{"id":86162,"date":"2026-06-17T04:02:44","date_gmt":"2026-06-17T12:02:44","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/06\/17\/south-carolina-gop-governor-candidates-are-open-to-signing-medical-marijuana-legalization-bill-they-say-during-debate\/"},"modified":"2026-06-17T19:46:25","modified_gmt":"2026-06-18T03:46:25","slug":"south-carolina-gop-governor-candidates-are-open-to-signing-medical-marijuana-legalization-bill-they-say-during-debate","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/06\/17\/south-carolina-gop-governor-candidates-are-open-to-signing-medical-marijuana-legalization-bill-they-say-during-debate\/","title":{"rendered":"South Carolina GOP Governor Candidates Are Open To Signing Medical Marijuana Legalization Bill, They Say During Debate"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2026\/06\/MM_Bill_Tracker_V5_blank-7.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>The two South Carolina Republican candidates in a runoff election for their party\u2019s nomination to serve as the state\u2019s next governor say they are open to signing legislation to legalize medical marijuana if elected to the job.<\/p>\n<p>The moderator of a debate on Tuesday noted that \u201ceven ruby red states\u201d are moving to allow medical cannabis use, pressing both contenders on whether they believe there is a pathway for it to be legalized in South Carolina.<\/p>\n<p>Pamela Evette, currently the state\u2019s lieutenant governor, said her father died a \u201chorrible death\u201d from lung cancer and that \u201cif I could have given him something that would have eased his pain in the last few days of his life, I would have done it.\u201d<\/p>\n<p>\u201cIf the General Assembly can bring me, as governor, a piece of legislation that doesn\u2019t end up being an open door to recreational use, I would heavily sit down and look at that,\u201d she said.<\/p>\n<p>\u201cBut I would bring in experts and doctors to make sure that we can tighten that to really just help people who medically need it, people who have tried everything and people who are sitting in the last minutes of their life\u2014because nobody should have to watch their loved one die in pain,\u201d Evette said.<\/p>\n<p \/>\n<p>She also noted that she and incumbent Gov. Henry McMaster (R) have already worked \u201cvery close\u201d with law enforcement on the issue\u2014though comprehensive medical cannabis legislation has never reached the governor\u2019s desk in South Carolina.<\/p>\n<p>Alan Wilson, who currently serves as state attorney general, said during Tuesday\u2019s debate that he \u201cwould be open to on the medical side. \u201d<\/p>\n<p>\u201cI have always taken the position and agree with what the Trump administration did,\u201d he said. \u201cThe Trump administration called for the rescheduling of marijuana from a Schedule I to a Schedule III. What that means is it can be studied for medical application, which it couldn\u2019t, as a Schedule I drug.\u201d<\/p>\n<p>\u201cI have met with so many veterans who are suffering from PTSD, people that I\u2019ve actually served with in Iraq. I have met with people suffering with seizures, people suffering with chronic illness, people suffering, people who are terminal,\u201d Wilson said. \u201cAnd if there is a possibility that we could derive some use from the medical application of that, then South Carolina should follow suit with what the federal government is doing, and have clearly defined laws and regulations that prevent it from being abused. I would be open to the medical use of it.\u201d<\/p>\n<p>Like Evette, the attorney general noted, however, that he does not support legalizing marijuana for recreational use.<\/p>\n<p>\u201cObviously, I\u2019ve spoken with law enforcement leaders all over the country, as well as elected leaders, both in the Republican and Democratic parties, who have told me, \u2018whatever you do, do not have recreational marijuana,&#8217;\u201d he said. \u201cThey can\u2019t say that publicly in their home states, but they said it has been an absolute disaster.\u201d<\/p>\n<p>The primary runoff election between the two candidates is on Tuesday.