{"id":84043,"date":"2025-10-28T11:55:15","date_gmt":"2025-10-28T19:55:15","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/10\/28\/tribe-in-nebraska-approves-first-marijuana-license-as-state-officials-scale-back-voter-approved-medical-cannabis-law\/"},"modified":"2025-10-29T20:03:10","modified_gmt":"2025-10-30T04:03:10","slug":"tribe-in-nebraska-approves-first-marijuana-license-as-state-officials-scale-back-voter-approved-medical-cannabis-law","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/10\/28\/tribe-in-nebraska-approves-first-marijuana-license-as-state-officials-scale-back-voter-approved-medical-cannabis-law\/","title":{"rendered":"Tribe In Nebraska Approves First Marijuana License As State Officials Scale Back Voter-Approved Medical Cannabis Law"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2025\/10\/MM_Bill_Tracker_V5_blank-53.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>As Nebraska officials face criticism over attempts to significantly scale back a voter-approved medical marijuana law, an Native American tribe within the state has now approved its first license for a vertically integrated cannabis operation since approving legalization in its borders earlier this year.<\/p>\n<p>At its first meeting on Monday, the <a href=\"https:\/\/www.marijuanamoment.net\/indian-tribe-in-nebraska-votes-to-legalize-marijuana-for-recreational-and-medical-use-effective-immediately\/\" target=\"_blank\" rel=\"nofollow noopener\">Omaha Tribe of Nebraska\u2019s Cannabis Regulatory Commission<\/a> discussed proposed rules to stand up the tribal marijuana market. They also agreed to license the tribe itself to move forward with next steps in setting up the industry for launch.<\/p>\n<p>The draft rules weren\u2019t adopted at the meeting, but the tribe\u2019s attorney general, John Cartier, said that in time he wants the territory to \u201cstand as a direct contrast to that dysfunction and show that the will of the voters is being respected, at least on the Omaha Reservation.\u201d<\/p>\n<p>\u201cWe\u2019re prepared to move forward to grant access to the folks that need help through medical cannabis,\u201d he said.<\/p>\n<p>Under the legalization code that the tribe adopted in July\u2014making it the first to enact such a reform in a state where lawmakers have long resisted the policy change\u2014adults 21 and older can purchase and possess up to an ounce of cannabis as long as they\u2019re on the tribal land.<\/p>\n<div class=\"fb-video\" data-allowfullscreen=\"true\" data-href=\"https:\/\/www.facebook.com\/ntvnews\/videos\/869213298769620\" style=\"background-color: #fff\" \/>\n<p>Arthur Isagholian, a member of the cannabis commission, cautioned at the meeting that, \u201cIf you violate rules off of the tribal land and you get caught with product that you purchased on tribal land, you\u2019re kind of on your own,\u201d as NTV <a href=\"https:\/\/nebraska.tv\/news\/omaha-tribes-cannabis-commission-holds-first-public-meeting\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>While the tribe approved a vertically integrated license for its own purposes to help streamline the implementation of legalization in the territory, it\u2019s unclear when the regulatory rules will go up for a vote and open up opportunities for legal sales.<\/p>\n<p>The tribe\u2019s license \u201cwill be subject, obviously, to our published rules and regulations\u2014but just so the tribe is able to start working towards agreements, equity and funding while we\u2019re hashing this out,\u201d a member said.<\/p>\n<p>The commission will be meeting once a month, and it\u2019s expected that at least some of the proposed regulations will be approved when members come together again in November.<\/p>\n<div class=\"fb-post\" data-href=\"https:\/\/www.facebook.com\/omahatribeofnebraska\/posts\/pfbid02117HW81viirXGW43aCd52DwNFqLmxs93f29bsqipKGfoVGHLdVMRx3pimS5kQqgal\" data-width=\"552\" style=\"background-color: #fff\" \/>\n<p>In a press release ahead of Monday\u2019s meeting, the tribe\u2019s attorney general had some choice words for state officials.<\/p>\n<p>\u201cWhile Nebraska\u2019s process lurches from delay to debate, we\u2019re doing the one thing patients and businesses need\u2014governing,\u201d Cartier said. \u201cOn October 27, we give Nebraska a greenlight: clear rules, real oversight, and a workable, well-regulated industry rooted in sovereignty, safety, and common sense.\u201d<\/p>\n<p>\u201cWe want to stand as a direct contrast to that dysfunction [at the state level] and show that the will of the voters is being respected, at least on the Omaha Reservation, and we\u2019re prepared to move forward to grant access to the folks that need help through medical cannabis,\u201d he <a href=\"https:\/\/nebraskapublicmedia.org\/en\/news\/news-articles\/omaha-tribe-cannabis-commission-holds-first-meeting\/\" target=\"_blank\" rel=\"noopener\">said<\/a>.<\/p>\n<p>He\u2019s not alone is the criticism. If organizers collect enough valid signatures from registered voters, it could appear on the 2026 ballot.<\/p>\n<p>The marijuana reform push also comes as the state attorney general is\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/nebraska-attorney-general-expands-intoxicating-hemp-and-delta-8-crackdown\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">cracking down on sales of intoxicating hemp-derived products<\/a>, including those containing delta-8 THC.<\/p>\n<p>Las year\u2019s approval of two medical marijuana ballot measures came after an earlier attempt in 2020 gathered enough signatures for ballot placement, but saw the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/nebraska-supreme-court-hears-case-challenging-medical-marijuana-ballot-initiative\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">measure invalidated by the state Supreme Court<\/a>\u00a0following a single-subject challenge.
