But to the disappointment of advocates and stakeholders, the president did not take the primetime opportunity to promote his work around marijuana rescheduling.<\/p>\n<p>Trump did bring up drugs in the context of militarized enforcement actions targeting alleged traffickers, preventing fentanyl smuggling across the border and the addressing pharmaceutical costs. Yet despite the bipartisan popularity of cannabis reform, he declined to mention a December executive order he issued directing Attorney General Pam Bondi to expeditiously complete the process of moving marijuana from Schedule I to Schedule III of the Controlled Substances Act (CSA).<\/p>\n<p>That hasn\u2019t happened yet, and the Justice Department has been largely silent on the issue in the weeks since Trump signed the order. Some hoped the president would use the high-profile speech before a joint session of Congress to reiterate his directive to finalize the rulemaking, but the issue was ignored altogether.<\/p>\n<p>Adam Rosenberg, chairman of the National Cannabis Industry Association (NCIA), said after the speech that the State of the Union represented a \u201cmissed an opportunity to highlight a major gap between federal policy and state law.\u201d<\/p>\n<p>\u201cNearly every state has legalized cannabis in some form, yet federal rules continue to create uncertainty for legitimate operators. The industry has heard promises before, including support for rescheduling. What\u2019s missing is delivery,\u201d he said. \u201cFederal inaction continues to punish state-legal businesses with punitive tax treatment and banking barriers, while the illicit market operates without consequence. That imbalance is unsustainable.\u201d<\/p>\n<p \/>\n<p>Trump during his first term used the annual address to <a href=\"https:\/\/www.marijuanamoment.net\/trump-vows-get-much-tougher-drugs-state-union-speech\/\" target=\"_blank\" rel=\"nofollow noopener\">promote his administration\u2019s tough-of-crime drug policy position<\/a>. But <a href=\"https:\/\/www.marijuanamoment.net\/fact-check-biden-falsely-claims-his-marijuana-pardons-expunged-thousands-of-convictions-in-state-of-the-union-address\/\" target=\"_blank\" rel=\"nofollow noopener\">it was his predecessor, former President Joe Biden, who first raised marijuana rescheduling<\/a>\u2014a process he initiated that led to the Schedule III recommendation\u2014at a State of the Union address.<\/p>\n<p>The rulemaking process has dragged on for years now, however, and neither Trump nor the White House have provided any further update.<\/p>\n<p>Ahead of Tuesday\u2019s speech, Marijuana Moment asked the White House whether the president planned to bring up cannabis rescheduling, but a spokesperson simply pointed to a statement from Press Secretary Karoline Leavitt the generally described Trump\u2019s intent to discuss the administration\u2019s \u201cmany record-breaking accomplishments\u201d and his \u201cambitious agenda to continue bringing the American Dream back for working people.\u201d<\/p>\n<p>A DOJ spokesperson told Marijuana Moment last month, meanwhile, that <a href=\"https:\/\/www.marijuanamoment.net\/doj-has-no-comment-or-updates-on-marijuana-rescheduling-more-than-a-month-after-trumps-executive-order\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">it had no \u201ccomment or updates\u201d to share on the topic<\/a>. However, an agency official more recently\u00a0told\u00a0Salon that \u201cDOJ is working to identify the most expeditious means of executing the EO.\u201d<\/p>\n<p>That phrasing is notable, signaling that the department is uncertain about the administrative pathway to finalize rescheduling. The hope among advocates and industry stakeholders was that the process would be more simple, with a final signature on the existing reform proposal that was released following a scientific review initiated under the prior Biden administration.<\/p>\n<p>The Justice Department\u2019s relative silence on the issue has left some wondering if the agency is aligned with the White House, which last month separately <a href=\"https:\/\/www.marijuanamoment.net\/white-house-touts-trumps-marijuana-rescheduling-order-as-a-top-win-during-his-first-year-back-in-office\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">touted the president\u2019s order as an example of a policy achievement<\/a>\u00a0during the first year of his second term.<\/p>\n<p>Separately, as the Trump administration works to finalize the rescheduling proposal and <a href=\"https:\/\/www.marijuanamoment.net\/federal-agency-finalized-rule-for-cbd-medicare-coverage-pilot-program-weeks-ago-key-hemp-stakeholder-says\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">prepares to roll out a CBD coverage plan through Medicare<\/a> under the Centers for Medicare &amp; Medicaid Services (CMS), the head of that agency, Mehmet Oz, recently raised concerns about non-intoxicating cannabidiol and hemp products overall.