{"id":83475,"date":"2025-09-23T11:07:43","date_gmt":"2025-09-23T19:07:43","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/09\/23\/new-texas-emergency-rules-ban-hemp-sales-to-people-under-21-in-line-with-governors-executive-order\/"},"modified":"2025-09-24T19:56:28","modified_gmt":"2025-09-25T03:56:28","slug":"new-texas-emergency-rules-ban-hemp-sales-to-people-under-21-in-line-with-governors-executive-order","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/09\/23\/new-texas-emergency-rules-ban-hemp-sales-to-people-under-21-in-line-with-governors-executive-order\/","title":{"rendered":"New Texas Emergency Rules Ban Hemp Sales To People Under 21 In Line With Governor\u2019s Executive Order"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2025\/09\/MM_Bill_Tracker_V5_blank-46.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>Texas officials have quickly adopted changes to the state\u2019s hemp laws, consistent with the governor\u2019s recent executive order, making it so <a href=\"https:\/\/www.marijuanamoment.net\/texas-governor-signs-hemp-executive-order-setting-age-limit-and-labeling-requirements-for-thc-products\/\" target=\"_blank\" rel=\"nofollow noopener\">people under the age of 21 will no longer be permitted to purchase consumable hemp products<\/a>.<\/p>\n<p>The Texas Alcoholic Beverage Commission (TABC) issued an emergency rule that took effect on Tuesday, stipulating that no businesses licensed under the agency may sell cannabis to those under 21. Doing so will now result in an automatic license or permit cancellation.<\/p>\n<p>Failing to check IDs to ensure that a patron is of age will also carry the penalty of an automatic license cancellation.<\/p>\n<p>\u201cThis emergency adoption is necessary to help prevent minors from accessing and using consumable hemp products (CHP) that will negatively impact the minors\u2019 health, which in turn negatively impacts the general welfare and public safety,\u201d TABC said in a notice.<\/p>\n<p>And while it was just two weeks ago that Gov. Greg Abbott (R) signed an executive order laying out new rules for the hemp market, the agency said that the rules are being adopted on an \u201cemergency basis\u201d and take effect immediately \u201cbecause an imminent peril to the public health, safety, or welfare requires adoption on fewer than 30 days\u2019 notice.\u201d<\/p>\n<p>\u201cThe harms associated with cannabis\/THC use by minors are well documented,\u201d it said.<\/p>\n<p>State statute says emergency rules can only be effective for up to 180 days, and TACB said it \u2018intends to propose these or similar rules under the normal rulemaking process and will consider any additional action necessary in the event unforeseen issues arise with the adopted sections. Future rulemaking may also provide additional guidance.\u201d<\/p>\n<p>While the <a href=\"https:\/\/go.boarddocs.com\/tx\/tabc\/Board.nsf\/goto?open&amp;id=DLJK6V50662A\" target=\"_blank\" rel=\"noopener\">rules<\/a> are actively in effect, the agency noted that it will begin enforcement on October 1.<\/p>\n<p>The Texas Cannabis Collective, which strongly resisted recent proposals in the legislature to ban hemp with any amount of THC, <a href=\"https:\/\/texascannabispolicy.org\/news-and-updates\/f\/tabc-moves-quickly-to-enforce-governors-executive-order-on-hemp\" target=\"_blank\" rel=\"noopener\">said<\/a> the TABC action \u201cfollows Governor Abbott\u2019s decisive steps earlier this year\u201d when he vetoed a Senate bill to recriminalize consumable cannabinoid products.<\/p>\n<p>Meanwhile, Texas officials have separately taken another step toward implementing a law to <a href=\"https:\/\/www.marijuanamoment.net\/newly-posted-texas-medical-marijuana-rules-will-let-doctors-recommend-new-qualifying-conditions-for-patients\/\" target=\"_blank\" rel=\"nofollow noopener\">significantly expand the state\u2019s medical marijuana program<\/a>\u2014proposing rules to to <a href=\"https:\/\/www.marijuanamoment.net\/texas-officials-post-rules-to-let-doctors-recommend-new-medical-marijuana-qualifying-conditions-and-allow-inhalation-devices\/\" target=\"_blank\" rel=\"nofollow noopener\">let physicians recommend new qualifying conditions for cannabis<\/a> and to create standards for allowable inhalation devices in line with legislation enacted by lawmakers and the governor earlier this year.<\/p>\n<p>Last month, the Department of Public Safety (DPS) also posted a set of additional rules in the Register to <a href=\"https:\/\/www.marijuanamoment.net\/texas-officials-publish-rules-to-expand-medical-marijuana-access-with-new-dispensary-licenses\/\" target=\"_blank\" rel=\"nofollow noopener\">increase the number of licensed medical marijuana dispensaries in Texas<\/a>\u00a0under the recently enacted legislation.<\/p>\n<p>DPS <a href=\"https:\/\/www.marijuanamoment.net\/texas-officials-take-key-step-to-expand-medical-marijuana-program-as-hemp-ban-bill-stalls\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">will ultimately be issuing 12 new licenses for dispensaries across the state<\/a>. Currently there are only three. The additional licensees will go through a competitive process, with officials prioritizing Texas\u2019s public health regions to optimize access.<\/p>\n<p>The first round of licenses will be awarded to nine of 139 applicants who submitted their forms during an earlier application window in 2023. DPS will select those nine licensees on December 1.
