{"id":86245,"date":"2026-07-01T06:54:59","date_gmt":"2026-07-01T14:54:59","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/07\/01\/delaware-lawmakers-override-governors-veto-of-marijuana-bill-to-limit-restrictive-local-business-zoning-rules\/"},"modified":"2026-07-01T19:48:26","modified_gmt":"2026-07-02T03:48:26","slug":"delaware-lawmakers-override-governors-veto-of-marijuana-bill-to-limit-restrictive-local-business-zoning-rules","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/07\/01\/delaware-lawmakers-override-governors-veto-of-marijuana-bill-to-limit-restrictive-local-business-zoning-rules\/","title":{"rendered":"Delaware Lawmakers Override Governor\u2019s Veto Of Marijuana Bill To Limit Restrictive Local Business Zoning Rules"},"content":{"rendered":"<\/p>\n<p>Delaware lawmakers have voted to override the governor\u2019s veto of a bill that would prevent local governments from imposing onerous zoning restrictions <a href=\"https:\/\/www.marijuanamoment.net\/after-delaware-governor-vetoes-bill-to-block-restrictive-marijuana-zoning-rules-senator-says-he-lied-about-a-deal-to-enact-it\/\" target=\"_blank\" rel=\"nofollow noopener\">that make it more challenging for marijuana businesses to operate in their jurisdictions<\/a>.<\/p>\n<p>The House of Representatives voted 25-16 early Wednesday morning to overturn the veto from Gov. Matt Meyer (D), <a href=\"https:\/\/www.marijuanamoment.net\/delaware-senate-votes-to-override-governors-veto-of-marijuana-bill-that-would-limit-restrictive-local-business-zoning-rules\/\" target=\"_blank\" rel=\"nofollow noopener\">following the Senate, which did so back in January<\/a>.<\/p>\n<p>House Majority Whip Ed Osienski (D) motioned for the override in his chamber, saying that the decision to take the action came after the state Supreme Court determined in May that state officials have authority over land-use issues.<\/p>\n<p>\u201cThe General Assembly controls zoning power,\u201d he said, Spotlight Delaware <a href=\"https:\/\/spotlightdelaware.org\/2026\/07\/01\/delaware-lawmakers-stay-up-late-to-pass-bond-bill-veto-override-others\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>Bill sponsor Sen. Trey Paradee (D), who sharply criticized Meyer immediately after the veto and alleged that he \u201clied\u201d about a deal to get the legislation enacted last year, changed his tone somewhat ahead of the override vote in his chamber earlier this year, stating that lawmakers did not intend to reject the veto as a \u201cpersonal attack\u201d on the governor.<\/p>\n<p>\u201cThis is not about personalities. This is not about politics,\u201d the senator said. \u201cThis is about policy\u2014and, more specifically, it is about whether the General Assembly is willing to stand behind the policy choices we already made in 2023 or whether we are comfortable allowing those choices to slowly collapse under the weight of inaction and obstruction.\u201d<\/p>\n<p>Despite efforts to stand up the cannabis industry, \u201cwe have not meaningfully expanded the number of operating retail dispensaries,\u201d he said, adding that the state \u201ccreated expectations\u201d about entrepreneurial growth but then \u201cleft license holders stranded.\u201d<\/p>\n<p>\u201cWe have created a licensing system that promises opportunity while tolerating a local land use environment that prevents those licenses from ever being used,\u201d he said. \u201cThat is not regulation. That is paralysis.\u201d<\/p>\n<p><a href=\"https:\/\/www.marijuanamoment.net\/delawares-first-recreational-marijuana-shops-are-officially-open-for-business\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">Delaware\u2019s adult-use cannabis market launched<\/a> last August, with the governor <a href=\"https:\/\/www.marijuanamoment.net\/delaware-governor-touts-nearly-1-million-in-marijuana-sales-during-states-first-weekend-of-adult-use-market\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">touting the state\u2019s first \u201csuccessful\u201d weekend of adult-use cannabis sales<\/a>, with total purchases for medical and recreational marijuana totaling nearly $1 million\u2014and compliance checks demonstrating that the regulated market is operating as intended under the law.