Hemani<\/em> that was submitted to the court on Friday, the top state prosecutors\u2014led by Illinois Attorney General Kwame Raoul (D)\u2014said justices should maintain the current statute known as 18 U.S.C. \u00a7 922(g)(3).<\/p>\n<p>That law has been challenged in multiple federal courts in recent years, but the Supreme Court agreed to take up <em>Hemani<\/em>, a case that led a lower court to rule that the federal prohibition on gun ownership by people who use cannabis violates the Second Amendment of the U.S. Constitution.<\/p>\n<p>\u201cI am urging the Supreme Court to reverse the appellate court\u2019s decision because the mix of habitual drug use and firearms poses recognized public safety risks,\u201d Raoul said in a press release. \u201cAllowing habitual drug users to carry or use firearms significantly increases danger to our communities.\u201d<\/p>\n<p>\u201cI am proud to lead this bipartisan coalition, as we all agreed we need to work together to protect our states and communities from gun violence,\u201d he said.<\/p>\n<p>In the brief, the attorneys general\u2014most of which represent states that have enacted adult-use legalization within their borders\u2014said they have a \u201csubstantial interest in the health, safety, and welfare of their communities, which includes preventing firearms from coming into the hands of people likely to misuse them.\u201d<\/p>\n<p>\u201cThat interest is implicated by this case, which addresses the extent to which the federal government may prohibit an individual who is an \u2018unlawful user of or addicted to any controlled substance\u2019 from possessing firearms,\u201d they said.<\/p>\n<p>The brief doesn\u2019t focus singularly on the marijuana and gun issue, which can be partly explained by the fact that the defendant in the case was not only a cannabis consumer but also a user of cocaine who\u2019s sold drugs in the past, according to court findings. But the impact of a ruling would likely have substantial implications for marijuana consumers and patients.<\/p>\n<p>The reasoning that other courts have used to deem the firearm ban unconstitutional is \u201cflawed in multiple respects,\u201d the attorneys general said, \u201cincluding that it misdescribes the scope of the relevant historical tradition, misapplies this Court\u2019s precedents, and unduly ties the hands of legislatures seeking to protect the public from the full range of dangers associated with combining firearms and drugs.\u201d<\/p>\n<p>While the district court in <em>Hemani <\/em>argued that gun statutes should distinguish between people who are actively impaired from controlled substances and drug users who don\u2019t possess guns while intoxicated, the latter group, the brief says that \u201chabitual drug use can cause some individuals to experience chronic psychological disturbances that affect their conduct and decision-making in a manner that compromises their ability to safely handle firearms.\u201d<\/p>\n<p>\u201cFurther, because much drug use is illicit, habitual drug users frequently interact with the illegal drug trade, which is inherently dangerous,\u201d it says.<\/p>\n<p>The brief cites a related case, <em>U.S. v. Harris<\/em>, where a regular cannabis user lost his gun after becoming intoxicated and the weapon ended up in the hands of a felon who was prohibited from possessing firearms.<\/p>\n<p style=\"padding-left: 40px\">\u201cIn short, amici States have a substantial interest in retaining the flexibility to address new societal concerns with appropriately tailored firearms regulations that are consistent with the principles underlying this country\u2019s historical tradition. Section 922(g)(3), as well as its state counterparts, respect that balance.\u201d<\/p>\n<p>Crime trends across the country show that the \u201caltered mental states caused by these and other drugs can be dangerous when combined with firearms, even when an individual user does not necessarily intend violence or harm or even fire the weapon,\u201d the state officials said.<\/p>\n<p>Other signatories of the amicus brief include the attorneys general of California, Colorado, Connecticut, Delaware, Hawaii, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nevada, New Jersey, New York, Ohio, Oregon, Rhode Island, Vermont, Washington State and Washington, D.C.<\/p>\n<p>Notably, all of those states have legalized adult-use marijuana, with the exception of Hawaii, where only medical cannabis is legal.<\/p>\n<p>\u201cDrugs and guns are a dangerous combination,\u201d California Attorney General Rob Bonta (D) said. \u201cPotentially dangerous drug users should not possess firearms\u2014this is a commonsense notion to prevent people who use drugs from harming themselves, their loved ones, or their communities.