{"id":85595,"date":"2026-03-11T05:20:17","date_gmt":"2026-03-11T13:20:17","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/03\/11\/congressional-lawmakers-approve-youth-safety-bill-that-could-complicate-marijuana-businesses-online-outreach\/"},"modified":"2026-03-11T19:45:47","modified_gmt":"2026-03-12T03:45:47","slug":"congressional-lawmakers-approve-youth-safety-bill-that-could-complicate-marijuana-businesses-online-outreach","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/03\/11\/congressional-lawmakers-approve-youth-safety-bill-that-could-complicate-marijuana-businesses-online-outreach\/","title":{"rendered":"Congressional Lawmakers Approve Youth Safety Bill That Could Complicate Marijuana Businesses\u2019 Online Outreach"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2026\/03\/MM_Bill_Tracker_V5_blank-21.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>A congressional committee has approved a bill aimed at protecting children online that could create <a href=\"https:\/\/www.marijuanamoment.net\/bill-advancing-in-congress-to-protect-kids-online-could-create-complications-for-marijuana-businesses-in-legal-states\/\" target=\"_blank\" rel=\"nofollow noopener\">complications for advertisers trying to promote legal marijuana<\/a> and other regulated substances.<\/p>\n<p>Members of the House Energy and Commerce Committee last week passed the Kids Internet and Digital Safety (KIDS) Act, sponsored by Rep. Brett Guthrie (R-KY), the chair of the panel, in a 28-24 vote.<\/p>\n<p>This comes about three months after a similar proposal from Rep. Gus Bilirakis (R-FL) advanced through a subcommittee, while a Senate companion version awaits\u00a0 action.<\/p>\n<p>Under the latest legislation, online platforms would be prohibited from facilitating the \u201cadvertising of narcotic drugs, cannabis products, tobacco products, gambling, or alcohol to an individual that the covered platform knows is a minor.\u201d<\/p>\n<p>The provision around drug use lists the \u201cdistribution, sale, or use of narcotic drugs, tobacco products, cannabis products, gambling, or alcohol\u201d as risks that platforms would need to actively guard minors against.<\/p>\n<p class=\"lbexIndent HE1303F7F78CF40E3A30007C367E5B81A-content\">One section that was in prior iterations of the bill that seems to have been omitted from this latest version had stipulated that video streaming platforms would be required \u201cto employ measures that safeguard against serving advertising for narcotic drugs, cannabis products, tobacco products, gambling, or alcohol directly to the account or profile of an individual that the service knows is a minor.\u201d<\/p>\n<p>It\u2019s unclear why that language was left out of the latest measure, <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/7757\" target=\"_blank\" rel=\"noopener\">H.R. 7757<\/a>.<\/p>\n<p>Online platforms covered under the legislation include those that are publicly available for use, allow the creation of searchable usernames that can be followed, facilitate the \u201csharing and access to user-generated content,\u201d is designed to promote engagement and uses user information to target advertising.<\/p>\n<p>Guthrie said in a press release that the measure\u2019s passage represents one of the \u201cmeaningful steps forward to empower parents and protect children and teens online\u201d the the panel has taken.<\/p>\n<p>\u201cWe owe it to parents. We owe it to communities. And most importantly, we owe it to the kids who are counting on us to get this right,\u201d he said.<\/p>\n<p>Bilirakis <a href=\"https:\/\/energycommerce.house.gov\/posts\/full-committee-markup-recap-e-and-c-advances-eight-bills-to-the-full-house-of-representatives\" target=\"_blank\" rel=\"noopener\">said<\/a> the <a href=\"https:\/\/docs.house.gov\/Committee\/Calendar\/ByEvent.aspx?EventID=119031\" target=\"_blank\" rel=\"noopener\">bill<\/a> is \u201cdesigned to strengthen safeguards and increase transparency in the online space.\u201d<\/p>\n<p>\u201cI remain steadfast in my commitment to ensuring that children can safely navigate the digital world, while holding technology companies accountable for the platforms they operate,\u201d he said. \u201cProtecting our kids must always come before protecting corporate profits.\u201d<\/p>\n<p>Few in the public policy space oppose the overall intent of the legislation, but some say its broad and potentially vague requirements could be difficult in practice.<\/p>\n<p>Shoshana Weismann, a fellow at the free-market R Street Institute, told Marijuana Moment last year when the Senate version was filed that the measure could ultimately block wide swaths of online advertising that are <em>accessible\u00a0<\/em>by minors\u2014even if the ads don\u2019t\u00a0<em>target<\/em>\u00a0children, as the bill\u2019s proponent\u2019s suggest.<\/p>\n<p>\u201cThe problem is that the knowledge standard here is so loose,\u201d she said, pointing to the bill\u2019s definition of knowledge by platforms that they\u2019re serving content to underage users.<\/p>\n<p>After last year\u2019s Senate passage of the earlier measure\u2014titled the \u201cKids Online Safety Act\u201d (KOSA)\u2014Jenna Leventoff, ACLU\u2019s senior policy council and director of the civil right\u2019s group\u2019s national political advocacy division, said she was skeptical the legislation would pass constitutional muster.