{"id":84297,"date":"2025-11-11T12:29:08","date_gmt":"2025-11-11T20:29:08","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/11\/11\/texas-officials-post-hemp-law-checklist-list-to-help-businesses-comply-with-state-cannabis-rules\/"},"modified":"2025-11-12T19:51:19","modified_gmt":"2025-11-13T03:51:19","slug":"texas-officials-post-hemp-law-checklist-list-to-help-businesses-comply-with-state-cannabis-rules","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/11\/11\/texas-officials-post-hemp-law-checklist-list-to-help-businesses-comply-with-state-cannabis-rules\/","title":{"rendered":"Texas Officials Post Hemp Law \u2018Checklist\u2019 List To Help Businesses Comply With State Cannabis Rules"},"content":{"rendered":"<\/p>\n<p>Even as Congress is taking steps to reinstitute a federal ban on hemp products containing THC, Texas officials are distributing a new hemp law \u201cchecklist\u201d list to help businesses comply with recently enacted state cannabis rules\u2014including age-gating to prevent the sale of intoxicating cannabinoid products to youth.<\/p>\n<p>In addition to holding a license or registration with the Texas Department of State Health Services (DSHS), hemp businesses must follow a series of new regulatory policies if they sell or deliver consumable hemp products (CHPs), the flyer says.<\/p>\n<p>For each sale or delivery, employees of licensed hemp businesses must inspect a customer\u2019s ID to determine if they\u2019re at least 21 years old and the identification is not expired.<\/p>\n<p>\u201cFailure to comply with these requirements is a violation of state law and regulations,\u201d the notice says, adding that consumable hemp products include CBD and THC oils, gummies and infused food or drink edibles.<\/p>\n<p>\u201cA CHP is a product processed or manufactured for consumption that contains hemp, including food, a drug, a device and a cosmetic,\u201d the department <a href=\"https:\/\/www.dshs.texas.gov\/sites\/default\/files\/hemp\/pdf\/chp-flyer-11.7.25.pdf\" target=\"_blank\" rel=\"noopener\">said<\/a>. \u201cIt does not include any consumable hemp product containing a hemp seed, or hemp seed-derived ingredient used in a manner generally recognized as safe by the U.S. Food and Drug Administration.\u201d<\/p>\n<p>As <a href=\"https:\/\/www.dshs.texas.gov\/consumable-hemp-program\" target=\"_blank\" rel=\"noopener\">rules<\/a> for consumable hemp sales are being implemented Texas, meanwhile, the U.S. Senate on Monday passed a spending bill that <a href=\"https:\/\/www.marijuanamoment.net\/ted-cruz-explains-his-vote-to-keep-hemp-thc-products-federally-legal-in-historic-first-senate-roll-call-on-cannabis\/\" target=\"_blank\" rel=\"nofollow noopener\">includes controversial language recriminalizing hemp products containing THC<\/a> that industry stakeholders say will seriously jeopardize the market.<\/p>\n<p>Texas\u2019s own Sen. Ted Cruz (R-TX) took some by surprise by voting against a motion to table an amendment from Sen. Rand Paul (R-KY) <a href=\"https:\/\/www.marijuanamoment.net\/ted-cruz-explains-his-vote-to-keep-hemp-thc-products-federally-legal-in-historic-first-senate-roll-call-on-cannabis\/\" target=\"_blank\" rel=\"nofollow noopener\">that would have stricken the hemp provisions<\/a>. But the amendment ultimately didn\u2019t advance, and the underlying legislation is set to receive a House vote on Wednesday before potentially going to the president\u2019s desk.<\/p>\n<p>Back in Texas, industry stakeholders and advocates are condemning congressional efforts to re-criminalize consumable hemp products.<\/p>\n<p>The Texas Hemp Business Council (THBC), for example, said in a statement on Tuesday that they are \u201cdeeply disappointed\u201d by the Senate vote\u2014and they\u2019re \u201cparticularly dismayed\u201d that members declined to take up Paul\u2019s amendment.<\/p>\n<p>\u201cThe consequences of this sweeping change are severe and immediate,\u201d THBC said. \u201cNow the industry is once again caught in the crossfire of a political showdown, with hemp serving as collateral damage. Congress had years to address the FDA\u2019s regulatory failures, yet instead of crafting a science-based solution, a last-minute political deal put the entire sector at risk.\u201d<\/p>\n<p>DHSH last month formally adopted the set of emergency rules meant to prevent the sale of intoxicating hemp products to people under 21.<\/p>\n<p>After\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/texas-lawmakers-take-up-bill-to-ban-hemp-thc-products-as-democratic-walkout-prevents-floor-vote\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">similar restrictions were implemented by the Texas Alcoholic Beverage Commission (TABC)<\/a> in September, DSHS then moved forward with the policies changes that <a href=\"https:\/\/www.marijuanamoment.net\/texas-governor-signs-hemp-executive-order-setting-age-limit-and-labeling-requirements-for-thc-products\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">comply with the governor\u2019s recent executive order on hemp<\/a>.<\/p>\n<p>The checklist flyer is also being released weeks after regulators with the Department of Public Safety (DPS) adopted new rules to implement a <a href=\"https:\/\/www.marijuanamoment.net\/texas-officials-adopt-rules-to-expand-number-of-medical-marijuana-dispensaries-in-the-state\/\" target=\"_blank\" rel=\"nofollow noopener\">law\u00a0significantly expanding the state\u2019s medical marijuana program<\/a>.<\/p>\n<p>This specific set of rules will increase the number of licensed dispensaries, establish security requirements for \u201csatellite\u201d locations and authorize the revocation of licenses for certain violations.<\/p>\n<p>DPS will\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/texas-officials-take-key-step-to-expand-medical-marijuana-program-as-hemp-ban-bill-stalls\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">ultimately be issuing 12 new licenses for dispensaries across the state<\/a>. Currently there are only three. The additional licensees will go through a competitive process, with officials prioritizing Texas\u2019s public health regions to optimize access.<\/p>\n<p>Also in line with the state\u2019s medical cannabis expansion law that Gov. Greg Abbott (R) signed, the state Health and Human Services Commission (HHSC) proposed rules in September to <a href=\"https:\/\/www.marijuanamoment.net\/texas-officials-post-rules-to-let-doctors-recommend-new-medical-marijuana-qualifying-conditions-and-allow-inhalation-devices\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">let physicians recommend new qualifying conditions for cannabis<\/a>\u00a0and to create standards for allowable inhalation devices.<\/p>\n<p>Meanwhile last month, the head of the Texas Department of Agriculture (TDA) pushed back against a GOP senator\u2019s \u201cincorrect assertions\u201d about <a href=\"https:\/\/www.marijuanamoment.net\/texas-agriculture-commissioner-pushes-back-on-gop-senators-hemp-law-criticism-while-signaling-thc-measurement-standards-change\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">the state\u2019s regulatory compliance with federal hemp laws<\/a>.
