{"id":83575,"date":"2025-10-01T12:23:36","date_gmt":"2025-10-01T20:23:36","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/10\/01\/oregon-officials-ask-federal-court-to-reverse-ruling-that-blocked-marijuana-industry-labor-law-approved-by-voters\/"},"modified":"2025-10-01T20:02:27","modified_gmt":"2025-10-02T04:02:27","slug":"oregon-officials-ask-federal-court-to-reverse-ruling-that-blocked-marijuana-industry-labor-law-approved-by-voters","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/10\/01\/oregon-officials-ask-federal-court-to-reverse-ruling-that-blocked-marijuana-industry-labor-law-approved-by-voters\/","title":{"rendered":"Oregon Officials Ask Federal Court To Reverse Ruling That Blocked Marijuana Industry Labor Law Approved By Voters"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2025\/10\/MM_Bill_Tracker_V5_blank-1.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>Oregon officials are asking a federal appeals court to reverse a judge\u2019s ruling that struck down a voter-approved law to <a href=\"https:\/\/www.marijuanamoment.net\/oregon-officials-will-appeal-court-decision-that-overturned-marijuana-industry-labor-peace-law\/\" target=\"_blank\" rel=\"nofollow noopener\">require licensed marijuana businesses to enter into labor peace agreements with workers<\/a> and mandate that employers remain neutral in discussions around unionization.<\/p>\n<p>In a filing with the U.S. Court of Appeals for the Ninth Circuit last week, attorneys for Oregon Gov. Tina Kotek (D), Attorney General Dan Rayfield (D) and Oregon Liquor and Cannabis Commission\u2019s (OLCC) Dennis Doherty and Craig Prins urged a review of the \u201cconstitutional challenge\u201d to the state law.<\/p>\n<p>The officials previously provided notice that they\u2019d be contesting the U.S. District Court for the District of Oregon decision back in June.<\/p>\n<p>After two marijuana businesses\u2014Bubble\u2019s Hash and Ascend Dispensary\u2014initially filed a lawsuit in the district court challenging the implementation of Measure 119, a federal judge sided with the plaintiffs, finding that the law unconstitutionally restricts free speech and violates the federal National Labor Relations Act (NLRA).<\/p>\n<p>Under the currently paused law, a marijuana businesses that was unable to provide proof of a labor peace agreement could have been subject a denial or revocation of their license.<\/p>\n<p>\u201cThe challenged law is constitutional because it does not in fact prohibit employers from expressing their views on any topic including unionization, and it therefore does not conflict either with the First Amendment\u2019s free-speech guarantee or with any substantive protection in the NLRA,\u201d the latest filing, first <a href=\"https:\/\/www.law360.com\/cannabis\/articles\/2392977\" target=\"_blank\" rel=\"noopener\">reported<\/a> by Law360, says. \u201cBut even if it does affect employers\u2019 freedom of expression, that effect is permissible under the NLRA because that federal law does not affirmatively protect employer expression at all.\u201d<\/p>\n<p>\u201cFurther, to the extent the federal law does protect employer expression on unionization, it leaves room to accommodate local interests in tightly regulating the marijuana market, which Congress intended to be tightly regulated,\u201d it continues. \u201cAnd any effect on expression is also permissible under the First Amendment because that effect is limited to commercial speech and survives intermediate scrutiny.\u201d<\/p>\n<p>In an order in May, the district court judge walked through various components of the legal arguments from both sides and ultimately agreed that the Oregon law is preempted by the NLRA, which is meant to provide protections for workers who want to unionize\u2014but specifically preserves the right for \u201cuninhibited, robust, and wide-open debate in labor disputes.\u201d<\/p>\n<p>By mandating neutrality from employers in labor discussions, that constitutes a violation of the NLRA, the judge ruled.<\/p>\n<p>But the state is asserting that the federal circuit court \u201cshould reverse the district court\u2019s judgment, and it should remand the case with instructions to enter judgment for defendants on the preemption and First Amendment claims.\u201d<\/p>\n<p><strong>\u2014<br \/>\nMarijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking hundreds of cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2025\/10\/MM_Bill_Tracker_V5_blank.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/p>\n<p>On the question of whether the law violates First Amendment protections under the U.S. Constitution, the cannabis companies argued that \u201cMeasure 119 is a content-based restriction on speech that is subject to strict scrutiny, and that Defendants fail to provide a compelling government interest requiring this restriction.\u201d<\/p>\n<p><a href=\"https:\/\/www.marijuanamoment.net\/oregon-voters-approve-ballot-measure-protecting-marijuana-industry-workers-union-rights\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">Measure 119 passed with about 57 percent of the vote<\/a>\u00a0last November. A regional chapter of United Food and Commercial Workers (UFCW)\u2014UFCW Local 555\u2014had submitted more than 160,000 signatures to qualify the measure for ballot placement last year.<\/p>\n<p>During the Oregon legislature\u2019s 2023 session, lawmakers declined to enact a bill containing similar provisions. UFCW lobbied for that legislation, and it decided to mount a campaign to let voters decide on the issue this year after that effort failed.<\/p>\n<p>UFCW pressed legislators to enact a bill to codify the labor protections in 2023.