<\/p>\n<p>Democratic gubernatorial nominee Jermaine Johnson, currently a state representative, says on his campaign website that \u201cit\u2019s time for South Carolina to make medicinal marijuana safe, legal, and accessible.\u201d<\/p>\n<p>\u201cThis means more jobs and income for farmers, a state wide tax on cannabis that will allow us to balance the budget, and medical freedom for people who are suffering,\u201d it says. \u201cAdditionally, Jermaine will commute the sentence of all prisoners who have non-violent marijuana related charges. This will relieve the burden on our state\u2019s prison system and restore families who have been destroyed by punitive and antiquated drug policies.\u201d<\/p>\n<p>The campaign also says Johnson would seek to \u201cput recreational cannabis to a state-wide referendum.\u201d<\/p>\n<div class=\"embed-x\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">We need a smarter approach to marijuana policy.<\/p>\n<p>Legalize medical use.<br \/>Pardon non-violent charges.<br \/>Let the people decide recreational use through a statewide referendum.<\/p>\n<p>Compassion. Accountability.<a href=\"https:\/\/t.co\/gWBw9vMJ3w\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/gWBw9vMJ3w<\/a> <a href=\"https:\/\/t.co\/7A9n4reVSS\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/7A9n4reVSS<\/a><\/p>\n<p>\u2014 Jermaine Johnson &#x1f1fa;&#x1f1f8; (@Dr_JLJohnson) <a href=\"https:\/\/x.com\/Dr_JLJohnson\/status\/2046260735324418365?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">April 20, 2026<\/a><\/p>\n<\/blockquote>\n<p \/><\/div>\n<p>Republican candidates for South Carolina attorney general recently <a href=\"https:\/\/www.marijuanamoment.net\/south-carolina-gop-attorney-general-candidates-clash-on-medical-marijuana-and-hemp-during-debate\/\" target=\"_blank\" rel=\"nofollow noopener\">clashed on medical cannabis and hemp issues during a debate<\/a>.<\/p>\n<p>Meanwhile, a\u00a0Republican <a href=\"https:\/\/www.marijuanamoment.net\/medical-marijuana-is-now-legal-in-south-carolina-gop-senator-declares-as-republican-governor-candidate-calls-it-a-gateway-drug\/\" target=\"_blank\" rel=\"nofollow noopener\">South Carolina state senator said that \u201cmedical marijuana is now legal\u201d in the state<\/a> following the <a href=\"https:\/\/www.marijuanamoment.net\/federal-marijuana-rescheduling-announced-by-department-of-justice-months-after-trump-executive-order\/\" target=\"_blank\" rel=\"nofollow noopener\">Trump administration\u2019s move to enact federal rescheduling<\/a>.<\/p>\n<p>State Sen. Tom Davis (R), who has sponsored bills to legalize medical cannabis over a number of sessions, said that under a little-known state law he believes was triggered by federal rescheduling, \u201cwe have just become the 41st state that has a legally authorized medical marijuana program.\u201d<\/p>\n<p>State statute says that \u201cif a substance is added, deleted, or rescheduled as a controlled substance pursuant to federal law or regulation,\u201d officials then have 30 days to reschedule the drug in the \u201cappropriate schedule\u201d under state law.<\/p>\n<p>A separate law, the South Carolina Controlled Substances Therapeutic Research Act, passed in 1980, sets up a program through which certain patients could obtain medical cannabis \u201cthrough whatever means\u201d the state health commissioner \u201cdeems most appropriate consistent with federal law.\u201d<\/p>\n<p>The governor\u2019s office confirmed to local media that <a href=\"https:\/\/www.marijuanamoment.net\/south-carolina-patients-could-get-medical-marijuana-access-under-state-laws-triggered-by-federal-rescheduling\/\" target=\"_blank\" rel=\"nofollow noopener\">South Carolina law will \u201crequire the State to mirror the new federal order\u201d on marijuana rescheduling<\/a>. And the South Carolina Department of Public Health (DPH) said that officials are \u201caware of the proposed rescheduling of medical marijuana from Schedule I to Schedule III under the Controlled Substances Act\u201d and are \u201cassessing the impacts to DPH and the state of South Carolina.