{"id":83213,"date":"2025-09-10T05:16:13","date_gmt":"2025-09-10T13:16:13","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/09\/10\/house-votes-to-expand-marijuana-waivers-for-military-recruits-who-test-positive-for-thc\/"},"modified":"2025-09-10T19:57:30","modified_gmt":"2025-09-11T03:57:30","slug":"house-votes-to-expand-marijuana-waivers-for-military-recruits-who-test-positive-for-thc","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/09\/10\/house-votes-to-expand-marijuana-waivers-for-military-recruits-who-test-positive-for-thc\/","title":{"rendered":"House Votes To Expand Marijuana Waivers For Military Recruits Who Test Positive For THC"},"content":{"rendered":"<\/p>\n<p>The House of Representatives has voted to <a href=\"https:\/\/www.marijuanamoment.net\/house-to-vote-on-expanding-marijuana-waivers-for-military-recruits-but-separate-hemp-amendment-is-blocked-from-defense-bill\/\" target=\"_blank\" rel=\"nofollow noopener\">expand waivers for military recruits who\u2019ve tested positive for marijuana<\/a>.<\/p>\n<p>The amendment to the National Defense Authorization Act (NDAA) passed on a voice vote on Tuesday as part of an en bloc package, with no debate.<\/p>\n<p>The measure, sponsored by Reps. Dave Joyce (R-OH) and Dina Titus (D-NV), co-chairs of the Congressional Cannabis Caucus, acknowledges that the Army and Navy have already \u201ctaken positive steps in their work to design and implement a waiver system that permits potential enlistees into the Armed Forces to reapply for enlistment following a positive toxicology test for tetrahydrocannabinol.\u201d<\/p>\n<p>But the amendment calls on the Air Force, Space Force and Marine Corps to follow through, especially \u201cgiven the ongoing recruitment and retention challenges undermining the Armed Forces readiness goals.\u201d<\/p>\n<p>The measure, which is now part of the NDAA bill pending final House passage, would require those military branches to \u201cdevelop and implement their own permanent waiver system commensurate with the process employed by the Army and Navy.\u201d<\/p>\n<p>It says that the secretary of defense \u201cshall develop a program through which to provide waivers for potential enlistees into the Armed Forces who were not permitted to enlist following a positive toxicology test for tetrahydrocannabinol so that such potential enlistees are permitted to reapply for enlistment.\u201d<\/p>\n<p>Further, the Department of Defense would be required to \u201cassess the feasibility of contacting\u201d prospective enlistees who were previously rejected over cannabis and, \u201cto the extent feasible, develop a plan to contact such potential enlistees.\u201d<\/p>\n<p \/>\n<p>Within 180 days of enactment, the defense secretary would need to submit a report to the congressional committees of jurisdiction with a \u201cplan to create, disseminate, and use a clear definition that highlights that all waivered recruits are qualified and eligible to enlist in the Armed Forces, even if they do not meet every enlistment standard, and that existing standards of enlistment allow for waivers.\u201d<\/p>\n<p>The House last year passed a version of the NDAA that would have\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/house-passes-defense-bill-that-omits-provisions-to-prevent-marijuana-testing-for-military-recruits\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">prevented drug testing for marijuana as a condition of enlistment<\/a>\u00a0in the military or for commission as an officer. But it was not included in the final version that was signed into law following bicameral negotiations with the Senate.<\/p>\n<p>The House Rules Committee had <a href=\"https:\/\/rules.house.gov\/bill\/119\/hr-3838\" target=\"_blank\" rel=\"noopener\">cleared<\/a> the current cannabis <a href=\"https:\/\/repcloakroom.house.gov\/amendment\/h-r-3838-streamlining-procurement-for-effective-delivery-and-national-defense-authorization-act-fiscal-year-2026\/\" target=\"_blank\" rel=\"noopener\">amendment<\/a> for a floor vote earlier this week, while separately blocking consideration of a different proposal from Rep. Tony Gonzales (R-TX) to clarify that <a href=\"https:\/\/www.marijuanamoment.net\/gop-lawmakers-seek-to-expand-marijuana-waivers-for-military-recruits-and-allow-service-members-to-use-hemp\/\" target=\"_blank\" rel=\"nofollow noopener\">military service members can use legal hemp products<\/a>.<\/p>\n<p>The measure would have made it so the secretary of defense could not \u201cprohibit a member of the Armed Forces from possessing, using, or consuming a product containing hemp or any ingredient derived from hemp if such possession, use, or consumption is in compliance with applicable Federal, State, and local law.\u201d<\/p>\n<p>The Gonzales amendment, which was not made in order for a floor vote, appeared to be responsive to a series of policy updates from various military branches that have banned the use of cannabis, including legal hemp products, by service members.<\/p>\n<p>In February, for example, a memo to Air Force personnel in Massachusetts warned that not only marijuana but also hemp-derived cannabinoids, including CBD and delta-8 THC,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-air-force-memo-cautions-that-possession-of-cannabis-products-including-hemp-and-cbd-could-carry-heavy-penalties\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">are prohibited on military bases and related properties<\/a>.<\/p>\n<p>In 2022, the Air Force\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/defense-department-warns-that-hemp-granola-and-cbd-hand-sanitizer-can-compromise-military-readiness\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">expressed concern that even using CBD-infused hand sanitizer or hemp granola could inadvertently compromise \u201cmilitary readiness.\u201d<\/a><\/p>\n<p>After its initial 2019 announcement, DOD more broadly reaffirmed that CBD is off limits to service members\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/u-s-military-reiterates-that-cbd-is-off-limits-to-service-members\/\" rel=\"noopener noreferrer\" data-google-interstitial=\"false\" target=\"_blank\">in notices published in 2020<\/a>.<\/p>\n<p>The Navy, for its part, issued an initial notice in 2018 informing ranks that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/navy-bans-sailors-from-using-cbd-despite-federal-hemp-legalization-new-memo-says\/\" rel=\"noopener noreferrer\" data-google-interstitial=\"false\" target=\"_blank\">they\u2019re barred from using CBD and hemp products<\/a>\u00a0no matter their legality.
