Rand Paul (R-KY) spoke about hemp policy issues and his plan to avert the new federal ban, which is set to take effect next November, at an event marking the opening of a Cornbread Hemp location in Louisville.<\/p>\n<p>When hemp\u2019s potential federal legalization was being considered as part of the 2018 Farm Bill that Trump signed in his first term, Paul said he thought that\u2019d be \u201cgreat,\u201d particularly for Kentucky farmers who\u2019ve seen losses as demand for tobacco has decreased. Creating a cannabis industry would also support ancillary businesses that aren\u2019t plant-touching, he said.<\/p>\n<p>Hemp legalization has been a \u201cgreat success,\u201d Paul added, \u201cand I don\u2019t want government to stifle this\u201d<\/p>\n<p>He also addressed arguments supporting the hemp ban that he described as \u201cuntrue,\u201d including the idea that all cannabinoid products are being sold at gas stations and marketed in a way that targets youth. Kentucky\u2014which enacted a regulatory framework for hemp that aims to mitigate those issues\u2014is an example of how cannabis products can be responsibly sold to adult consumers, Paul said.<\/p>\n<div class=\"embed-twitter\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">I joined Cornbread Hemp at their ribbon cutting for their newest facility in Louisville. There still will be the question of going across state lines we have to tackle. We\u2019re in the process of listening to people in the business, listening to the farmers and trying to come to some conclusion that we\u2019ve got to change their minds. We have about a year.\u201d<\/p>\n<p>The senator\u2014who <a href=\"https:\/\/www.marijuanamoment.net\/rand-paul-slams-alcohol-and-marijuana-interests-over-federal-hemp-ban-announcing-hell-file-a-bill-to-reverse-it-next-week\/\" target=\"_blank\" rel=\"noopener\">laid partial blame for the pending hemp ban on alcohol and marijuana interests<\/a>\u2014also made the case that text of the recently enacted spending bill would effectively prohibit the sale of not just consumable cannabinoid products but also plants used for \u201cnon-edible purposes\u201d such an clothing and building materials. That reflects the \u201cidiocy\u201d of the measure, he said.<\/p>\n<p \/>\n<p>Paul pointed to Cornbread Hemp as a business that would likely be unfairly impacted by the hemp policy change, and he said the opening of its latest facility is \u201cgood for Louisville\u201d to support consumers and promote job creation.<\/p>\n<p>\u201cI think we should be open-minded to allowing adults to choose what they would like to take for a variety of conditions. And, apparently, millions of people think this is helpful to them\u2013and then some simply use it as a drink to feel some effect as maybe having a beer,\u201d Paul said. \u201cBut I\u2019m proud of the companies.\u201d<\/p>\n<div class=\"embed-twitter\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Today, Sen. <a href=\"https:\/\/twitter.com\/RandPaul?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@RandPaul<\/a> cut the ribbon to officially open the <a href=\"https:\/\/twitter.com\/CornbreadHemp?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">@CornbreadHemp<\/a> retail store and public tours. <a href=\"https:\/\/t.co\/8GKVwLmd1W\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/8GKVwLmd1W<\/a><\/p>\n<p>\u2014 Jim Higdon (@jimhigdon) <a href=\"https:\/\/twitter.com\/jimhigdon\/status\/2000719744224116794?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">December 16, 2025<\/a><\/p>\n<\/blockquote>\n<p \/><\/div>\n<p>Paul has been sounding the alarm for weeks about the potential consequences of the hemp recriminalization provisions, which he said would cause mass job losses and a $25 billion industry to be \u201cwiped out.\u201d<\/p>\n<p>The senator initially said <a href=\"https:\/\/www.marijuanamoment.net\/rand-paul-slams-alcohol-and-marijuana-interests-over-federal-hemp-ban-announcing-hell-file-a-bill-to-reverse-it-next-week\/\" target=\"_blank\" rel=\"nofollow noopener\">he\u2019d be imminently filing a bill to address the issue last month<\/a>, describing the legislation during a webinar organized by the Kentucky Hemp Association. So far, the text has not been released, but Paul said it would\u00a0make it so state policy regulating hemp cannabinoid products\u2014with basic safeguards in place to prevent youth access, for example\u2014\u201dsupersedes the federal law.\u201d<\/p>\n<p>\u201cI like the approach of doing it [this way], because it\u2019s not a direct repeal, and we\u2019re [doing] an end-run around him,\u201d Paul said. \u201cAnd if a state doesn\u2019t have laws\u2014and they want to have a hemp industry\u2014they\u2019d get pretty busy at their state legislature and go ahead and put something in place so they can have a hemp industry, because I don\u2019t think you can have one under [Senate Majority Leader Mitch McConnell\u2019s (R-KY)] law.