, and real access for Oregonians who are struggling,\u201d he said. \u201cNow we have the time to prove it.\u201d<\/p>\n
