{"id":84178,"date":"2025-11-04T10:25:39","date_gmt":"2025-11-04T18:25:39","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/11\/04\/alcohol-industry-groups-push-congress-to-ban-intoxicating-hemp-products-at-least-until-federal-regulations-are-enacted\/"},"modified":"2025-11-05T19:52:00","modified_gmt":"2025-11-06T03:52:00","slug":"alcohol-industry-groups-push-congress-to-ban-intoxicating-hemp-products-at-least-until-federal-regulations-are-enacted","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/11\/04\/alcohol-industry-groups-push-congress-to-ban-intoxicating-hemp-products-at-least-until-federal-regulations-are-enacted\/","title":{"rendered":"Alcohol Industry Groups Push Congress To Ban Intoxicating Hemp Products\u2014At Least Until Federal Regulations Are Enacted"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2025\/11\/MM_Bill_Tracker_V5_blank-6.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>A coalition of major alcohol industry associations is throwing its weight behind a push to get Congress to ban intoxicating hemp products\u2014at least on a temporary basis before the federal government creates a \u201crobust regulatory framework\u201d for the marketplace.<\/p>\n<p>As lawmakers work to finalize appropriations legislation, they\u2019ve felt pressure on both sides of the hemp debate, with some interests endorsing controversial proposals to outright prohibit intoxicating cannabinoids and others that have called for a comprehensive regulatory approach that could prevent significant economic fallout for the hemp industry.<\/p>\n<p>A new letter from the American Distilled Spirits Alliance (ADSA), Beer Institute (BI), Distilled Spirits Council of the U.S. (DISCUS), Wine America and Wine Institute seems to promote a middle-ground solution\u2014but one the begins with a ban on hemp THC products as championed by Sen. Mitch McConnell (R-KY) and Rep. Andy Harris (R-MD).<\/p>\n<p>The letter, sent to congressional leaders on Tuesday, states that the alcohol associations are aligned with a group of 39 state and territory attorneys general who recently <a href=\"https:\/\/www.marijuanamoment.net\/39-bipartisan-state-and-territory-attorneys-general-push-congress-to-ban-intoxicating-hemp-products\/\" target=\"_blank\" rel=\"nofollow noopener\">urged federal legislators to enact a ban on the hemp items<\/a>.<\/p>\n<p>\u201cOur respective organizations produce virtually all the beer, distilled spirits, and wine available in every state and congressional district across the country, representing some of the world\u2019s most valuable consumer brands,\u201d the letter says.<\/p>\n<p>\u201cUnfortunately, the ambiguous language contained in the 2018 Farm Bill has been manipulated and exploited by certain actors, fueling the rapid growth of a largely unregulated market that is knowingly and willfully ignoring the [Food and Drug Administration, or FDA] position that the addition of intoxicating cannabinoids (like delta-8 THC and delta-9 THC) to food is illegal,\u201d it says.<\/p>\n<p>\u201cThe rhetoric surrounding this issue is unfortunate,\u201d the coalition said, adding that \u201ccertain entities, including some within the beverage alcohol space, claim that any effort to rein in the sale of highly intoxicating hemp THC products is tantamount to \u2018prohibition\u2019 or a \u2018ban\u2019 that will adversely impact industrial hemp farmers or even products that contain non-intoxicating cannabidiol (CBD).\u201d<\/p>\n<p>Wine &amp; Spirits Wholesalers of America (WSWA), a key player in the space, is among those alcohol interests that have pushed back against the proposed prohibition. WSWA also <a href=\"https:\/\/www.marijuanamoment.net\/major-alcohol-industry-trade-association-welcomes-its-first-thc-cannabis-beverage-member\/\" target=\"_blank\" rel=\"nofollow noopener\">added a company that makes THC-infused drinks to its membership roster<\/a> for the first time in September.<\/p>\n<p>While supporters of the restrictive hemp language that\u2019s been proposed in Congress have maintained that non-intoxicating CBD products would not be impacted, the provisions that have materialized in recent months leave ample room for interpretation and raise questions about the feasibility of marketing cannabidiol with no traces of THC or other intoxicating cannabinoids.<\/p>\n<p>In June, WSWA <a href=\"https:\/\/www.marijuanamoment.net\/major-alcohol-industry-group-pushes-congress-to-dial-back-proposed-hemp-product-ban\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">called on Congress to dial back language in a House spending bill<\/a>\u00a0that would ban most consumable hemp products, instead proposing to maintain the legalization of naturally derived cannabinoids from the crop and only prohibit synthetic items.<\/p>\n<p>In the new letter, the other alcohol groups didn\u2019t necessarily suggest that the government should permanently ban intoxicating hemp products from the market, however.<\/p>\n<p>\u201cManufacturers of beverage alcohol, one of the most highly regulated consumer products, urge Congress to act immediately to remove hemp-derived THC products from the marketplace until a robust federal regulatory framework is established,\u201d they said. \u201cWe stand ready to work with Congress and the Administration to enact regulations that protect consumers and ensure a safe, orderly marketplace for these intoxicating products.\u201d<\/p>\n<p>There\u2019s been a <a href=\"https:\/\/www.marijuanamoment.net\/alcohol-industry-steps-up-lobbying-on-hemp-drinks-as-congress-debates-thc-ban\/\" target=\"_blank\" rel=\"nofollow noopener\">surge in congressional lobbying from major alcohol companies and associations<\/a> in recent months, with stakeholders aiming to influence federal hemp laws that focus on <a href=\"https:\/\/www.marijuanamoment.net\/most-people-who-drink-thc-infused-cannabis-beverages-reduce-their-use-of-alcohol-survey-shows\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">THC beverages that many consumers are turning to as beer and liquor alternatives<\/a>.<\/p>\n<p>Those lobbying on the issue include some of the signatories on this latest letter to congressional leaders.<\/p>\n<p>As Congress continues to navigate a path forward on funding legislation to end an ongoing government shutdown, lawmakers are\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/future-of-federal-hemp-laws-in-flux-amid-congressional-negotiations-but-gop-senators-say-alternatives-to-thc-ban-are-on-the-table\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">still at work attempting to reach a deal on federal hemp laws<\/a>\u2014with one GOP senator telling Marijuana Moment that multiple options are on the table, though it will ultimately come down to what leadership wants.<\/p>\n<p>Two GOP lawmakers\u2014McConnell and Harris\u2014have pushed aggressively for an outright ban on hemp products containing THC. But others such as Sen. Rand Paul (R-KY) have insisted that such a policy change would devastate the industry. And Paul said recently he\u2019d go so far as to <a href=\"https:\/\/www.marijuanamoment.net\/gop-senator-threatens-to-block-bills-to-reopen-government-if-hemp-thc-ban-moves-forward\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">hold up large-scale spending legislation if a full ban was kept intact<\/a>.<\/p>\n<p>The senator also pushed back against the recent letter from the state and territory attorneys general who implored Republican leaders to fully prevent the marketing of intoxicating hemp products.<\/p>\n<p>\u201cSome of them came back from states that have completely legalized marijuana, and they\u2019re going to ban hemp? I mean, it\u2019s just ridiculous,\u201d he said. \u201cSo they prefer people to use a much higher dose of THC from cannabis than lower-dose hemp products.
