Bill Partington (R), filed for the 2026 session on Wednesday, would also make it so medical marijuana registrations could last up to two years instead of the current 30 weeks, and it\u2019d waive patient registration fees for honorably discharged military veterans.<\/p>\n<p>Under the proposal, doctors would additionally be able to recommend medical cannabis via telehealth without a physical examination\u2014expanding a current policy that allows renewals, but not initial certifications, to be conducted remotely.<\/p>\n<p>There are also reciprocity provisions built into the measure, requiring regulators to create a process to issue medical cannabis registration cards to \u201cnonresidents who are actively enrolled in the medical cannabis program of another jurisdiction recognized by the department within 1 business day.\u201d It specifies that \u201ca visiting qualified patient may engage in all conduct authorized for a qualified patient.\u201d<\/p>\n<p>Another section of the <a href=\"https:\/\/www.flhouse.gov\/Sections\/Bills\/billsdetail.aspx?BillId=83347\" target=\"_blank\" rel=\"noopener\">bill<\/a> stipulates that doctors could certify patients to receive up to 10 70-day supply limits of smokable medical marijuana, rather than three. They could also issue up to 20 35-day supply limits instead of the current six.<\/p>\n<p>The measure is being filed just days after a Florida Democratic senator introduced legislation for the 2026 session that would <a href=\"https:\/\/www.marijuanamoment.net\/medical-marijuana-home-cultivation-would-be-legalized-in-florida-under-senators-new-bill\/\" target=\"_blank\" rel=\"nofollow noopener\">legalize home cultivation of marijuana for registered medical cannabis patients<\/a> in the state.<\/p>\n<p>The proposal\u00a0would permit qualified patients who are at least 21 years old to cultivate up to six flowering plants for personal, therapeutic use. Those patients could also buy seeds and clones from licensed dispensaries.<\/p>\n<p>If enacted into law, the bill would become law on July 1, 2026. A\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-bill-would-let-medical-marijuana-patients-grow-at-home-and-crack-down-on-hemp-derived-cannabinoids\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">similar proposal was introduced at the beginning of this year by Sen. Joe Gruters (R)<\/a>, who is now chairman of the Republican National Committee, but it did not advance.<\/p>\n<p>Gruters and Kim Rivers\u2014the CEO of Trulieve, a medical marijuana company that provided the bulk of funding for an unsuccessful cannabis legalization ballot initiative last year\u2014<a href=\"https:\/\/www.marijuanamoment.net\/trump-met-with-top-marijuana-company-ceo-and-florida-gop-senator-before-supporting-legalization-measure\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">also met with Preident Donald Trump ahead of his endorsement of the constitutional amendment<\/a>, as well as federal rescheduling and industry banking access.<\/p>\n<p>Notably, Amendment 3 would not have legalized home cultivation of marijuana\u2014a detail seized on by some critics of the industry-backed proposal.<\/p>\n<p>The campaign behind that initiative, Smart &amp; Safe Florida, recently said it\u2019s\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-marijuana-campaign-is-confident-legalization-measure-will-make-ballot-with-1-million-signatures-despite-state-roadblocks\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">collected more than one million signatures to put a new version of the legalization measure<\/a>\u00a0on the 2026 ballot\u2014and so it voluntarily declined to appeal a legal case in which\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-judge-says-officials-can-toss-200000-marijuana-legalization-petitions-putting-2026-ballot-initiative-at-risk\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">a judge allowed state officials to invalidate about 200,000 petitions<\/a>\u00a0over a largely procedural issue.<\/p>\n<p>Smart &amp; Safe filed a separate lawsuit with the state Supreme Court over another issue last month, alleging that officials are\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-marijuana-legalization-campaign-sues-state-over-nonsensical-delay-in-ballot-initiative-review\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">violating election laws by stalling a required review process for the measure<\/a>\u00a0without justification. The state has\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-officials-advance-marijuana-legalization-initiative-to-ballot-review-after-being-sued-over-delay\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">since agreed to move forward with the processing<\/a>.