{"id":86267,"date":"2026-07-08T11:08:06","date_gmt":"2026-07-08T19:08:06","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/07\/08\/wyoming-attorney-general-blocks-state-marijuana-rescheduling-that-would-be-triggered-by-trumps-federal-reform\/"},"modified":"2026-07-08T19:45:24","modified_gmt":"2026-07-09T03:45:24","slug":"wyoming-attorney-general-blocks-state-marijuana-rescheduling-that-would-be-triggered-by-trumps-federal-reform","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/07\/08\/wyoming-attorney-general-blocks-state-marijuana-rescheduling-that-would-be-triggered-by-trumps-federal-reform\/","title":{"rendered":"Wyoming Attorney General Blocks State Marijuana Rescheduling That Would Be Triggered By Trump\u2019s Federal Reform"},"content":{"rendered":"<\/p>\n<p>Wyoming\u2019s attorney general has determined that <a href=\"https:\/\/www.marijuanamoment.net\/wyoming-official-issues-objection-to-rescheduling-marijuana-under-state-law-following-trumps-federal-move\/\" target=\"_blank\" rel=\"nofollow noopener\">the state will not reclassify marijuana under state law in line with a federal rescheduling move<\/a> by the Trump administration.<\/p>\n<p>\u201cThe Wyoming Legislature has not legalized medical marijuana, has not approved a state licensed medical marijuana regulatory scheme, or approved of recognizing any other state\u2019s medical marijuana issued licenses,\u201d Attorney General Keith Kautz (R) said on Tuesday. \u201cTherefore, placing marijuana subject to a state medical marijuana license in Schedule III of the Wyoming Controlled Substances Act is inconsistent with the police powers exercised to date by the Wyoming Legislature.\u201d<\/p>\n<p>\u201cThe question of whether to remove any type of marijuana from Schedule I of the Wyoming Controlled Substances Act is for the Wyoming Legislature and should not be done through the administrative rule making process,\u201d he said.<\/p>\n<p>The legislature, however, previously enacted a law that says \u201cif any substance is designated, rescheduled, or deleted as a controlled substance under federal law,\u201d the commissioner of drugs and substances control \u201cshall control the substance under this act in the same manner as federal law\u201d within 30 days.<\/p>\n<p>Under state law, the attorney general serves as the commissioner of drugs and substances control and can formally object to the automatic state rescheduling to prevent it from taking place, subject to a public hearing allowing \u201call interested parties an opportunity to be heard.\u201d<\/p>\n<p>Kautz convened a hearing in June to consider the issue, and also accepted public comments via email.<\/p>\n<p style=\"padding-left: 40px\">\u201cThe Commissioner received eight email comments. Four of the comments expressed support of leaving medical marijuana and marijuana products on Schedule I of the Wyoming Controlled Substances Act. Four of the comments supported placing marijuana and medical marijuana on Schedule III of the Wyoming Controlled Substances Act. One person appeared in person at the hearing and provided testimony requesting\u00a0 that the Commissioner leave all marijuana on Schedule I of the Wyoming Controlled Substances Act. All of the comments\u2014both email and in person\u2014were rooted in the important policy considerations surrounding the legalization of marijuana and marijuana products.\u201d<\/p>\n<p>The attorney general also noted that \u201call marijuana products currently approved by the United States Food and Drug Administration are already scheduled consistent with the federal Controlled Substances Act,\u201d <a href=\"https:\/\/drive.google.com\/file\/d\/1yMed5rCflBJkkpogCXU_DdKj_CRmpj8O\/view\" target=\"_blank\" rel=\"noopener\">citing<\/a> prescription medications such as dronabinol, Cesamet and Epidiolex. \u201cThe Commissioner will continue to appropriately control individual substances as they are approved by the United States Food and Drug Administration.\u201d<\/p>\n<p>\u201cAfter considering all of the comments from interested parties, the Commissioner has determined that all marijuana products, including marijuana subject to a state medical marijuana license, shall remain on Schedule I of the Wyoming Controlled Substances Act,\u201d Kautz\u2019s announcement says. \u201cThis decision is final unless altered by statute.\u201d<\/p>\n<p>Under an order issued by U.S. Acting Attorney General Todd Blanche in April, marijuana products regulated by a state medical cannabis license immediately moved from Schedule I of the Controlled Substances Act (CSA) to Schedule III, as did any marijuana products that are approved by the Food and Drug Administration (FDA).<\/p>\n<p>An <a href=\"https:\/\/www.marijuanamoment.net\/inside-the-deas-marijuana-rescheduling-hearing-what-i-saw-who-was-missing-and-why-it-matters-op-ed\/\" target=\"_blank\" rel=\"nofollow noopener\">administrative hearing now underway is considering broader cannabis rescheduling<\/a>, including for recreational products.<\/p>\n<p>In Wyoming, activists have sough unsuccessfully to put <a href=\"https:\/\/www.marijuanamoment.net\/two-wyoming-marijuana-initiatives-fail-to-qualify-for-2024-ballot-but-advocates-will-try-again\/\" target=\"_blank\" rel=\"nofollow noopener\">initiatives to legalize medical cannabis and decriminalize marijuana possession on the ballot<\/a>.<\/p>\n<p>State lawmakers have also considered legislation on the issue, but Wyoming remains one of only a handful of states without any legal medical marijuana access.<\/p>\n<p>In 2022 the Wyoming House speaker filed a bipartisan decriminalization bill <a href=\"https:\/\/www.marijuanamoment.net\/wyoming-house-speaker-backs-new-bill-to-decriminalize-marijuana\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">to remove criminal penalties for possessing small amounts of cannabis<\/a>\u00a0and replace the state\u2019s current misdemeanor charge with a $100 fine. But that legislation\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/wyoming-marijuana-decriminalization-bill-wont-get-a-vote-this-session-sponsor-says\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">did not receive a vote<\/a> despite support from top GOP lawmakers.<\/p>\n<p>A bill to legalize and regulate cannabis for adult use in Wyoming\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/wyoming-lawmakers-approve-marijuana-legalization-bill-sponsored-by-top-gop-leaders\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">advanced out of a House committee<\/a>\u00a0in 2021, but it did not move further by the end of that session.<\/p>\n<p>A\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/wyoming-is-ready-to-legalize-marijuana-new-poll-shows\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">poll released in 2020 found<\/a>\u00a0that 54 percent of Wyoming residents supported allowing adults in the state \u201cto legally possess marijuana for personal use.\u201d<\/p>\n<p>Meanwhile, other states that also don\u2019t have comprehensive medical cannabis programs are also grappling with changes to state marijuana laws that could be trigged by the federal rescheduling action.<\/p>\n<p>A <a href=\"https:\/\/www.marijuanamoment.net\/medical-marijuana-is-now-legal-in-south-carolina-gop-senator-declares-as-republican-governor-candidate-calls-it-a-gateway-drug\/\" target=\"_blank\" rel=\"nofollow noopener\">GOP senator in South Carolina, for example, said that \u201cmedical marijuana is now legal\u201d<\/a> in the state under a trigger law.<\/p>\n<p>In May, the governing body of the <a href=\"https:\/\/www.marijuanamoment.net\/alabama-officials-move-to-delay-automatic-rescheduling-of-marijuana-under-state-law-following-trumps-federal-move\/\" target=\"_blank\" rel=\"nofollow noopener\">Alabama Department of Public Health voted to object to federal rescheduling of marijuana<\/a> after health officials said they need more time to determine how to implement a change on the state level.<\/p>\n<p>Tennessee Gov.