\u201d<\/p>\n<p>\u201cBoth red and blue states alike\u2014recognizing the dangers posed by combining habitual drug use with firearms\u2014have imposed firearm restrictions to prevent gun violence,\u201d he <a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-scotus-drugs-and-guns-are-dangerous-combination\" target=\"_blank\" rel=\"noopener\">said<\/a>, adding that justices should \u201creverse a lower court decision, uphold public safety, and keep firearms out of the reach of people who are drug users.\u201d<\/p>\n<p>Several other <a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/DocketFiles\/html\/Public\/24-1234.html\" target=\"_blank\" rel=\"noopener\">briefs<\/a> were also submitted on Friday to justices in the case, which was granted cert last month. Firearm control groups including Everytown for Gun Safety, Second Amendment Law Scholars, Brady Center to Prevent Gun Violence, Giffords Law Center to Prevent Gun Violence and Global Action on Gun Violence have told the Supreme Court to overturn the lower court\u2019s ruling in the matter, for example. A coalition of history and law professors also submitted a brief.<\/p>\n<p>Also last week, Smart Approaches to Marijuana (SAM) and 21 other prohibitionist groups filed a brief, urging justices to <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-isnt-chill-and-is-actually-more-dangerous-than-alcohol-anti-legalization-groups-tell-supreme-court-in-brief-for-gun-rights-case\/\" target=\"_blank\" rel=\"nofollow noopener\">uphold the constitutionality of the federal gun ban for people who use cannabis<\/a>\u2014which they claim is associated with violence and psychosis.<\/p>\n<p>U.S. Solicitor General D. John Sauer, for his part, told the Supreme Court that <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-users-pose-a-greater-danger-than-alcohol-drinkers-trump-doj-tells-scotus-in-gun-rights-case-filing\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">people who use illegal drugs \u201cpose a greater danger\u201d than those who drink alcohol.<\/a><\/p>\n<p>The latests amicus briefs were filed just one day after President Donald Trump signed an executive order directing U.S. Attorney General Pam Bondi to expeditiously complete a rulemaking process to move marijuana from Schedule I to Schedule III of the Controlled Substances Act (CSA). It\u2019s uncertain to what extent, if at all, the modest policy change would impact the pending gun cases.<\/p>\n<p>Meanwhile, the Biden administration was evidently concerned about potential legal liability in federal cases for people convicted of violating gun laws simply by being a cannabis consumer who possessed a firearm,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/doj-knew-gun-ban-for-marijuana-users-is-vulnerable-to-litigation-risk-newly-revealed-memo-shows-as-supreme-court-takes-up-issue\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">documents recently obtained by Marijuana Moment show<\/a>.<\/p>\n<p>The previously unpublished 2024 guidance from former President Joe Biden\u2019s Justice Department\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/newly-revealed-biden-marijuana-guidance-rescinded-by-trump-doj-ordered-prosecutors-to-seek-higher-up-approval-for-cases\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">generally cautioned U.S. attorneys to use discretion in prosecuting federal cannabis cases<\/a>, particularly for offenses that qualified people for pardons during his term. But one section seems especially relevant as\u00a0the Supreme Court takes on a case challenging the constitutionality of the current federal gun statute.<\/p>\n<p>With respect to\u00a0<em>Hemani<\/em>, in a separate August filing for the case, the Justice Department also emphasized that \u201cthe question presented is the subject of a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/trump-doj-asks-supreme-court-to-uphold-ban-on-marijuana-users-owning-guns\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">multi-sided and growing circuit conflict<\/a>.\u201d In seeking the court\u2019s grant of cert, the solicitor general also noted that the defendant is a joint American and Pakistani citizen with alleged ties to Iranian entities hostile to the U.S., putting him the FBI\u2019s radar.<\/p>\n<p>Now that the Supreme Court has\u00a0agreed\u00a0to take up\u00a0<em>Hemani<\/em>, if justices declare 922(g)(3) constitutional, such a ruling could could mean government wins in the remaining cases. The high court last month denied a petition for cert in\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-appeals-court-says-constitution-doesnt-support-taking-guns-away-from-all-marijuana-users-categorically\/?fbclid=IwY2xjawLCm5VleHRuA2FlbQIxMQABHoc9WWhxA-2W_gEE3IYrhkxF6H9j8cTvRYBSlafgmNpESiNCVeTaGLLokm8p_aem_q6RdzYZm7pzt7I5G3nBW2w\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\"><em>U.S. v. Cooper<\/em><\/a>, while leaving pending decisions on\u00a0<em><a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/24-1248.html\" target=\"_blank\" rel=\"noopener\">U.S. v. Daniels<\/a><\/em>\u00a0and\u00a0<em><a href=\"https:\/\/www.supremecourt.gov\/search.aspx?filename=\/docket\/docketfiles\/html\/public\/24-1249.html\" target=\"_blank\" rel=\"noopener\">U.S. v. Sam<\/a><\/em>.