\u201d<\/p>\n<p>Stakeholders say the new definition will devastate the market, as even non-intoxicating CBD items typically exceed the proposed 0.4 mg THC per container limit that is set to be enforced around this time next year.<\/p>\n<p>Since a majority of his colleagues in the Senate opted to advance the appropriations bill, however, \u201cnow I\u2019m asking them to repeal something they\u2019ve already voted for,\u201d Paul said. \u201cBut if I ask them to vote for language that lets their state make the decision on regulation, we might get more votes.\u201d<\/p>\n<p>Opposition to the ban crosses party lines, too. For example, Sens. Ron Wyden (D-OR) and Jeff Merkley (D-OR) introduced a bill last week to <a href=\"https:\/\/www.marijuanamoment.net\/hemp-products-would-be-federally-regulated-instead-of-banned-under-new-senate-bill\/\" target=\"_blank\" rel=\"nofollow noopener\">create a federal regulatory framework for hemp-derived cannabinoids<\/a> and allow states to set their own rules for products such as CBD. The measure is conceptually similar to what Paul previewed about his own legislation, but it also includes additional prescriptive regulatory controls that may conflict with the GOP senator\u2019s more libertarian principles.<\/p>\n<p>On the other end of the debate, Rep. Nancy Mace (R-SC) filed a bill that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-gop-led-bill-in-congress-would-reverse-hemp-thc-ban-that-trump-signed-into-law\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">strike the contested provisions of the appropriations legislation<\/a>. But some stakeholders worry that approach could backfire, and they\u2019re hoping to see bipartisan bills introduced in he near future that would provide a robust regulatory model for intoxicating hemp products as a viable alternative to blanket prohibition.<\/p>\n<p>Meanwhile, GOP political operative Roger Stone said last month that Trump was\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-lawmakers-forced-trump-into-signing-hemp-ban-longtime-ally-roger-stone-says\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">effectively \u201cforced\u201d by Republican lawmakers to sign the spending bill<\/a>\u00a0with the hemp THC ban language.<\/p>\n<p>However, a White House spokesperson said prior to the bill signing that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/trump-supports-hemp-thc-ban-thats-advancing-in-senate-white-house-says\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">Trump specifically supported the prohibition language<\/a>.<\/p>\n<p>The Democratic governor of Kentucky said last month that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/kentucky-governor-says-hemp-is-an-important-industry-that-should-be-regulated-at-the-state-level-not-federally-banned\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">the hemp industry is an \u201cimportant\u201d part of the economy that deserves to be regulated<\/a>\u00a0at the state level\u2014rather than federally prohibited, as Congress has moved to do.<\/p>\n<p>Also, a leading veterans organization is warning congressional leaders that the newly approved blanket ban on consumable hemp products\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/top-veterans-group-warns-congress-that-hemp-ban-could-slam-the-door-shut-on-medical-research\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">could inadvertently \u201cslam the door shut\u201d on critical research<\/a>.<\/p>\n<p>While many hemp stakeholders say the ban would effectively eradicate the industry\u2013even applying to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/why-is-congress-moving-to-ban-the-hemp-products-that-saved-my-sons-life-op-ed\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">nonintoxicating CBD products that people use for medical reasons<\/a>\u2014there\u2019s latent hope that they can strike a compromise deal with lawmakers before the prohibition is implemented this time next year.<\/p>\n<p>Lawmakers such as Sen. Chris Van Hollen (D-MD) also say that window could provide an opportunity to advance legislation to create an alternative regulatory model for consumable hemp products.<\/p>\n<p>Since 2018, cannabis products have been considered legal hemp if they contain less than 0.3 percent delta-9 THC on a dry weight basis.<\/p>\n<p>The new\u00a0legislation\u00a0specifies that, within one year of enactment, the weight will apply to total THC\u2014including delta-8 and other isomers.
