{"id":86336,"date":"2026-07-15T04:25:52","date_gmt":"2026-07-15T12:25:52","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/07\/15\/military-warns-that-trumps-marijuana-rescheduling-move-doesnt-allow-use-by-service-members\/"},"modified":"2026-07-15T19:48:11","modified_gmt":"2026-07-16T03:48:11","slug":"military-warns-that-trumps-marijuana-rescheduling-move-doesnt-allow-use-by-service-members","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/07\/15\/military-warns-that-trumps-marijuana-rescheduling-move-doesnt-allow-use-by-service-members\/","title":{"rendered":"Military Warns That Trump\u2019s Marijuana Rescheduling Move Doesn\u2019t Allow Use By Service Members"},"content":{"rendered":"<\/p>\n<p>The Department of War (DOW) has issued a memo to senior Pentagon leadership making clear that marijuana use by military service members and civilian employees of the department remains prohibited, even as the Trump administration is moving to federally reschedule cannabis.<\/p>\n<p>DOW \u201cmaintains a drug-free workplace to protect national security, public safety, and operational readiness,\u201d the one-page document dated July 9 and obtained by Marijuana Moment says.<\/p>\n<p>Under an order issued by U.S. Acting Attorney General Todd Blanche in April,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-marijuana-rescheduling-announced-by-department-of-justice-months-after-trump-executive-order\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">marijuana products regulated by a state medical cannabis license immediately moved from Schedule I<\/a>\u00a0of the Controlled Substances Act (CSA) to Schedule III, as did any marijuana products that are approved by the Food and Drug Administration (FDA). An ongoing administrative\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/inside-the-deas-marijuana-rescheduling-hearing-what-i-saw-who-was-missing-and-why-it-matters-op-ed\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">hearing is considering broader marijuana rescheduling<\/a>.<\/p>\n<p>The new Pentagon memo, which has not previously been reported, seems to not recognize that medical cannabis rescheduling has already occurred, however, saying that \u201cif implemented,\u201d the reform \u201cwould not decriminalize marijuana under Federal law.\u201d<\/p>\n<p>\u201cService members are reminded that the Uniform Code of Military Justice (UCMJ) prohibits certain actions, including the wrongful use, possession, manufacture, or distribution of marijuana, and attempts to commit such acts,\u201d Anthony J. Tata, the under secretary of war for personnel and readiness, wrote. \u201cThese offenses remain punishable under the UCMJ, even if a State or local jurisdiction legalizes the use of recreational marijuana or authorizes the sale of marijuana, including medical marijuana, at State dispensaries.\u201d<\/p>\n<p>Lynn Wagner, the executive director of DOW\u2019s Office of Drug Demand Reduction, is listed as a point of contact on the memo, though she did not immediately respond to Marijuana Moment\u2019s request to verify the document, nor did the Pentagon\u2019s press office.<\/p>\n<p>\u201cService members who violate the UCMJ may be held appropriately accountable, including through judicial, nonjudicial, or administrative action,\u201d Tata wrote in the memo, adding that civilian employees of DOW are subject to restrictions of the department\u2019s Drug-Free Workplace Program.<\/p>\n<p class=\"p1\">\u201cThese prohibitions do not apply to formulations approved as drugs by the FDA with a valid prescription for a legitimate medical purpose,\u201d he concluded.<\/p>\n<p><a href=\"https:\/\/www.marijuanamoment.net\/congressional-report-explains-implications-and-limitations-of-trumps-marijuana-rescheduling-move-for-users-and-industry\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">The Congressional Research Service, however, published a report on the cannabis rescheduling move<\/a>\u00a0explaining that certified patients who possess medical marijuana from state-licensed dispensaries now have certain protections under Schedule III. \u201cThe order appears to authorize end users to possess marijuana for medical use without a CSA-compliant prescription,\u201d it says.<\/p>\n<p>The Army, meanwhile, enacted a new policy in April making it so recruits will no longer need to obtain a <a href=\"https:\/\/www.marijuanamoment.net\/new-army-rule-allows-recruits-with-a-marijuana-conviction-to-enlist-without-needing-a-waiver-starting-on-4-20\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">waiver to enlist if they have a single conviction for possessing marijuana<\/a>\u00a0or drug paraphernalia on their records.<\/p>\n<p>That said, military branches have regularly warned service members about the consequences of using marijuana or even federally legal hemp-derived products.<\/p>\n<p>In May, for example, the <a href=\"https:\/\/www.marijuanamoment.net\/army-reminds-soldiers-of-zero-tolerance-marijuana-policy-warning-that-even-cbd-lotion-remains-banned\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">Army published a post reminding soldiers of its \u201czero-tolerance\u201d policy for all forms of cannabis<\/a>\u00a0and its derivatives\u2014including hair care products and lotions made from hemp.<\/p>\n<p>Last year, a memo to Air Force personnel in Massachusetts warned that not only marijuana but also hemp-derived cannabinoids, including CBD and delta-8 THC,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-air-force-memo-cautions-that-possession-of-cannabis-products-including-hemp-and-cbd-could-carry-heavy-penalties\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">are prohibited on military bases and related properties<\/a>.<\/p>\n<p>In 2022, the Air Force\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/defense-department-warns-that-hemp-granola-and-cbd-hand-sanitizer-can-compromise-military-readiness\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">expressed concern that even using CBD-infused hand sanitizer or hemp granola could inadvertently compromise \u201cmilitary readiness.\u201d<\/a><\/p>\n<p>DOD broadly reaffirmed that CBD is off limits to service members <a href=\"https:\/\/www.marijuanamoment.net\/u-s-military-reiterates-that-cbd-is-off-limits-to-service-members\/\" rel=\"noopener noreferrer\" data-google-interstitial=\"false\" target=\"_blank\">in notices published in 2020<\/a>.<\/p>\n<p>The Navy, for its part, issued an initial notice in 2018 informing ranks that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/navy-bans-sailors-from-using-cbd-despite-federal-hemp-legalization-new-memo-says\/\" rel=\"noopener noreferrer\" data-google-interstitial=\"false\" target=\"_blank\">they\u2019re barred from using CBD and hemp products<\/a>\u00a0no matter their legality.
