{"id":84413,"date":"2025-11-19T12:03:00","date_gmt":"2025-11-19T20:03:00","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/11\/19\/congressional-lawmakers-want-exemption-from-federal-hemp-thc-ban-for-states-with-regulations\/"},"modified":"2025-11-19T19:55:26","modified_gmt":"2025-11-20T03:55:26","slug":"congressional-lawmakers-want-exemption-from-federal-hemp-thc-ban-for-states-with-regulations","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/11\/19\/congressional-lawmakers-want-exemption-from-federal-hemp-thc-ban-for-states-with-regulations\/","title":{"rendered":"Congressional Lawmakers Want Exemption From Federal Hemp THC Ban For States With Regulations"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2025\/11\/MM_Bill_Tracker_V5_blank-14.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>There\u2019s an effort underway to rally federal lawmakers representing Minnesota to push the Trump administration to scale back a recently enacted ban on hemp-derived THC by providing a carve-out for states that want to regulate cannabinoid products, a Democratic congresswoman tells Marijuana Moment.<\/p>\n<p>But a GOP congressman who helped secure the ban that was signed into law last week by President Donald Trump says he\u2019s not concerned about attempts to undercut the enacted law, brushing off arguments about the possible consequences of the policy change as \u201cdesperate mistruths from an industry that stands to lose billions of dollars by selling intoxicants to children.\u201d<\/p>\n<p>Rep. Ilhan Omar (D-MN), co-chair of the Congressional Cannabis Caucus, told Marijuana Moment on Tuesday that she and other legislators are working to see if they can secure \u201cexemptions\u201d from the ban \u201cfor states that have already rolled out their hemp policies.\u201d<\/p>\n<p>\u201cSo much of our economy is already absorbing the hemp industry, and it\u2019s just going to be a tragedy for the industries that already exist in states like Minnesota,\u201d she said.<\/p>\n<p>The congresswoman said that here office has been working to \u201cgauge interest\u201d among colleagues from Minnesota about the possibility of signing a letter to the Trump administration laying out their concerns with the hemp policy change and making the case that states should be empowered to set their own cannabis laws without federal interference.<\/p>\n<p>Omar said that <a href=\"https:\/\/www.marijuanamoment.net\/ted-cruz-explains-his-vote-to-keep-hemp-thc-products-federally-legal-in-historic-first-senate-roll-call-on-cannabis\/\" target=\"_blank\" rel=\"nofollow noopener\">many Democrats voted against a motion to kill an amendment to the appropriations legislation<\/a> that Sen. Rand Paul (R-KY) sponsored in hopes of striking the hemp language, which was championed by Sen. Mitch McConnell (R-KY). There are also other Republicans \u201con this side of the chamber, so we\u2019ll see if we can get movement in that regard,\u201d she said.<\/p>\n<p>Asked whether the Cannabis Caucus is coordinating the effort, Omar said she\u2019s primarily speaking with members of Minnesota\u2019s congressional delegation, \u201cbecause if we can move them, we can try to build a broader coalition.\u201d<\/p>\n<p>\u201cThe states that are impacted have to speak up before the advocates get involved,\u201d she said.<\/p>\n<p>Rep. Andy Harris (R-MD), who championed the ban along with McConnell, is dead-set on ensuring that the prohibitionist policy is left intact.<\/p>\n<p>\u201cFederal law supersedes state laws on scheduled substances,\u201d he told Marijuana Moment. \u201cWe are going to limit an otherwise unregulated industry that sells intoxicants to children.\u201d<\/p>\n<p>The federal hemp ban\u2014which would set a THC limit on cannabinoid products so low that many stakeholders say it would effectively upend the industry\u2014<a href=\"https:\/\/www.marijuanamoment.net\/minnesota-hemp-businesses-and-senators-say-federal-thc-ban-will-hurt-the-states-economy\/\" target=\"_blank\" rel=\"nofollow noopener\">has been an especially hot topic in Minnesota<\/a>, where lawmakers legalized hemp-derived THC beverages and established a regulatory framework for such products before the state legalized adult-use marijuana.<\/p>\n<p>It took many by surprise when Minnesota\u2019s Democratic attorney general, Keith Ellison, joined 38 of his state and territory counterparts in a letter to congressional leaders earlier this month that voiced support for the hemp provisions of the spending bill Trump signed.