<\/p>\n<p>A\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/federal-judge-gives-florida-marijuana-legalization-campaign-a-win-over-states-ballot-initiative-restriction-law\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">federal judge in August separately delivered a win to the campaign<\/a>\u2014granting \u201ccomplete relief\u201d from provisions of a law the governor signed to impose other serious restrictions on signature gathering.<\/p>\n<p>In March, meanwhile, two Democratic members of Congress representing Florida asked the federal government to investigate\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/members-of-congress-want-federal-investigation-into-use-of-florida-medicaid-funds-to-oppose-marijuana-legalization-by-group-tied-to-desantis\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">what they described as \u201cpotentially unlawful diversion\u201d of millions in state Medicaid funds<\/a>\u00a0via a group with ties to Gov. Ron DeSantis (R). The money was used to fight against a citizen ballot initiative, vehemently opposed by the governor, that would have legalized marijuana for adults.<\/p>\n<p>The lawmakers\u2019 letter followed allegations that a $10 million donation from a state legal settlement was improperly made to the Hope Florida Foundation, which later sent the money to two political nonprofits, which in turn sent $8.5 million to a campaign opposing Amendment 3.<\/p>\n<p>The governor said in February that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-florida-marijuana-initiative-faces-big-time-trouble-in-supreme-court-desantis-says-predicting-itll-be-blocked-from-2026-ballot\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">the newest marijuana legalization measure is in \u201cbig time trouble\u201d with the state Supreme Court<\/a>, predicting it will be blocked from going before voters next year.<\/p>\n<p>\u201cThere\u2019s a lot of different perspectives on on marijuana,\u201d DeSantis said. \u201cIt should not be in our Constitution. If you feel strongly about it, you have elections for the legislature. Go back candidates that you believe will be able to deliver what your vision is on that.\u201d<\/p>\n<p>\u201cBut when you put these things in the Constitution\u2014and I think, I mean, the way they wrote, there\u2019s all kinds of things going on in here. I think it\u2019s going to have big time trouble getting through the Florida Supreme Court,\u201d he said.<\/p>\n<p>The latest\u00a0<a href=\"https:\/\/dos.elections.myflorida.com\/initiatives\/initdetail.asp?account=83475&amp;seqnum=3\" target=\"_blank\" rel=\"noopener\">initiative<\/a>\u00a0was filed with the secretary of state\u2019s office just months after the initial version failed during the November 2024 election\u2014despite an endorsement from President Donald Trump.<\/p>\n<p>Smart &amp; Safe Florida is hoping the revised version will succeed in 2026. The campaign\u2014which in the last election cycle received tens of millions of dollars from cannabis industry stakeholders, principally the multi-state operator Trulieve\u2014incorporated certain changes into the new version that seem responsive to criticism opponents raised during the 2024 push.<\/p>\n<p>For example, it now specifically states that the \u201csmoking and vaping of marijuana in any public place is prohibited.\u201dAnother section asserts that the legislature would need to approve rules dealing with the \u201cregulation of the time, place, and manner of the public consumption of marijuana.\u201d<\/p>\n<p>Last year, the governor accurately predicted that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/desantis-says-marijuana-legalization-will-be-on-florida-ballot-following-court-review\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">the 2024 cannabis measure from the campaign would survive a legal challenge<\/a>\u00a0from the state attorney general. Alex Andrade (R), the sponsor, said earlier this year that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/embracing-marijuana-legalization-could-help-gop-win-over-more-young-voters-trumps-first-attorney-general-pick-suggests\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">embracing cannabis reform is a way for the Republican party to secure more votes<\/a>\u00a0from young people.<\/p>\n<p>Separately, Florida medical marijuana officials are\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-officials-are-revoking-medical-marijuana-ids-from-patients-and-caregivers-with-drug-convictions-under-law-signed-by-desantis\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">actively revoking the registrations of patients and caregivers with drug-related criminal records<\/a>. The policy is part of broad budget legislation signed into law earlier this year by DeSantis.