\u201d<\/p>\n<p>Last year, <a href=\"https:\/\/www.marijuanamoment.net\/south-carolina-gop-governor-says-theres-compelling-case-for-medical-marijuana-as-house-leader-remains-skeptical\/\" target=\"_blank\" rel=\"nofollow noopener\">South Carolina\u2019s governor said there\u2019s a \u201ccompelling\u201d case to be made for legalizing medical marijuana<\/a> in the state, despite reservations from law enforcement.<\/p>\n<p>\u201cI think what we need to do is study it very carefully, get as much information as we can and try to do the right thing,\u201d he said.<\/p>\n<p>The office of House Speaker Murrell Smith (R) tempered expectations, however, referencing what he viewed as insufficient support within the GOP caucus to advance the reform through his chamber.<\/p>\n<p>An earlier version of Davis\u2019s cannabis measure <a href=\"https:\/\/www.marijuanamoment.net\/south-carolina-medical-marijuana-bill-wont-receive-house-vote-by-end-of-session-committee-chair-says\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">passed the Senate in the 2024 session but was never taken up in the House<\/a>. He <a href=\"https:\/\/www.marijuanamoment.net\/south-carolina-senator-files-bill-to-legalize-medical-marijuana-in-2025-as-an-alternative-to-opioids-for-patients-with-pain\/\" target=\"_blank\" rel=\"nofollow noopener\">filed a new version for the 2025 session<\/a>, but it did not advance.<\/p>\n<p>\u201cIt requires doctors in patient authorization, doctor supervision,\u201d Davis said at the time. \u201cIt requires pharmacists to dispense it. It is a very conservative bill, because that\u2019s what South Carolinians want.\u201d<\/p>\n<p>As introduced, the legislation would allow patients to access medical marijuana from \u201ctherapeutic cannabis pharmacies,\u201d which would be licensed by the state Board of Pharmacy. Individuals would need to receive a doctor\u2019s recommendation for the treatment of certain qualifying conditions, which include several specific ailments as well as terminal illnesses and chronic diseases where opioids are the standard of care.<\/p>\n<p>Among the public,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/as-south-carolina-lawmakers-urge-house-vote-on-medical-marijuana-bill-new-poll-shows-strong-bipartisan-support\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">medical marijuana legalization enjoys overwhelming bipartisan support in the state<\/a>, with a 2024 poll finding that 93 percent of Democrats, 74 percent of Republicans and 84 percent of independents back the reform.<\/p>\n<p>The state Senate passed an earlier version of the legislation in 2022, but it stalled in the opposite body over a procedural href=\"https:\/\/www.marijuanamoment.net\/south-carolina-senators-square-off-over-medical-marijuana-legalization-bill-on-chamber-floor\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">began debating the medical marijuana legislation<\/a> in 2024, the body adopted an amendment that clarifies the bill does not require landlords or people who control property to allow vaporization of cannabis products.<\/p>\n<p>As debate on the legislation continued, members\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/south-carolina-senate-continues-debate-on-medical-marijuana-bill-with-lawmakers-clashing-over-changes-from-earlier-version\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">clashed over whether the current version of the legislation contains major differences<\/a>\u00a0from an earlier iteration that the body passed in 2022.<\/p>\n<p>Certain lawmakers have also raised concerns that medical cannabis legalization would lead to broader reform to allow adult-use marijuana, that it could put pharmacists with roles in dispensing cannabis in jeopardy and that federal law could preempt the state\u2019s program, among other worries.<\/p>\n<p>After Davis\u2019s Senate-passed medical cannabis bill was blocked in the House in 2022, he\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/south-carolina-medical-marijuana-legalization-bill-suffers-another-procedural-defeat\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">tried another avenue for the reform proposal<\/a>, but that similarly failed on procedural grounds.<\/p>\n<p>The lawmaker has called the stance of his own party, particularly as it concerns medical marijuana, \u201can intellectually lazy position that doesn\u2019t even try to present medical facts as they currently
