{"id":86061,"date":"2026-05-27T12:43:38","date_gmt":"2026-05-27T20:43:38","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/05\/27\/state-attorneys-general-file-lawsuit-to-block-trump-administrations-marijuana-rescheduling-move\/"},"modified":"2026-05-27T19:45:42","modified_gmt":"2026-05-28T03:45:42","slug":"state-attorneys-general-file-lawsuit-to-block-trump-administrations-marijuana-rescheduling-move","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/05\/27\/state-attorneys-general-file-lawsuit-to-block-trump-administrations-marijuana-rescheduling-move\/","title":{"rendered":"State Attorneys General File Lawsuit To Block Trump Administration\u2019s Marijuana Rescheduling Move"},"content":{"rendered":"<\/p>\n<p>Three Republican state attorneys general have filed a lawsuit challenging the <a href=\"https:\/\/www.marijuanamoment.net\/federal-marijuana-rescheduling-announced-by-department-of-justice-months-after-trump-executive-order\/\" target=\"_blank\" rel=\"nofollow noopener\">federal cannabis rescheduling action announced by President Donald Trump\u2019s Department of Justice<\/a> last month.<\/p>\n<p>The filing from the attorneys general of Indiana, Nebraska and Louisiana claims that they will \u201cshow that this agency action fails to comport with the requirements\u201d of federal law, \u201cwas improperly promulgated and was otherwise procedurally improper,\u201d \u201cexceeds or is inconsistent with pertinent authority\u201d and \u201cultimately, that this agency action is arbitrary, capricious, an abuse of discretion, and not in accordance with law.\u201d<\/p>\n<p>\u201cPetitioners thus ask that this Court declare unlawful and vacate this final agency action,\u201d the filing with the U.S. Court of Appeals for the District of Columbia Circuit says.<\/p>\n<p>On Wednesday, the court consolidated the state attorneys generals\u2019 complaint with a <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-opponents-file-lawsuit-to-block-trump-administrations-federal-rescheduling-move\/\" target=\"_blank\" rel=\"nofollow noopener\">separate suit that was filed earlier this month by prohibitionist organization Smart Approaches to Marijuana (SAM)<\/a> and the National Drug and Alcohol Screening Association (NDASA).<\/p>\n<p>\u201cWe welcome these legal challenges brought by the attorneys general, who are taking bold action to stop this illegal order,\u201d SAM CEO Kevin Sabet said in a press release. \u201cOur coalition is growing as leaders around the country recognize that this unprecedented order will cause significant harm to public health and safety. We won\u2019t rest until this dangerous action is reversed.\u201d<\/p>\n<p>SAM and NDASA alleged in their earlier filing that they have been \u201caggrieved\u201d by the federal cannabis reform.<\/p>\n<p>Under an action announced by Acting Attorney General Todd Blanche last month, marijuana products regulated by a state medical cannabis license immediately moved from Schedule I of the Controlled Substances Act (CSA) to Schedule III, as did any marijuana products that are approved by the Food and Drug Administration (FDA).
