{"id":86261,"date":"2026-06-30T13:07:13","date_gmt":"2026-06-30T21:07:13","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/06\/30\/marijuana-opponents-attack-government-analysis-behind-rescheduling-recommendation-on-second-day-of-dea-hearing\/"},"modified":"2026-07-01T19:49:43","modified_gmt":"2026-07-02T03:49:43","slug":"marijuana-opponents-attack-government-analysis-behind-rescheduling-recommendation-on-second-day-of-dea-hearing","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/06\/30\/marijuana-opponents-attack-government-analysis-behind-rescheduling-recommendation-on-second-day-of-dea-hearing\/","title":{"rendered":"Marijuana Opponents Attack Government Analysis Behind Rescheduling Recommendation On Second Day Of DEA Hearing"},"content":{"rendered":"<\/p>\n<p>Lawyers for marijuana reform opponents that are participating in a Drug Enforcement Administration (DEA) hearing on the <a href=\"https:\/\/www.marijuanamoment.net\/dea-will-highlight-testimony-on-marijuanas-medical-benefits-in-rescheduling-hearing-new-filing-shows\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">Trump administration\u2019s cannabis rescheduling proposal<\/a> put significant focus on the second day of the proceedings on pressing a government witness about recently adopted changes to an analysis used to determine whether drugs have accepted medical value.<\/p>\n<p>A separate government witness who began his testimony on Tuesday focused on cannabis\u2019s role in treating pain patients and its relative safety compared to opioids.<\/p>\n<p>Under federal law, drugs that have a currently accepted medical use (CAMU) cannot be classified in Schedule I, the most restrictive category. For years, officials had used a five-part test to determine a substance\u2019s medical utility that involved an analysis of whether its chemistry is known and reproducible, safety studies, research proving efficacy, acceptance by qualified experts and widely available scientific evidence.<\/p>\n<p>But in 2023 to evaluate marijuana, they switched to a new two-part analysis that looks at whether there is widespread, current experience with medical use of the substance by licensed health care providers operating in accordance with state laws and, if so, whether there is some credible scientific support for at least one of the medical conditions it is being used for.<\/p>\n<p>Opponents of reform say the switch was improper, however. Their attorneys pressed Dominic Chiapperino, who serves as director of the controlled substance staff with the Food and Drug Administration\u2019s (FDA) Center for Drug Evaluation and Research and is one of the DEA\u2019s two witnesses, on the issue during cross-examination on Tuesday.<\/p>\n<p>An attorney for the states of Idaho, Indiana and Nebraska, for example, focused on how a prior analysis on marijuana, conducted in 2015 under the older test, concluded that it should not be rescheduled because it did not have a currently accepted medical use.<\/p>\n<p>Under questioning, FDA\u2019s Chiapperino testified that the new two-part test did not exist when he and agency colleagues began the most recent analysis of marijuana that led to its rescheduling recommendation and that in July 2023\u2014just two months before they finished their work\u2014officials were informed of the new approach in a letter from the assistant secretary of health.<\/p>\n<p>Chiapperino also acknowledged that marijuana would not have passed the prior five-part test. The line of questioning that led to that testimony was objected to by DEA lawyers but they were overruled by the judge overseeing the proceedings.<\/p>\n<p>Kevin Sabet, president and CEO of the prohibitionist organization Smart Approaches to Marijuana, said in a video posted to social media that the admission is \u201ctruly extraordinary.\u201d<\/p>\n<p>\u201cLet\u2019s be clear about what this means,\u201d he said. \u201cIt means that the government is asking to move marijuana out of Schedule I, but it did so using a brand new standard instead of a standard that it had applied for years, which has applied for every other drug\u2014and now in open court its own witness has acknowledged that marijuana would not have met the traditional test.