<\/p>\n<p>Oz said this month that <a href=\"https:\/\/www.marijuanamoment.net\/dr-oz-warns-of-consequences-as-people-choose-marijuana-over-alcohol-citing-concerns-about-high-dose-hemp-and-cbd\/\" target=\"_blank\" rel=\"nofollow noopener\">\u201cthere are going to be consequences\u201d as more Americans choose marijuana over alcohol<\/a>\u2014including problems caused by \u201chigh-dose hemp and CBD.\u201d<\/p>\n<p>Meanwhile, the first-ever White House drug czar recently said that while he loves Trump and \u201calmost everything he does,\u201d <a href=\"https:\/\/www.marijuanamoment.net\/former-white-house-drug-czar-says-trump-is-wrong-to-reschedule-marijuana-calling-it-a-gateway-drug-thats-massively-destructive\/\" target=\"_blank\" rel=\"nofollow noopener\">that affection doesn\u2019t extend to the pending proposal to federally reschedule marijuana<\/a>, which he described as a \u201cgateway drug\u201d that\u2019s harming youth.<\/p>\n<p>A White House spokesperson defended the administration\u2019s rescheduling push in an earlier interview with Fox News Digital, stating that it\u2019s part of his \u201cpledge to expand medical research into applications of marijuana and cannabidiols.\u201d<\/p>\n<p>\u201cThe president\u2019s historic action paved the way for the development of promising new treatments for American patients, especially veterans\u2014and the presence of several leaders from law enforcement and veterans groups at the Oval Office signing is indicative of how President Trump continues to push the envelope to support our nation\u2019s heroes,\u201d White House spokesperson Kush Desai said.<\/p>\n<p>The rescheduling plan has been met with mixed reactions on Capitol Hill. For example, prohibitionist Rep. Andy Harris (R-MD) half-jokingly told Marijuana Moment this month that <a href=\"https:\/\/www.marijuanamoment.net\/justice-department-should-take-about-20-years-to-reschedule-marijuana-gop-congressman-says\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">he felt the Justice Department should \u201ctake about 20 years\u201d to finish the rescheduling process<\/a>.<\/p>\n<p>In December, Harris separately said Trump doesn\u2019t have the authority to unilaterally reschedule marijuana via executive order. But while lawmakers could overrule any administrative move to enact the reform,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-congressman-says-trump-technically-cant-reschedule-marijuana-on-his-own-but-reversing-it-in-congress-would-be-a-heavy-lift\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">it would be a \u201cheavy lift\u201d in the Republican-controlled Congress, he acknowledged<\/a>.<\/p>\n<p>Another GOP lawmaker on the other side of the debate, Congressional Cannabis Caucus co-chair Rep. Dave Joyce (R-OH), recently told Marijuana Moment that while marijuana rescheduling might not be at the top of the agenda for the Justice Department or White House amid competing interests,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-congressman-isnt-sure-marijuana-rescheduling-is-a-doj-priority-but-remains-optimistic-about-progress-under-trump\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">he and bipartisan colleagues will be ready when \u201copportunity does present itself.\u201d<\/a><\/p>\n<p>Joyce separately said last month that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-congressman-dismisses-concerns-about-marijuana-rescheduling-delay-saying-trump-made-it-very-clear-doj-must-act\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">he doesn\u2019t think the attorney general would seek to undermine the president\u2019s executive order to move marijuana to Schedule III<\/a>\u00a0despite any personal reservations she may have about the policy change.<\/p>\n<p>Former Rep. Matt Gaetz (R-FL), Trump\u2019s first pick for attorney general this term who ultimately withdrew his nomination, raised eyebrows last week after posting on X that he\u2019s been told the Drug Enforcement Administration (DEA) is\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/dea-is-drafting-rule-to-reschedule-marijuana-asap-trumps-first-pick-for-attorney-general-says\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">actively drafting a rescheduling rule and intended to issue it \u201cASAP.\u201d<\/a><\/p>\n<p>There\u2019s some confusion around that point, however, as a rule is already pending before the Justice Department\u2014and a new rule would presumably be subject to additional administrative review and public comment.<\/p>\n<p>A Democratic senator told Marijuana Moment earlier this month that it\u2019s\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/democratic-senator-very-concerned-about-how-doj-will-handle-marijuana-rescheduling\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">\u201ctoo early to tell\u201d what the implications of Trump\u2019s cannabis order would be<\/a>\u2014saying that while there are \u201cthings that look promising\u201d about it, he is \u201cvery concerned about where the DOJ will land.\u201d<\/p>\n<p>\u201cThe ability of the Trump administration to speak out of both sides of their mouth is staggering,\u201d Sen. Cory Booker (D-NJ) said. \u201cSo I\u2019m just going to wait and see right now. Obviously, there\u2019s things that look promising\u2014to end generations of injustice.
