{"id":83798,"date":"2025-10-15T07:44:07","date_gmt":"2025-10-15T15:44:07","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/10\/15\/ohio-judge-blocks-governors-hemp-product-ban-from-taking-effect\/"},"modified":"2025-10-15T19:49:43","modified_gmt":"2025-10-16T03:49:43","slug":"ohio-judge-blocks-governors-hemp-product-ban-from-taking-effect","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/10\/15\/ohio-judge-blocks-governors-hemp-product-ban-from-taking-effect\/","title":{"rendered":"Ohio Judge Blocks Governor\u2019s Hemp Product Ban From Taking Effect"},"content":{"rendered":"<\/p>\n<p>\u201cToday\u2019s decision allows thousands of hardworking Ohio entrepreneurs to continue supporting their families and serving consumers who rely on access to safe, legal, and properly regulated hemp products.\u201d<\/p>\n<p><strong>By Megan Henry, Ohio Capital Journal<\/strong><\/p>\n<p>Ohio stores can temporarily resume to selling intoxicating hemp products\u2014for now.<\/p>\n<p>Franklin County Court of Common Pleas Judge Carl Aveni granted a 14-day temporary restraining order on <a href=\"https:\/\/www.marijuanamoment.net\/ohio-governor-issues-order-banning-intoxicating-hemp-product-sales-for-90-days\/\" target=\"_blank\" rel=\"nofollow noopener\">Gov. Mike DeWine\u2019s (R) executive order banning the sale of intoxicating hemp products<\/a> on October 14.<\/p>\n<p>DeWine announced last week a 90-day executive order that bans the sale of intoxicating hemp products that also started on October 14. The next hearing in this case is scheduled for October 28.<\/p>\n<p>Intoxicating hemp products are items that contain THC that are sold anywhere other than licensed marijuana dispensaries including gas stations, smoke shops and CBD stores, among others.<\/p>\n<p>Marijuana is not considered an intoxicating hemp product and is legal in Ohio. This ban does not affect the marijuana law passed by voters in 2023.<\/p>\n<p>\u201cWhile we continue to fight in court, today\u2019s developments underscore our continued desire to work with the General Assembly to pass permanent legislation regarding intoxicating hemp,\u201d DeWine said in a statement.<\/p>\n<p>Titan Logistic Group, Fumee Smoke and Vape and Invicta Partners\u2014all members of the Ohio Healthy Alternatives Association\u2014filed a lawsuit last week against the ban, arguing DeWine is breaking federal and state law by restricting access to these products.<\/p>\n<p>\u201cToday\u2019s decision allows thousands of hardworking Ohio entrepreneurs to continue supporting their families and serving consumers who rely on access to safe, legal, and properly regulated hemp products,\u201d Ohio Healthy Alternatives Association said in a statement.<\/p>\n<p>The 2018 Farm Bill says hemp can be grown legally if it contains less than 0.3 percent THC.<\/p>\n<p>\u201cThe Executive Order is overly broad in that it applies to all hemp and hemp products including those that are legal under the 2018 Farm Bill and Ohio\u2019s current laws,\u201d the lawsuit says.<\/p>\n<p>\u201cIt is also vague because there is no definition of \u2018intoxicating hemp\u2019 in the Ohio Revised Code or Ohio Administrative Code.\u201d<\/p>\n<p>DeWine\u2014who has been calling on lawmakers to regulate or ban delta-8 THC products since January 2024\u2014spent much of last week\u2019s press conference where he announced the ban talking about the need to protect children from these products.<\/p>\n<div class=\"embed-twitter\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Ohio voters have opined on where they want cannabis sold by their passage of Issue 2, which passed with the support of 57% of Ohio voters. <\/p>\n<p>Issue 2 limited the sale of cannabis to dispensaries.
