{"id":86343,"date":"2026-07-14T09:50:53","date_gmt":"2026-07-14T17:50:53","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/07\/14\/californias-top-marijuana-regulator-says-local-bans-benefit-illicit-market-with-97-of-busts-in-counties-without-legal-growers\/"},"modified":"2026-07-15T19:48:29","modified_gmt":"2026-07-16T03:48:29","slug":"californias-top-marijuana-regulator-says-local-bans-benefit-illicit-market-with-97-of-busts-in-counties-without-legal-growers","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/07\/14\/californias-top-marijuana-regulator-says-local-bans-benefit-illicit-market-with-97-of-busts-in-counties-without-legal-growers\/","title":{"rendered":"California\u2019s Top Marijuana Regulator Says Local Bans \u2018Benefit\u2019 Illicit Market, With 97% Of Busts In Counties Without Legal Growers"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2026\/07\/MM_Bill_Tracker_V5_blank-17.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>About 97 percent of marijuana seized by California officials in unincorporated areas of the state came from counties that continue to ban licensed growers, new data from the Department of Cannabis Control (DCC) reveals.<\/p>\n<p>That shows how local governments that have refused to get on board with California\u2019s legalization law that voters approved 10 years ago \u201cbenefit\u201d the illicit market, the state\u2019s top cannabis regulator told State Affairs, which obtained and first reported on the data.<\/p>\n<p>DCC has repeatedly argued that the current system of patchwork regulations\u2014where localities are able to opt-in or opt-out of allowing certain types of licensed marijuana businesses from operating in their area\u2014is a key factor keeping the state\u2019s illegal cannabis trade alive.<\/p>\n<p>It creates barriers to access for adult consumers, while allowing unlicensed operators to function in a policy vacuum. To combat the problem, the state established the Unified Cannabis Enforcement Taskforce (UCETF) in 2022 to coordinate multi-agency enforcement action against illicit growers, manufacturers and sellers.<\/p>\n<p>Through that work, DCC has been able to put the local control issue into perspective. According to data on enforcement activity spanning October 2022 to August 2025, the department found that 96.6 percent of illicit marijuana seized by UCETF in unincorporated areas of the state was discovered in eight counties\u2014almost all of which maintain local bans on licensed marijuana cultivators.<\/p>\n<p>DCC Director Clint Kellum said that \u201ccannabis is used in every community, regardless of local rules,\u201d and while localities can ban licensed shops, \u201cthey cannot eliminate consumer demand.\u201d<\/p>\n<p>\u201cWhen local governments deny consumers access to licensed retailers, the illicit market and organized crime benefit, while public health and safety is harmed,\u201d he <a href=\"https:\/\/pro.stateaffairs.com\/ca\/cannabis\/local-cannabis-grower-bans-benefit-illicit-market-california-data-shows\" target=\"_blank\" rel=\"noopener\">told<\/a> State Affairs.<\/p>\n<p>Kellum added that the department \u201cwill continue applying pressure to illegal operators, particularly when the activity involves organized crime, unlawful transportation and distribution, illegal manufacturing, diversion, threats to the licensed market, environmental harm, labor exploitation or conduct that crosses jurisdictional lines.\u201d<\/p>\n<p>DCC released the county-level data days after Gov. Gavin Newsom (D) touted the state\u2019s work seizing 63,000 pounds of illicit cannabis valued at more than $104 million, while destroying more than 89,000 cannabis plants, from April to June.<\/p>\n<p>All told, the multi-agency task force has seized over 841,000 pounds (or 420 tons, as the governor\u2019s office went out of its way to note in a press release) since its establishment four years ago.<\/p>\n<p>\u201cDisrupting the illegal cannabis market is about more than seizing unlicensed products\u2014it\u2019s about taking on criminal networks, removing illegal firearms out of the hands of dangerous individuals, and stopping activity that threatens public safety,\u201d the governor said. \u201cThrough strong multiagency collaboration, California is making clear: if you threaten our communities, we will act.\u201d<\/p>\n<p>Meanwhile, Newsom is term-limited, but California\u2019s two major party general election gubernatorial candidates both support legalization. Republican Steve Hilton, who is endorsed by President Donald Trump, recently told Marijuana Moment that <a href=\"https:\/\/www.marijuanamoment.net\/trump-endorsed-gop-california-gubernatorial-candidate-says-marijuana-taxes-and-regulations-are-too-high\/\" target=\"_blank\" rel=\"nofollow noopener\">taxes and regulations on cannabis are \u201ctoo high.