Tom Davis (R), who has sponsored bills to legalize medical cannabis over a number of sessions, told The Post and Courier that the federal action kicks off \u201ca chain of legal consequences in South Carolina that the General Assembly can no longer ignore.\u201d<\/p>\n<p>Specifically, an existing South Carolina <a href=\"https:\/\/www.scstatehouse.gov\/code\/t44c053.php#44-53-160\" target=\"_blank\" rel=\"noopener\">law<\/a> says that \u201cif a substance is added, deleted, or rescheduled as a controlled substance pursuant to federal law or regulation,\u201d officials then have 30 days to reschedule the drug in the \u201cappropriate schedule\u201d under state law.<\/p>\n<p>A separate law, the South Carolina Controlled Substances Therapeutic Research Act, passed in 1980, sets up a program through with cancer and glaucoma patients could obtain medical cannabis \u201cthrough whatever means\u201d the state health commissioner \u201cdeems most appropriate consistent with federal law.\u201d<\/p>\n<p>Under the <a href=\"https:\/\/www.scstatehouse.gov\/sess103_1979-1980\/bills\/350.htm\" target=\"_blank\" rel=\"noopener\">legislation<\/a>, a Review Advisory Board could \u201cinclude other disease groups for participation in the controlled substances therapeutic research program after pertinent medical data have been presented by a practitioner to both the Commissioner and the board and after necessary approval is received by the appropriate federal agencies.\u201d<\/p>\n<p>Gov. Henry McMaster\u2019s (R) office confirmed to The Post and Courier that South Carolina law will \u201crequire the State to mirror the new federal order\u201d on marijuana rescheduling.<\/p>\n<p>Separately, the South Carolina Department of Public Health <a href=\"https:\/\/www.postandcourier.com\/politics\/medical-marijuana-law-south-carolina\/article_bc20bc5d-476a-410f-9c77-7bfe5e01de95.html\" target=\"_blank\" rel=\"noopener\">told<\/a> the newspaper that officials are \u201caware of the proposed rescheduling of medical marijuana from Schedule I to Schedule III under the Controlled Substances Act\u201d and are \u201cassessing the impacts to DPH and the state of South Carolina.\u201d<\/p>\n<p>Davis, the senator who has sponsored medical cannabis legalization legislation, said his bill \u201cprovides exactly the model we need: physician authorization on the front end, licensed cultivation and processing in the middle, and pharmacist dispensing on the back end\u2014a patient-centered framework that protects patients, ensures product safety, and provides the regulatory clarity that both the public and the healthcare community deserve.\u201d<\/p>\n<div class=\"embed-twitter\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">.<a href=\"https:\/\/twitter.com\/postandcourier?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@postandcourier<\/a>: \u201cThe South Carolina Compassionate Care Act provides the medical-cannabis model we need: physician authorization on the front end and pharmacist dispensing on the back end to protect patients and ensure product safety,\u201d said Sen. Tom Davis.<a href=\"https:\/\/t.co\/NcIkekO7rk\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/NcIkekO7rk<\/a><\/p>\n<p>\u2014 Tom Davis (@SenTomDavisSC) <a href=\"https:\/\/twitter.com\/SenTomDavisSC\/status\/2048029233100825036?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">April 25, 2026<\/a><\/p>\n<\/blockquote>\n<p \/><\/div>\n<p>Last year, <a href=\"https:\/\/www.marijuanamoment.net\/south-carolina-gop-governor-says-theres-compelling-case-for-medical-marijuana-as-house-leader-remains-skeptical\/\" target=\"_blank\" rel=\"nofollow noopener\">South Carolina\u2019s governor said there\u2019s a \u201ccompelling\u201d case to be made for legalizing medical marijuana<\/a> in the state, despite reservations from law enforcement.<\/p>\n<p>McMaster said at the time that he thinks supporters of the reform have a \u201cvery compelling situation,\u201d despite the fact that \u201claw enforcement, almost end-to-end, still have grave concerns.\u201d<\/p>\n<p>\u201cI think what we need to do is study it very carefully, get as much information as we can and try to do the right thing,\u201d he said.<\/p>\n<p>The office of House Speaker Murrell Smith (R) tempered expectations, however, referencing what he viewed as insufficient support within the GOP caucus to advance the reform through his chamber.<\/p>\n<p>An earlier version of Davis\u2019s cannabis measure <a href=\"https:\/\/www.marijuanamoment.net\/south-carolina-medical-marijuana-bill-wont-receive-house-vote-by-end-of-session-committee-chair-says\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">passed the Senate in the 2024 session but was never taken up in the House<\/a>. He <a href=\"https:\/\/www.marijuanamoment.net\/south-carolina-senator-files-bill-to-legalize-medical-marijuana-in-2025-as-an-alternative-to-opioids-for-patients-with-pain\/\" target=\"_blank\" rel=\"nofollow noopener\">filed a new version for the 2025 session<\/a>, but it did not advance.<\/p>\n<p>\u201cIt requires doctors in patient authorization, doctor supervision,\u201d Davis said at the time. \u201cIt requires pharmacists to dispense it. It is a very conservative bill, because that\u2019s what South Carolinians want.\u201d<\/p>\n<p>As introduced, the legislation would allow patients to access medical marijuana from \u201ctherapeutic cannabis pharmacies,\u201d which would be licensed by the state Board of Pharmacy.