\u201d<\/p>\n<div class=\"embed-x\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">&#x1f6a8;  BREAKING NEWS: The government\u2019s own witness admitted, under oath, that marijuana would not have passed the FDA\u2019s longstanding five-part test for \u201ccurrently accepted medical use.\u201d<\/p>\n<p>SAM CEO <a href=\"https:\/\/x.com\/KevinSabet?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@KevinSabet<\/a> discusses the latest major development in the DEA rescheduling hearing\u2026 <a href=\"https:\/\/t.co\/OPhoPVk79x\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/OPhoPVk79x<\/a><\/p>\n<p>\u2014 Smart Approaches to Marijuana (@learnaboutsam) <a href=\"https:\/\/x.com\/learnaboutsam\/status\/2071971101337403882?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">June 30, 2026<\/a><\/p>\n<\/blockquote>\n<p \/><\/div>\n<p>In 2024, the Department of Justice\u2019s (DOJ) Office of Legal Counsel (OLC)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/attorney-general-formally-moves-to-reschedule-marijuana-but-dea-signals-resistance-despite-doj-legal-review\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">said the prior five-part test was \u201cimpermissibly narrow\u201d<\/a> and said the two-part review \u201cis sufficient to establish that a drug has CAMU even if the drug has not been approved by FDA and would not satisfy DEA\u2019s five-part test.\u201d<\/p>\n<p>DEA has since <a href=\"https:\/\/www.marijuanamoment.net\/dea-acknowledges-new-two-step-test-for-marijuanas-accepted-medical-use-is-legitimate\/\" target=\"_blank\" rel=\"nofollow noopener\">embraced the new approach to evaluating cannabis for CAMU<\/a> and it has been used to subsequently evaluate other substances.<\/p>\n<p>While the rescheduling proceedings are not being livestreamed to the public in line with requests from Marijuana Moment, a congressman and others, Marijuana Moment spoke to several people who were in the room for the hearing to get a sense of how the testimony is going. Quotes from participants come from sources\u2019 notes and have not been verified, as official transcripts have not yet been made available.<\/p>\n<p>On Monday, the first day of the hearing, DEA lawyers\u00a0highlighted testimony on <a href=\"https:\/\/www.marijuanamoment.net\/dea-and-fda-highlight-how-marijuana-is-safer-than-alcohol-and-opioids-during-rescheduling-hearings-opening-day\/\" target=\"_blank\" rel=\"nofollow noopener\">marijuana\u2019s medical benefits and its relative safety compared to other substances such as alcohol and opioids<\/a>.<\/p>\n<p>Also on Tuesday,\u00a0 government\u2019s second witness, Corey Burchman, a medical doctor from New Hampshire, began his testimony, with a focus on how <a href=\"https:\/\/www.marijuanamoment.net\/dea-will-highlight-testimony-on-marijuanas-medical-benefits-in-rescheduling-hearing-new-filing-shows\/\" target=\"_blank\" rel=\"nofollow noopener\">medical marijuana provides relief to pain patients and can serve as an alternative to opioids.<\/a><\/p>\n<p>Once medical cannabis became available, he and colleagues would \u201cavidly use that ability to limit opioids,\u201d he said\u2014adding that some patients were able to fully transition off of the prescription painkillers. It was \u201cpositive\u201d and \u201cbenefitted patients,\u201d he said.<\/p>\n<p>\u201cIt is extremely helpful in chronic pain patients as a means of analgesia,\u201d Burchman testified.<\/p>\n<p>He also spoke about the relatively safety and effects of cannabis and opioids.<\/p>\n<p>\u201cWithdrawal from opioids is like a dumpster fire,\u201d he said. \u201cWithdrawal from marijuana is more like dying glowing ember of a campfire.\u201d<\/p>\n<p>Ahead of the hearing\u2019s start on Monday, marijuana reform activists held a <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-activists-say-theyre-being-shut-out-of-deas-rescheduling-hearing-that-features-only-legalization-opponents\/\" target=\"_blank\" rel=\"nofollow noopener\">press conference outside DEA headquarters to highlight how they feel the have been \u201cshut out\u201d<\/a> of the process\u2014criticizing the fact that no supporters of reform were invited to participate and that the proceedings are not being livestreamed despite officials\u2019 vows of \u201ctransparency.