\u201d<\/a><\/p>\n<p>Not all California Republicans are on board with the reform, however. The vice chair of the state Senate Budget Committee has floated the idea of <a href=\"https:\/\/www.marijuanamoment.net\/california-gop-senator-suggests-putting-marijuana-back-on-the-ballot-to-reverse-legalization\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">putting a new initiative on the state ballot to \u201creverse\u201d Proposition 64<\/a>, for example, arguing that voters were misled and voicing concerns about the health impacts of marijuana use.<\/p>\n<p>\u201cWe have seen significant negative consequences of this legalization, both here as well as in other states,\u201d the senator, who was speaking at a hearing at which lawmakers\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-bill-to-legalize-marijuana-dispensary-drive-thru-windows-advances-in-senate-after-clearing-full-assembly\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">approved a bill to legalize marijuana dispensary drive-thru windows in California<\/a>, said.<\/p>\n<p>Democratic gubernatorial contender Xavier Becerra, who previously served in Congress and as California\u2019s attorney general, meanwhile, facilitated a scientific review process during his time as health and human services secretary under the Biden administration that ultimately resulted in a recommendation to move cannabis from Schedule I to Schedule III of the Controlled Substances Act state\u2019s marijuana licensing process that are intended to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-california-emergency-marijuana-rules-aim-to-help-states-businesses-benefit-from-trumps-federal-rescheduling-move\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">make it easier for businesses to qualify for benefits<\/a> in line with the Trump administration\u2019s recent decision to move ahead with federally rescheduling medical cannabis.<\/p>\n<p>They also launched a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-marijuana-regulators-unveil-new-ai-tool-to-prevent-product-packaging-that-may-appeal-to-kids\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">new AI tool to help businesses identify marijuana product packaging may appeal to kids<\/a>\u00a0in violation of state rules.<\/p>\n<p>Separately, Newsom recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/newsom-takes-credit-for-legalizing-marijuana-in-california-and-discusses-complicated-experience-smoking-it-at-the-grand-canyon\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">took credit for helping to lead the push for the state to legalize marijuana<\/a>\u00a0and discussed his own limited experience with using cannabis.<\/p>\n<p>In October, however, the governor vetoed a bill that would have\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/newsom-vetoes-california-bill-to-let-marijuana-businesses-deliver-products-directly-to-patients\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">allowed certain marijuana microbusinesses to ship medical cannabis products directly to patients<\/a>\u00a0via common carriers like FedEx and UPS, stating that the proposal \u201cwould be burdensome and overly complex to administer.\u201d<\/p>\n<p>Newsom did sign a bill earlier that month aimed at\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-governor-signs-bill-to-expedite-marijuana-and-psychedelics-research\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">streamlining research on marijuana and psychedelics<\/a>.<\/p>\n<p>In September, the governor also signed a measure into law to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-governor-signs-bill-to-roll-back-marijuana-tax-hike\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">put a pause on a recently enacted tax hike on marijuana products<\/a>.<\/p>\n<p>Separately, the state attorney general says\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-indian-tribes-cant-participate-in-statewide-marijuana-industry-without-getting-their-own-licenses-attorney-general-says\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">Indian tribes cannot independently engage in marijuana commerce<\/a>\u00a0with licensed cannabis businesses without first obtaining their own commercial license from state officials.<\/p>\n<p>California officials recently awarded\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-officials-award-30-million-in-marijuana-revenue-to-support-research-on-thc-drinks-terpenes-and-tribal-cannabis-sales\/\"