<\/p>\n<p>The court also recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/supreme-court-denies-one-case-on-gun-rights-for-marijuana-consumers-but-justices-will-discuss-several-others-this-week\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">denied a petition for cert in another gun and marijuana case<\/a>,\u00a0<em>U.S. v. Baxter,\u00a0<\/em>but that wasn\u2019t especially surprising as both DOJ and the defendants advised against further pursing the matter after a lower court reinstated his conviction for being an unlawful user of a controlled substance in possession of a firearm.<\/p>\n<p>Meanwhile, in recent interviews with Marijuana Moment, several Republican senators shared their views on\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-senators-discuss-federal-ban-on-marijuana-users-owning-guns-as-supreme-court-considers-taking-up-issue\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">the federal ban on gun possession by people who use marijuana<\/a>\u2014with one saying that if alcohol drinkers can lawfully buy and use firearms, the same standard should apply to cannabis consumers.<\/p>\n<p>Separately,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-appeals-court-says-government-must-prove-marijuana-users-pose-a-risk-of-danger-to-justify-gun-ban\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">the U.S. Court of Appeals for the Tenth Circuit<\/a>\u00a0earlier this year sided with a federal district court that dismissed an indictment against Jared Michael Harrison, who was charged in Oklahoma in 2022 after police discovered cannabis and a handgun in his vehicle during a traffic stop.<\/p>\n<p>The case has now been remanded to that lower court, which determined that the current statute banning \u201cunlawful\u201d users of marijuana from possessing firearms violates the Second Amendment of the Constitution.<\/p>\n<p>The lower court largely based his initial decision on\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/feds-must-defend-historical-rationale-of-banning-guns-for-medical-marijuana-patients-revised-lawsuit-argues-after-scotus-ruling\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">an interpretation of a Supreme Court ruling<\/a>\u00a0in which the justices generally created a higher standard for policies that seek to impose restrictions on gun rights.<\/p>\n<p>In the U.S. Court of Appeals for the Eleventh District, <a href=\"https:\/\/www.marijuanamoment.net\/federal-appeals-court-gives-medical-marijuana-patients-who-want-to-own-guns-a-win\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">judges recently ruled in favor of medical cannabis patients<\/a>\u00a0who want to exercise their Second Amendment rights to possess firearms.<\/p>\n<p>As a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/courts-grapple-with-constitutional-attacks-on-law-barring-marijuana-users-from-gun-ownership-congressional-researchers-note\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">recent report from the Congressional Research Service (CRS) explained the current legal landscape<\/a>, a growing number of federal courts are now \u201cfinding constitutional problems in the application of at least some parts\u201d of the firearms prohibition.<\/p>\n<p>In a recent ruling, a three-judge panel for the U.S. Court of Appeals for the Eighth Circuit\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/appeals-court-vacates-conviction-over-marijuana-users-gun-ownership-noting-lower-court-didnt-find-his-use-caused-a-threat\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">vacated a defendant\u2019s conviction and remanded the case back to a district court<\/a>, noting that a retrial before a jury may be necessary to determine whether cannabis in fact caused the defendant to be dangerous or pose a credible threat to others.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-court-upholds-gun-ban-for-marijuana-users-but-requires-individualized-judgments-to-determine-dangerousness\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">Third Circuit separately said in a published opinion that district courts must make \u201cindividualized judgments\u201d to determine whether 922(g)(3) is constitutional<\/a>\u00a0as applied to particular defendants.<\/p>\n<p>A federal court in October agreed to delay proceedings in a years-long Florida-based case\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-case-on-medical-marijuana-patients-gun-rights-is-on-hold-as-supreme-court-weighs-underlying-issue\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">challenging the constitutionality of the ban on gun ownership by people who use medical marijuana<\/a>, with the Justice Department arguing that the Supreme Court\u2019s recent decision to take up\u00a0<em>Hemani<\/em>\u00a0warrants a stay in the lower court.