<\/p>\n<p>But when it comes to local control, Meyer aligned himself with county governments in a way that Pardee and others say is kneecapping the industry with zoning restrictions that limit the expansion of the commercial market.<\/p>\n<p>\u201cA weak legal market only serves to strengthen the illegal market,\u201d Pardee said. \u201cThe first step to displacing the illicit market is not more rhetoric, it is building a functional, accessible, regulated legal market. The first step to building that market is allowing licensed businesses to open.\u201d<\/p>\n<p>The legislation that lawmakers passed and the governor, a former New Castle County executive, vetoed would \u201cprevent zoning from being used as a disguised prohibition,\u201d Pardee said.<\/p>\n<p>\u201cIt establishes a reasonable statewide floor so that state-issued licenses have a realistic path to existence. That is all <a href=\"https:\/\/legis.delaware.gov\/BillDetail\/141969\" target=\"_blank\" rel=\"noopener\">Senate Bill 75<\/a> is about: Finishing the job,\u201d he said. \u201cIt is about preventing local zoning from being used as a <em>de facto<\/em> ban on a legal state-authorized industry.\u201d<\/p>\n<p>\u201cIt does not force any business to open. It does not eliminate reasonable setbacks or safety rules. It does not strip counties of land use authority,\u201d the senator continued. \u201cWhat it does is establish a basic statewide floor so that, if the state issues a license, there is at least a realistic path forward to use it. That is fairness. That is regulatory integrity. That is good government.\u201d<\/p>\n<p style=\"padding-left: 40px\">\u201cIf we allow the governor\u2019s veto to stand, we are effectively telling conditional license holders, you want a license, but we never intended to give you a place to operate. We are telling investors Delaware\u2019s word is conditional. We\u2019re telling entrepreneurs, apply at your own risk. That is not the message a serious state sends. Colleagues, we legalized adult-use cannabis. That decision has already been made. The question before us today is not whether marijuana should be legal. The question is whether we\u2019re going to regulate the legal market competently. The question is whether we are comfortable watching surrounding states collect the revenue, create the jobs and build the infrastructure that could be built here. The question is whether we allow local zoning to quietly nullify state law.\u201d<\/p>\n<p>\u201cI believe the answer must be \u2018no.\u2019 Overriding this veto is not radical\u2014is not reckless. It is responsible. It is a course correction,\u201d he said. \u201cIt says that, when Delaware creates a licensing system, we intend for it to function. It says that, when we promise opportunity, we mean it. It says that state law cannot be rendered meaningless by a patchwork of local prohibitions. This is about honoring the law we passed. This is about protecting Delaware\u2019s economic interests. This is about moving forward instead of standing still.\u201d<\/p>\n<p>The governor, for his part, has said he stands by his veto even as he continues to support marijuana legalization.<\/p>\n<p>In January, he said he doesn\u2019t think \u201cthe state should require every county and certainly localities to have marijuana stores 500 feet from the local elementary school.\u201d<\/p>\n<p>\u201cI think it\u2019s a local decision,\u201d he said. \u201cThat\u2019s what I think.\u201d<\/p>\n<p>Last year, Meyer detailed a <a href=\"https:\/\/www.marijuanamoment.net\/delaware-governor-seeks-marijuana-regulation-advice-from-colorado-counterpart-as-states-legal-market-launches\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">conversation he had with Colorado Gov. Jared Polis (D) about regulating the marijuana industry<\/a>\u2014drawing a contrast between their respective responsibilities given the fact that Colorado is much larger with more local jurisdictions to interact with compared to Delaware, which has just three counties.<\/p>\n<p>The launch of Delaware\u2019s legal market came about <a href=\"https:\/\/www.marijuanamoment.net\/delaware-governor-will-allow-marijuana-legalization-and-sales-bills-to-become-law\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">two years after marijuana legalization was enacted into law<\/a>\u00a0under former Gov. John Carney (D).