{"id":85570,"date":"2026-03-04T04:27:06","date_gmt":"2026-03-04T12:27:06","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/03\/04\/texas-voters-approve-marijuana-legalization-ballot-measure\/"},"modified":"2026-03-04T19:47:17","modified_gmt":"2026-03-05T03:47:17","slug":"texas-voters-approve-marijuana-legalization-ballot-measure","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2026\/03\/04\/texas-voters-approve-marijuana-legalization-ballot-measure\/","title":{"rendered":"Texas Voters Approve Marijuana Legalization Ballot Measure"},"content":{"rendered":"<\/p>\n<p>Texas voters have approved a <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-legalization-is-on-the-ballot-in-texas-during-the-primary-election-thats-happening-now\/\" target=\"_blank\" rel=\"nofollow noopener\">marijuana legalization question that appeared on the state\u2019s Democratic primary ballot<\/a>.<\/p>\n<p>As part of the primary election on Tuesday, each major party was able to place several non-binding propositions on the ballot that allow voters show how they feel on key issues.<\/p>\n<p>The Texas Democratic Party used one of its propositions to find out where the electorate stands on legalizing cannabis and whether past convictions should be expunged.<\/p>\n<p>Preliminary results indicate that Texas voters who selected a Democratic primary ballot approved the cannabis question by a margin of 80 percent to 20 percent, with 92 percent of polling locations reporting as of Wednesday morning.<\/p>\n<p><strong>The yes or no question on Democratic primary ballots read:<\/strong><\/p>\n<p style=\"padding-left: 40px\">\u201cTexas should legalize cannabis for adults and automatically expunge criminal records for past low-level cannabis offenses.\u201d<\/p>\n<p>There was no cannabis question on the Republican ballot, but Texas has an open primary system in which voters can opt to participate in either <a href=\"https:\/\/www.ballotready.org\/elections\/texas-primary-election-10e44477-f2e5-4d4b-a610-a518125c7f98\" target=\"_blank\" rel=\"noopener\">party\u2019s<\/a> <a href=\"https:\/\/goelect.txelections.civixapps.com\/ivis-enr-ui\/races\" target=\"_blank\" rel=\"noopener\">primary<\/a> regardless of how they are registered.<\/p>\n<p>The approval of Democrats\u2019 marijuana question will not on its own change any cannabis laws, but it could send a signal to lawmakers that the reform is popular with voters.<\/p>\n<p>For what it\u2019s worth, a statewide poll released last month found that <a href=\"https:\/\/www.marijuanamoment.net\/texas-voters-disapprove-of-how-state-officials-are-handling-marijuana-and-thc-laws-poll-shows\/\" target=\"_blank\" rel=\"nofollow noopener\">Texas voters don\u2019t like how state leaders and lawmakers have handled marijuana and THC policy issues<\/a>. In the survey, a plurality of voters (40 percent) said they disapprove of how their elected officials have approached the issue, according to the survey. Just 29 percent said they approve of how cannabis issues have been handled, while 31 percent said they didn\u2019t have an opinion one way or another.<\/p>\n<p>A separate poll released last year found that <a href=\"https:\/\/www.marijuanamoment.net\/texas-voters-want-marijuana-laws-to-be-made-less-strict-new-poll-finds\/\" target=\"_blank\" rel=\"nofollow noopener\">a plurality of Texas voters want the state\u2019s marijuana laws to be made \u201cless strict.\u201d<\/a> And among the legislative items lawmakers considered during recent special sessions, voters say a proposal to address hemp regulations was among the least important.<\/p>\n<p>In the background, officials with the Department of Public Safety (DPS) in December <a href=\"https:\/\/www.marijuanamoment.net\/texas-officials-approve-nine-new-medical-marijuana-business-licenses-as-state-expands-patient-access\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">conditionally approved nine new medical marijuana business licenses<\/a>\u00a0in December as part of a law that\u2019s being implemented to significantly expand the state\u2019s cannabis program.<\/p>\n<p>The department will issue conditional licenses to three additional dispensaries by April 2026.<\/p>\n<p>This represents a major change to the program, as there are currently only three dispensaries licensed to operate in Texas.<\/p>\n<p><a href=\"https:\/\/www.marijuanamoment.net\/texas-officials-adopt-rules-to-expand-number-of-medical-marijuana-dispensaries-in-the-state\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">DPS in October adopted additional rules to increase the number of licensed dispensaries<\/a>, establishing security requirements for \u201csatellite\u201d locations and authorizing the revocation of licenses for certain violations.<\/p>\n<p>The Department of State Health Services (DSHS) also recently finalized rules <a href=\"https:\/\/www.marijuanamoment.net\/texas-officials-finalize-medical-marijuana-rules-to-let-doctors-recommend-new-qualifying-conditions-and-prescribe-thc-inhalation-devices\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">allowing doctors to recommend new qualifying conditions for cannabis patients<\/a>\u00a0and creating standards for allowable low-THC inhalation devices.<\/p>\n<p>Meanwhile, bipartisan Texas lawmakers say the stage is set to <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-texas-lawmakers-want-hemp-thc-regulated-instead-of-banned-with-gop-rep-saying-market-is-too-big-to-ignore\/\" target=\"_blank\" rel=\"nofollow noopener\">advance legislation next session establishing regulations for hemp THC products<\/a>, with growing understanding among their colleagues that prohibition fails to effectively address concerns about the cannabis market.<\/p>\n<p>In the interim, Texas regulators have\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/texas-officials-invite-comment-on-new-hemp-rules-covering-age-limits-licensing-fees-labeling-and-more\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">taken a series of steps to enact rules around consumable hemp products over recent months<\/a>, which began after Gov.