<\/p>\n<p><strong>\u2014<br \/>\nMarijuana Moment is <a in Rhode Island\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/another-federal-judge-rules-against-the-governments-ban-on-gun-ownership-by-marijuana-consumers\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">ruled that the ban was unconstitutional as applied to two defendants<\/a>, writing that the government failed to establish that the \u201csweeping\u201d prohibition against gun ownership by marijuana users was grounded in historical precedent.<\/p>\n<p>A federal judge in El Paso separately ruled late last year that the government\u2019s ongoing\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-judge-in-texas-rules-that-ban-on-gun-ownership-by-marijuana-user-is-unconstitutional-as-applied\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">ban on gun ownership by habitual marijuana users is unconstitutional<\/a>\u00a0in the case of a defendant who earlier pleaded guilty to the criminal charge. The court allowed the man to withdraw the plea and ordered that the indictment against him be dismissed.<\/p>\n<p>DOJ has claimed in multiple federal cases over the past several years that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-appeals-court-rules-that-gun-ban-for-marijuana-consumers-is-unconstitutional\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">the statute banning cannabis consumers from owning or possessing guns<\/a>\u00a0is constitutional because it\u2019s consistent with the nation\u2019s history of disarming \u201cdangerous\u201d individuals.<\/p>\n<p>In 2023, for example, the Justice Department told the U.S. Court of Appeals for the Third Circuit that historical precedent \u201ccomfortably\u201d supports the restriction. Cannabis consumers with guns pose a unique danger to society, the Biden administration claimed, in part because they\u2019re\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bidens-justice-department-says-marijuana-consumers-are-unlikely-to-store-guns-properly-in-latest-defense-of-federal-ban\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">\u201cunlikely\u201d to store their weapon properly<\/a>.<\/p>\n<p>Meanwhile, some states have passed their own laws either further restricting or attempting to preserve gun rights as they relate to marijuana.<\/p>\n<p>Recently a Pennsylvania lawmaker introduced a bill meant to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-gop-senators-bill-would-let-medical-marijuana-patients-get-gun-carry-permits\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">remove state barriers to medical marijuana patients carrying firearms<\/a>.<\/p>\n<p>Colorado activists also attempted to qualify an initiative for November\u2019s ballot that would have protected the Second Amendment rights of marijuana consumers in that state, but\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/colorado-initiative-on-marijuana-and-concealed-carry-firearm-permits-fails-to-qualify-for-ballot\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">the campaign\u2019s signature-gathering drive ultimately fell short<\/a>.<\/p>\n<p>As 2024 drew to a close, the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kentucky-residents-who-participate-in-states-new-medical-marijuana-program-will-be-ineligible-to-own-guns-feds-warn\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">ATF issued a warning to Kentucky residents<\/a>\u00a0that, if they choose to participate in\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kentucky-could-legalize-recreational-marijuana-if-new-medical-program-works-well-governor-says\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">the state\u2019s medical marijuana program that\u2019s set to launch imminently<\/a>, they will be prohibited from buying or possessing firearms under federal law.<\/p>\n<p>The official said that while people who already own firearms aren\u2019t \u201cexpected to\u201d turn them over if they become state-legal cannabis patients, those who \u201cwish to follow federal law and not be in violation of it\u201d must \u201cmake the decision to divest themselves of those firearms.\u201d<\/p>\n<p>Since then, bipartisan state lawmakers have introduced\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-kentucky-lawmakers-push-congress-to-protect-medical-marijuana-patients-gun-rights\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">legislation that would urge Kentucky\u2019s representatives in Congress to amend federal law<\/a>\u00a0to clarify that users of medical marijuana may legally possess firearms, though no action has since been taken on that bill.<\/p>\n<p>Kentucky Gov.