<\/p>\n<p>Ellison <a href=\"https:\/\/www.marijuanamoment.net\/minnesota-attorney-general-defends-signing-letter-urging-congress-to-ban-hemp-thc-products-amid-industry-pushback\/\" target=\"_blank\" rel=\"nofollow noopener\">later defended his decision to sign that letter<\/a>, saying that while he supports the state\u2019s marijuana laws\u2014as well as \u201cMinnesota\u2019s THC edible industry that follows state law\u201d\u2014the so-called \u201cloophole\u201d in federal hemp statute puts his state at risk because it allows potentially non-compliant, out-of-state cannabinoid products to enter Minnesota\u2019s market.<\/p>\n<p>Still, there\u2019s been widespread outcry over the looming re-criminalization, drawing criticism from <a href=\"https:\/\/www.marijuanamoment.net\/why-is-congress-moving-to-ban-the-hemp-products-that-saved-my-sons-life-op-ed\/\" target=\"_blank\" rel=\"nofollow noopener\">parents of cannabis patients<\/a>, <a href=\"https:\/\/www.marijuanamoment.net\/pets-will-suffer-needlessly-if-federal-hemp-ban-takes-effect-and-limits-cbd-access-veterinarian-says\/\" target=\"_blank\" rel=\"noopener\">veterinarians<\/a> and <a href=\"https:\/\/www.marijuanamoment.net\/joe-rogan-slams-really-bad-federal-hemp-ban-trump-signed-blaming-alcohol-industry-for-influencing-congress\/\" target=\"_blank\" rel=\"nofollow noopener\">influencers like Joe Rogan<\/a>, for example.<\/p>\n<p>In response to the hemp ban, Rep. Nancy Mace (R-SC) recently started circulating a bill that would <a href=\"https:\/\/www.marijuanamoment.net\/nancy-mace-circulates-bill-to-block-hemp-thc-ban-that-trump-signed-into-law\/\" target=\"_blank\" rel=\"nofollow noopener\">strike the contested provisions of the appropriations legislation<\/a>. But some stakeholders worry that approach could backfire, and they\u2019re hoping to see bipartisan bills introduced in he near future that would provide a robust regulatory model for intoxicating hemp products as a viable alternative to blanket prohibition.<\/p>\n<p>Meanwhile, GOP political operative Roger Stone said this week that President Donald Trump was <a href=\"https:\/\/www.marijuanamoment.net\/gop-lawmakers-forced-trump-into-signing-hemp-ban-longtime-ally-roger-stone-says\/\" target=\"_blank\" rel=\"nofollow noopener\">effectively \u201cforced\u201d by Republican lawmakers to sign the spending bill<\/a> with the hemp THC ban language.<\/p>\n<p>However, a White House spokesperson said prior to the bill signing that <a href=\"https:\/\/www.marijuanamoment.net\/trump-supports-hemp-thc-ban-thats-advancing-in-senate-white-house-says\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">Trump specifically supported the prohibition language<\/a>.<\/p>\n<p>The Democratic governor of Kentucky said last week that <a href=\"https:\/\/www.marijuanamoment.net\/kentucky-governor-says-hemp-is-an-important-industry-that-should-be-regulated-at-the-state-level-not-federally-banned\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">the hemp industry is an \u201cimportant\u201d part of the economy that deserves to be regulated<\/a>\u00a0at the state level\u2014rather than federally prohibited, as Congress has moved to do.<\/p>\n<p>Also, a leading veterans organization is warning congressional leaders that the newly approved blanket ban on consumable hemp products\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/top-veterans-group-warns-congress-that-hemp-ban-could-slam-the-door-shut-on-medical-research\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">could inadvertently \u201cslam the door shut\u201d on critical research<\/a>.<\/p>\n<p>While many hemp stakeholders say the ban would effectively eradicate the industry\u2013even applying to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/why-is-congress-moving-to-ban-the-hemp-products-that-saved-my-sons-life-op-ed\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">nonintoxicating CBD products that people use for medical reasons<\/a>\u2014there\u2019s latent hope that they can strike a compromise deal with lawmakers before the prohibition is implemented this time next year.<\/p>\n<p>Lawmakers such as Sen. Chris Van Hollen (D-MD) also say that window could provide an opportunity to advance legislation to create an alternative regulatory model for consumable hemp products.<\/p>\n<p>There were\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/house-committee-blocks-vote-on-gop-lawmakers-amendment-to-stop-hemp-ban-while-senator-floats-regulatory-alternative\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">attempts by GOP lawmakers in both chambers to strike the hemp prohibition provision<\/a>. But the proposed amendments from Paul and Rep.