\u201d<\/p>\n<p>DEA Administrator Terrance Cole <a href=\"https:\/\/www.marijuanamoment.net\/dea-picks-participants-for-marijuana-rescheduling-hearing-this-month-and-only-opponents-are-invited\/\" target=\"_blank\" rel=\"nofollow noopener\">invited only organizations and people who oppose marijuana reform to join the hearing<\/a> as designated participants\u2014telling supporters that they do not meet the definition of an \u201cinterested person\u201d to participate because they are not \u201cadversely affected or aggrieved by any rule or proposed rule issuable.\u201d<\/p>\n<p>Last week, <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-moment-takes-ask-for-rescheduling-hearing-livestreaming-directly-to-dea-head-after-judge-says-he-wont-consider-request\/\" target=\"_blank\" rel=\"nofollow noopener\">Marijuana Moment sent requests to DEA Chief Administrative Law Judge Derek Julius and to Cole, the DEA administrator,<\/a> requesting they <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-moment-asks-dea-judge-to-allow-livestreaming-of-rescheduling-hearing-for-transparent-public-access\/\" target=\"_blank\" rel=\"nofollow noopener\">reverse a decision to prohibit the public from tuning into the cannabis hearing via livestream<\/a>. If you rely on our reporting to stay informed about key cannabis developments, please help us keep doing this by <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/membership\" target=\"_blank\" rel=\"noopener\">becoming a sustaining subscriber today<\/a>.<\/strong><\/p>\n<p><strong>Backing us at the $25\/month level also gets you access to our Bill Tracker so you won\u2019t miss any important marijuana legislation in your state.<\/strong><br \/>\n<strong>\u2014<\/strong><\/p>\n<p>Rescheduling opponents that are participating in the hearing filed statements last week <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-opponents-preview-arguments-for-next-weeks-rescheduling-hearing-in-new-filings\/\" target=\"_blank\" rel=\"nofollow noopener\">previewing the anti-marijuana arguments they intend to make<\/a> during the proceedings.<\/p>\n<p>The <a href=\"https:\/\/www.dea.gov\/marijuana-rescheduling-regulatory-actions\" target=\"_blank\" rel=\"noopener\">hearing<\/a> is set to conclude no later than July 15.<\/p>\n<p>Acting Attorney General Todd Blanche in April <a href=\"https:\/\/www.marijuanamoment.net\/federal-marijuana-rescheduling-announced-by-department-of-justice-months-after-trump-executive-order\/\" target=\"_blank\" rel=\"nofollow noopener\">issued an order that immediately reclassified state-licensed medical cannabis<\/a>, as well as marijuana products approved by the Food and Drug Administration (FDA) from Schedule I of the Controlled Substances Act (CSA) to Schedule III.<\/p>\n<p>Under a separate order the acting attorney general signed, the upcoming hearing will consider more comprehensively moving marijuana to Schedule III.<\/p>\n<p>A prior hearing process on the marijuana rescheduling process that was initiated by the Biden administration <a href=\"https:\/\/www.marijuanamoment.net\/dea-judge-cancels-marijuana-rescheduling-hearings-amid-legal-challenges-pushing-back-reform-for-at-least-three-months\/\" target=\"_blank\" rel=\"nofollow noopener\">stalled last year amid litigation over alleged improper communications and witness selection<\/a>.<\/p>\n<p>The current <a href=\"https:\/\/www.marijuanamoment.net\/drug-testing-industry-and-pharmaceutical-company-ask-court-to-pause-trumps-marijuana-rescheduling-move\/\" target=\"_blank\" rel=\"nofollow noopener\">marijuana rescheduling process is being challenged with several lawsuits<\/a> that have been consolidated by a federal appeals court. Those pieces of <a href=\"https:\/\/www.marijuanamoment.net\/louisiana-attorney-general-withdraws-from-lawsuit-against-trump-administrations-marijuana-rescheduling-move\/\" target=\"_blank\" rel=\"nofollow noopener\">litigation against the cannabis reform have been filed by state attorneys general<\/a>, <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-opponents-file-lawsuit-to-block-trump-administrations-federal-rescheduling-move\/\" target=\"_blank\" rel=\"nofollow noopener\">marijuana legalization opponents<\/a> and a <a href=\"https:\/\/www.marijuanamoment.net\/trump-is-being-sued-for-rescheduling-marijuana-by-doctors-and-a-pharmaceutical-company-who-are-aggrieved-by-the-move\/\" target=\"_blank\" rel=\"nofollow noopener\">cannabis-focused biopharmaceutical corporation<\/a>.