{"id":86019,"date":"2026-05-20T11:33:05","date_gmt":"2026-05-20T19:33:05","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/05\/20\/tsa-clarifies-that-its-marijuana-policy-has-not-changed-despite-clickbait-headlines\/"},"modified":"2026-05-20T19:45:53","modified_gmt":"2026-05-21T03:45:53","slug":"tsa-clarifies-that-its-marijuana-policy-has-not-changed-despite-clickbait-headlines","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/05\/20\/tsa-clarifies-that-its-marijuana-policy-has-not-changed-despite-clickbait-headlines\/","title":{"rendered":"TSA Clarifies That Its Marijuana Policy \u2018Has Not Changed\u2019 Despite Clickbait Headlines"},"content":{"rendered":"<\/p>\n<p>Numerous news organizations over the past week have run exaggerated headlines about a supposed change in the federal government\u2019s policy on bringing marijuana into airports and on airplanes.<\/p>\n<p>But it isn\u2019t true, the Transportation Security Administration (TSA) tells Marijuana Moment.<\/p>\n<p>\u201cTSA\u2019s policy on medical marijuana has not changed,\u201d a TSA spokesperson said in an email on Wednesday.<\/p>\n<p>\u201cPer TSA\u2019s website: If any illegal substance or evidence of criminal activity is discovered during security screening, TSA will refer the matter to a law enforcement officer,\u201d they said.<\/p>\n<p>While it is true that the agency\u2019s listing for medical marijuana on the \u201cWhat Can I Bring?\u201d section of its website was updated on April 27, there was no substantive change in the policy.<\/p>\n<p>The site currently says that \u201cYes,\u201d travelers can bring medical marijuana in both carry on and checked bags, with special instructions.<\/p>\n<p>But <a href=\"https:\/\/www.marijuanamoment.net\/tsa-updates-marijuana-rules-to-allow-hemp-derived-cbd-on-flights\/\" target=\"_blank\" rel=\"nofollow noopener\">TSA cannabis policy has said \u201cYes\u201d to medical marijuana<\/a>, with the same caveats, since 2019.<\/p>\n<p>Both the <a href=\"https:\/\/www.tsa.gov\/travel\/security-screening\/whatcanibring\/items\/medical-marijuana\" target=\"_blank\" rel=\"noopener\">current<\/a> version of the page that was updated last month and an <a href=\"https:\/\/web.archive.org\/web\/20190526160254\/https:\/\/www.tsa.gov\/travel\/security-screening\/whatcanibring\/items\/medical-marijuana\" target=\"_blank\" rel=\"noopener\">archived<\/a> version from seven years ago say the following:<\/p>\n<p style=\"padding-left: 40px\">\u201cTSA\u2019s screening procedures are focused on security and are designed to detect potential threats to aviation and passengers. Accordingly, TSA security officers do not search for illegal drugs, but if any illegal substance or evidence of criminal activity is discovered during security screening, TSA will refer the matter to a law enforcement officer.\u201d<\/p>\n<p>The previous version also had this language about federally legal hemp products, but it has now been removed in the latest update:<\/p>\n<p style=\"padding-left: 40px\">\u201cPossession of marijuana and certain cannabis infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law. TSA officers are required to report any suspected violations of law, including possession of marijuana and certain cannabis infused products.<\/p>\n<p style=\"padding-left: 40px\">Products\/medications that contain hemp-derived CBD or are approved by the FDA are legal as long as it is produced within the regulations defined by the law under the Agriculture Improvement Act 2018.\u201d<\/p>\n<p>Many news organizations that didn\u2019t bother to compare the current version of the TSA page with the prior one seem to have assumed that the <a href=\"https:\/\/www.marijuanamoment.net\/federal-marijuana-rescheduling-announced-by-department-of-justice-months-after-trump-executive-order\/\" target=\"_blank\" rel=\"nofollow noopener\">Trump administration\u2019s move to federally reschedule cannabis<\/a> last month had caused the air travel safety agency to make a change in its policy, but that is not the case.<\/p>\n<p>\u201cPeriodic website updates occur for clarity and conciseness,\u201d the TSA email to Marijuana Moment on Wednesday said. \u201cTSA\u2019s policy remains the same. No changes have been made.\u201d<\/p>\n<p>Other agencies, meanwhile, have made cannabis policy changes in line with federal rescheduling.<\/p>\n<p>The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has posted a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-atf-gun-form-recognizes-medical-marijuanas-federally-legal-status-under-trumps-rescheduling-move\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">draft update to a gun purchase form to acknowledge the federally legal status of medical marijuana<\/a>\u00a0under rescheduling. The revised section in question\u00a0notably says that only \u201cuse or possession of marijuana for recreational purposes\u201d is federally prohibited, leaving out the prior form\u2019s mention of medical cannabis.<\/p>\n<p>The U.S. Department of the Treasury and Internal Revenue Service (IRS) said they plan to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/feds-announce-marijuana-industry-tax-guidance-is-coming-as-rescheduling-takes-effect\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">issue new tax guidance for the marijuana industry<\/a>\u00a0following rescheduling.
