Nicholas Scutari (D), the governor would be empowered to \u201center into an agreement with another state or states authorizing medicinal or personal-use commercial cannabis activity, or both, between entities licensed under the laws of the contracting state and entities operating with a State license\u201d in New Jersey.<\/p>\n<p>However, the reform would only take effect under certain conditions, such as if federal law changed to explicitly allow interstate marijuana commerce, the U.S. Department of Justice issued a memo saying it would tolerate the activity or if Congress passed legislation blocking officials from enforcing the prohibition on cannabis sales between states.<\/p>\n<p>Alternatively, the policy could move forward if the state attorney general issued an opinion determining that the law\u2019s implementation \u201cwill not result in significant legal risk to this State based on review of federal judicial decisions and administrative action.\u201d<\/p>\n<p>Cannabis products brought into the state from another market under the <a href=\"https:\/\/www.njleg.state.nj.us\/bill-search\/2026\/S3151\" target=\"_blank\" rel=\"noopener\">bill\u2019s<\/a> framework would need to be subject rules equivalent to New Jersey\u2019s regulations, including with respect to testing, packaging, labeling, marketing, tracking and quality assurance.<\/p>\n<p>Scutari has introduced <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-senate-president-files-bill-to-allow-interstate-marijuana-commerce\/\" target=\"_blank\" rel=\"nofollow noopener\">interstate cannabis commerce legislation<\/a> in <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-lawmakers-file-bills-to-allow-marijuana-home-grow-interstate-commerce-banking-protections-psilocybin-legalization-and-more\/\" target=\"_blank\" rel=\"nofollow noopener\">previous sessions<\/a>, but none of those proposals were enacted into law.<\/p>\n<p>Several other states already have interstate marijuana commerce laws in place.<\/p>\n<p>California Gov. Gavin Newsom (D), for example, signed a bill in 2022 that <a href=\"https:\/\/www.marijuanamoment.net\/california-governor-signs-10-marijuana-bills-including-interstate-commerce-employment-protections-and-record-sealing\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">empowers him to enter into interstate cannabis commerce agreements<\/a> with other legal states, but that power is incumbent upon federal guidance or an assessment from the state attorney general that sanctioned such activity.<\/p>\n<p>Following a review of the policy proposal, however, California Attorney General Rob Bonta\u2019s (D) office ultimately determined in 2023 that the state could\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/interstate-marijuana-commerce-could-put-california-at-significant-legal-risk-of-federal-action-attorney-general-says\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">put itself and its employees at \u201csignificant legal risk\u201d of federal enforcement action<\/a>\u00a0if it were to authorize interstate marijuana commerce.<\/p>\n<p>Oregon and Washington State have also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/washington-governor-signs-interstate-marijuana-commerce-bill-into-law\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">passed laws allowing officials to enter into cross-border cannabis trade agreements<\/a>\u00a0with other states, although those state laws both\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/oregon-governor-signs-bill-to-allow-interstate-marijuana-imports-and-exports\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">require some form of federal reform or guidance to proceed<\/a>.<\/p>\n<p>Meanwhile, lawmakers in Congress have filed legislation intended to help small marijuana growers compete against large corporations in the event of federal legalization\u2014proposing to give them the ability to <a href=\"https:\/\/www.marijuanamoment.net\/new-congressional-bill-would-allow-interstate-marijuana-shipping-by-usps-to-help-small-growers-compete-against-large-corporations\/\" target=\"_blank\" rel=\"nofollow noopener\">ship and sell cannabis products directly to consumers within and across state lines via the U.S. Postal Service<\/a> (USPS) and commercial carriers.<\/p>\n<p>Back in New Jersey, lawmakers this week sent Gov. Phil Murphy (D) a bill to <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-legislature-passes-bill-to-create-psilocybin-therapy-pilot-program-sending-it-to-governor\/\" target=\"_blank\" rel=\"nofollow noopener\">create a psilocybin therapy pilot program<\/a> and allocate $6 million in funding to support the effort.<\/p>\n<p>In other New Jersey drug policy news,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-jerseys-incoming-governor-supports-legalizing-marijuana-home-cultivation\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">voters in November elected U.S. Rep.