<\/p>\n<p>Meanwhile, the already-enacted rescheduling of state-licensed medical cannabis is already having broad impacts.<\/p>\n<p><a href=\"https:\/\/www.marijuanamoment.net\/congressional-report-explains-implications-and-limitations-of-trumps-marijuana-rescheduling-move-for-users-and-industry\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">The Congressional Research Service published a report on the current cannabis rescheduling move<\/a>\u00a0explaining that certified patients who possess medical marijuana from state-licensed dispensaries now have certain protections under Schedule III. \u201cThe order appears to authorize end users to possess marijuana for medical use without a CSA-compliant prescription,\u201d it says.<\/p>\n<p>The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has posted a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-atf-gun-form-recognizes-medical-marijuanas-federally-legal-status-under-trumps-rescheduling-move\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">draft update to a gun purchase form to acknowledge the federally legal status of medical marijuana<\/a>\u00a0under rescheduling. The revised section in question\u00a0notably says that only \u201cuse or possession of marijuana for recreational purposes\u201d is federally prohibited, leaving out the prior form\u2019s mention of medical cannabis.<\/p>\n<p>The U.S. Department of the Treasury and Internal Revenue Service (IRS) said they plan to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/feds-announce-marijuana-industry-tax-guidance-is-coming-as-rescheduling-takes-effect\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">issue new tax guidance for the marijuana industry<\/a>\u00a0following rescheduling. The reform will benefit state-licensed marijuana businesses by allowing them to take federal tax deductions they\u2019re currently barred from under an IRS code known as 280E that doesn\u2019t apply to Schedule III substances.<\/p>\n<p>Even DEA, which has long opposed cannabis legalization and was accused of stalling the rescheduling process initiative by the Biden administration, has <a href=\"https:\/\/www.marijuanamoment.net\/dea-announces-new-marijuana-registration-forms-for-manufacturing-distribution-and-testing-businesses\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">launched a registration process for state-legal marijuana businesses<\/a>\u00a0to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/state-licensed-marijuana-businesses-can-now-apply-for-federal-protections-using-new-dea-form\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">take advantage of federal benefits that come with the reform<\/a>.<\/p>\n<p>The Department of Transportation, on the other hand, issued guidance saying that use of <a href=\"https:\/\/www.marijuanamoment.net\/truckers-and-pilots-still-cant-use-medical-marijuana-even-though-trump-reclassified-it-transportation-department-says\/\" target=\"_blank\" rel=\"nofollow noopener\">state-legal medical cannabis is still no excuse for a positive drug test by truck drivers<\/a>, pilots and other safety-sensitive workers.<\/p>\n<p>A congressional committee recently <a href=\"https:\/\/www.marijuanamoment.net\/congressional-committee-votes-to-block-marijuana-rescheduling-even-as-trump-administration-moves-forward-with-the-reform\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">voted to\u00a0block federal officials from taking further steps to carry out cannabis rescheduling<\/a>, though <a href=\"https:\/\/www.marijuanamoment.net\/congress-wont-block-trumps-marijuana-rescheduling-move-bipartisan-lawmakers-say-as-hearing-on-reform-begins\/\" target=\"_blank\" rel=\"nofollow noopener\">bipartisan lawmakers told Marijuana Moment they don\u2019t believe that provision will be enacted<\/a> into law.<\/p>\n<p><em>Photo courtesy of <a