<\/p>\n<p>Ahead of the sales roll-out, the governor last July toured one of the state\u2019s cannabis cultivation facilities, praising the quality of marijuana that\u2019s being produced, <a href=\"https:\/\/www.marijuanamoment.net\/delaware-governor-tours-marijuana-grow-ahead-of-friday-sales-launch-saying-state-will-produce-the-french-wine-of-weed\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">which he said will be the \u201cFrench wine of weed.\u201d<\/a><\/p>\n<p>The launch of the legal market came with some controversy, however, with <a href=\"https:\/\/www.marijuanamoment.net\/critics-say-delawares-retail-marijuana-sales-launch-is-unfair-prioritizing-existing-medical-operators\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">critics alleging that allowing medical operators to start adult-use sales ahead of other license applicants is unfair<\/a>. Dozens of other would-be retailers that have either already received licenses or are still awaiting issuance will need to wait for further regulatory approvals until they can open their doors\u2014a situation that\u2019s frustrated some advocates.<\/p>\n<p>Meanwhile, two lawmakers who led the push to legalize marijuana are separately seeking input from consumers and businesses about the market launch. Paradee, the sponsor of SB 75, and House Majority Whip Rep. Ed Osienski (D)\u2014the primary sponsor of the state\u2019s 2023 legalization bills\u2014<a href=\"https:\/\/www.marijuanamoment.net\/delaware-lawmakers-seek-marijuana-consumer-and-business-input-ahead-of-states-legal-sales-launch-next-month\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">put out a new online form last year for residents to share thoughts and feedback about the cannabis program anonymously<\/a>.<\/p>\n<p>The idea is to identify any hiccups that lawmakers might need to address when they return for next year\u2019s legislative session.<\/p>\n<p>The Office of Cannabis Management (OCM) initially projected that recreational sales would start by last March, but complications related to securing an FBI fingerprint background check service code delayed the implementation. Lawmakers passed a bill in April to resolve the issue, and the <a href=\"https:\/\/www.marijuanamoment.net\/fbi-grants-delaware-marijuana-officials-a-fingerprint-service-code-allowing-launch-of-legal-market-to-proceed\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">FBI subsequently issued the code that the stat\u2019s marijuana law requires<\/a>.<\/p>\n<p><strong>\u2014<br \/>\nMarijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking hundreds of cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/p>\n<p>Meanwhile, Meyer signed a bill in May to <a href=\"https:\/\/www.marijuanamoment.net\/delaware-governor-signs-bill-allowing-medical-marijuana-use-in-hospitals-by-terminally-ill-patients\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">allow terminally ill patients to use medical cannabis in hospitals<\/a>\u00a0and other healthcare facilities.<\/p>\n<p>Separately, a Delaware House committee this session <a href=\"https:\/\/www.marijuanamoment.net\/delaware-lawmakers-approve-bill-to-decriminalize-public-marijuana-use-and-remove-threat-of-jail-time\/\" target=\"_blank\" rel=\"nofollow noopener\">approved a bill to decriminalize public consumption of marijuana<\/a>, but it didn\u2019t advance further.<\/p>\n<p>While certain legal marijuana states like Colorado and Ohio still impose criminal penalties for public cannabis use, Delaware stands out as especially punitive, with a maximum penalty that carries the risk of jail time in addition to a fine<\/p>\n<p>In 2024, OMC held a series of\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/delaware-officials-will-hold-first-marijuana-license-lottery-this-week-ahead-of-adult-use-market-launch\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">licensing lotteries for cannabis business<\/a>\u00a0to start serving adult consumers.<\/p>\n<p>A total of 125 licenses will ultimately be issued, including 30 retailers, 60 cultivators, 30 manufacturers and five testing labs.