<\/p>\n<p>A number of states have attempted to adopt similar bills, Leventoff pointed out, and \u201cin almost every case, a court has evaluated those laws and determined that they are likely to be unconstitutional.\u201d<\/p>\n<p>\u201cIt\u2019s extremely likely that KOSA is unconstitutional,\u201d she said at the time,\u201d and it makes me wonder why Congress is trying to enact something that won\u2019t hold up in a court of law.\u201d<\/p>\n<p>At the state level in 2024, Colorado\u2019s Senate passed a bill similarly aimed at protecting minors from drug and other controversial content. But the proposal\u2014which was later <a href=\"https:\/\/www.marijuanamoment.net\/colorado-bill-that-would-have-muzzled-social-media-speech-on-state-legal-psychedelics-and-other-drugs-is-dead-for-the-year\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">put on hold indefinitely by a House committee<\/a>\u2014drew fire from advocates such as Weismann at R Street Institute.<\/p>\n<p>She and other critics pointed out at the time that the bill could ban content around over-the-counter cough syrup and even, potentially, the Colorado governor\u2019s social media posts in favor of the state\u2019s legal psychedelics industry.<\/p>\n<p>Under existing regulations, states that have legalized have generally seen less cannabis consumption among young people compared to states where marijuana remains illegal, according to multiple studies.<\/p>\n<p>During a webinar in January, federal <a href=\"https:\/\/www.marijuanamoment.net\/teen-marijuana-use-remained-stable-as-legalization-expands-federal-health-officials-acknowledge\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">officials discussed the results of the latest Monitoring the Future (MTF) survey<\/a>\u2014which is supported by the National Institute on Drug Abuse (NIDA) and conducted every year for decades by the University of Michigan.<\/p>\n<p>Youth marijuana use is stable amid the state legalization movement, despite prohibitionist claims to the contrary, they said. And beyond that, more students are <a href=\"https:\/\/www.marijuanamoment.net\/federal-health-official-says-teens-are-finding-it-harder-to-access-marijuana-even-as-legalization-spreads-contrary-to-opponents-fears\/\" target=\"_blank\" rel=\"nofollow noopener\">actually saying it\u2019s harder to access cannabis and that they disapprove of occasional use<\/a>.<\/p>\n<p><strong>\u2014<br \/>\nMarijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking hundreds of cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2026\/03\/MM_Bill_Tracker_V5_blank-20.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/p>\n<p>To reform advocates, the results of the survey reinforce the idea that creating a regulatory framework for cannabis where licensed retailers must check IDs and implement other security mechanisms to prevent unlawful diversion is a far more effective policy than prohibition, with illicit suppliers whose products may be untested and where age-gating isn\u2019t a strictly enforced regulation.<\/p>\n<p>To that point, a separate federally funded study out of Canada that was released last year found that that <a href=\"https:\/\/www.marijuanamoment.net\/youth-marijuana-use-has-declined-since-canada-enacted-legalization-federally-funded-study-shows\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">youth marijuana use rates actually declined after the country legalized cannabis<\/a>.<\/p>\n<p>The study was released about three months after German officials\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/german-government-report-shows-marijuana-legalization-hasnt-increased-youth-use-or-traffic-accidents\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">released a separate report on their country\u2019s experience with legalizing marijuana nationwide<\/a>.<\/p>\n<p>Back in July, federal health data also indicated that while past-year marijuana use in the U.S. overall has climbed in recent years,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-report-shows-youth-marijuana-use-remained-stable-even-as-more-states-legalized-in-recent-years\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">the rise has been \u201cdriven by increases\u2026among adults 26 years or older.\u201d<\/a>\u00a0As for younger Americans, rates of both past-year use and cannabis use disorder, by contrast, \u201cremained stable among adolescents and young adults between 2021 and 2024.\u201d<\/p>\n<p>Across the U.S., research suggests that marijuana use by young people has generally fallen in states that legalize the drug for adults.<\/p>\n<p>A report from the advocacy group Marijuana Policy Project (MPP), for example, found that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/youth-marijuana-use-hasnt-increased-in-states-that-legalize-and-most-actually-see-significant-declines-analysis-of-government-data-shows\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">youth marijuana use declined in 19 out of 21 states that legalized adult-use marijuana<\/a>\u2014with teen cannabis consumption down an average of 35 percent in the earliest states to legalize.
