{"id":86169,"date":"2026-06-16T09:30:20","date_gmt":"2026-06-16T17:30:20","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/06\/16\/federal-marijuana-rescheduling-does-not-appear-to-apply-to-washington-businesses-state-officials-say\/"},"modified":"2026-06-17T19:46:38","modified_gmt":"2026-06-18T03:46:38","slug":"federal-marijuana-rescheduling-does-not-appear-to-apply-to-washington-businesses-state-officials-say","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/06\/16\/federal-marijuana-rescheduling-does-not-appear-to-apply-to-washington-businesses-state-officials-say\/","title":{"rendered":"Federal Marijuana Rescheduling \u2018Does Not Appear To Apply\u2019 To Washington Businesses, State Officials Say"},"content":{"rendered":"<\/p>\n<p>Marijuana regulators in Washington say that the Trump administration\u2019s move to reschedule cannabis on the federal level \u201cdoes not appear to apply\u201d to businesses in the state.<\/p>\n<p>The U.S. Department of Justice in April <a href=\"https:\/\/www.marijuanamoment.net\/federal-marijuana-rescheduling-announced-by-department-of-justice-months-after-trump-executive-order\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">issued an order that immediately reclassified state-licensed medical cannabis<\/a>, as well as marijuana products approved by the Food and Drug Administration (FDA) from Schedule I of the Controlled Substances Act\u00a0 (CSA) to Schedule III. A hearing scheduled for later this month\u00a0will <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-legalization-supporters-and-opponents-file-notices-to-participate-in-dea-hearing-on-rescheduling-next-month\/\" target=\"_blank\" rel=\"nofollow noopener\">consider more comprehensively moving marijuana to Schedule III<\/a>.<\/p>\n<p>\u201cWashington does not license medical cannabis producers, processors, or retailers,\u201d the state Liquor and Cannabis Board (LCB) said in guidance published on Tuesday. \u201cInstead, Washington has a single recreational market and within that market producers\/processors may manufacture [Department of Health]-compliant products, and certain retailers may sell DOH-compliant products to all adult patients and designated providers.\u201d<\/p>\n<p>\u201cBecause of this, Washington\u2019s cannabis licensees do not appear to qualify as \u2018state medical marijuana licensee[s]\u2019 and therefore may not be eligible to register under the Final Rule,\u201d the agency said, referring to a Drug Enforcement Administration (DEA) <a href=\"https:\/\/www.marijuanamoment.net\/dea-announces-new-marijuana-registration-forms-for-manufacturing-distribution-and-testing-businesses\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">registration process for state-legal marijuana businesses<\/a>\u00a0to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/state-licensed-marijuana-businesses-can-now-apply-for-federal-protections-using-new-dea-form\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">take advantage of federal benefits that come with the reform<\/a>.<\/p>\n<p>That said, LCB is \u201cnot taking a position to prevent licensees from applying for federal registration if they choose,\u201d the guidance continues. \u201cIf any licensee does apply for federal registration, we would be interested in learning about their experience and any federal determination.\u201d<\/p>\n<p>Nonetheless,\u00a0\u201cbased on our analysis, federal rescheduling in its current form does not appear to apply to Washington\u2019s cannabis licensees due to the statutory framework predominately regulating recreational cannabis,\u201d LCB said.<\/p>\n<p>The agency did stress, however, that while it has consulted with the Cannabis Regulators Association, National Governors Association and industry stakeholders, its current view does not represent the formal opinion of Washington and \u201cmay not be our final interpretation as information is evolving and the determination may not rest with the state.\u201d<\/p>\n<p>\u201cWe expect additional guidance from involved federal agencies, new or updated federal agency processes, and\/or other federal proceedings,\u201d it <a href=\"https:\/\/content.govdelivery.com\/accounts\/WALCB\/bulletins\/41c1c1a\" target=\"_blank\" rel=\"noopener\">said<\/a>, citing the upcoming administrative hearing and <a href=\"https:\/\/www.marijuanamoment.net\/drug-testing-industry-and-pharmaceutical-company-ask-court-to-pause-trumps-marijuana-rescheduling-move\/\" target=\"_blank\" rel=\"nofollow noopener\">ongoing litigation challenging cannabis rescheduling<\/a>.<\/p>\n<p style=\"padding-left: 40px\">\u201cThe LCB recognizes there are many cannabis producers, processors, and retailers that actively engage in the production and sales of medical cannabis in Washington. These businesses may or may not have an opportunity to use the 280e tax deduction and additionally register with the DEA for a schedule III permit. The determination of the applicability of 280e and qualification for DEA schedule III permits is with the federal government and not with the state of Washington. It is possible that the state of Washington will ultimately not have any input into the determination as to whether its licensees meet the criteria for \u2018state medical marijuana licensees,\u2019 as DOJ may make that determination unilaterally. DOJ has the authority to reasonably interpret the meaning of the Final Rule, and a determination that Washington cannabis licensees do qualify as \u2018state medical marijuana licensee[s].&#8217;\u201d<\/p>\n<p>The U.S. Department of the Treasury and Internal Revenue Service (IRS) said they plan to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/feds-announce-marijuana-industry-tax-guidance-is-coming-as-rescheduling-takes-effect\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">issue new tax guidance for the marijuana industry<\/a>\u00a0following rescheduling.
