{"id":83207,"date":"2025-09-10T08:19:47","date_gmt":"2025-09-10T16:19:47","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/09\/10\/texas-governor-signs-hemp-executive-order-setting-age-limit-and-labeling-requirements-for-thc-products\/"},"modified":"2025-09-10T19:57:18","modified_gmt":"2025-09-11T03:57:18","slug":"texas-governor-signs-hemp-executive-order-setting-age-limit-and-labeling-requirements-for-thc-products","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/09\/10\/texas-governor-signs-hemp-executive-order-setting-age-limit-and-labeling-requirements-for-thc-products\/","title":{"rendered":"Texas Governor Signs Hemp Executive Order Setting Age Limit And Labeling Requirements For THC Products"},"content":{"rendered":"<\/p>\n<p><em>\u201cMy executive order makes sure that kids are kept safe and parents have peace of mind now, and that consumers know the products they purchase are tested and labeled responsibly.\u201d<\/em><\/p>\n<p><strong>By Alex Nguyen, The Texas Tribune<\/strong><\/p>\n<p>THC products will remain largely legal in Texas, but will be banned for minors and current regulations further enforced under a <a href=\"https:\/\/gov.texas.gov\/uploads\/files\/press\/EO-GA-56_hemp_and_hemp-derived_products_regulation_IMAGE_2025-09-10.pdf\" target=\"_blank\" rel=\"nofollow noopener\">new executive order<\/a> by Gov. <a href=\"https:\/\/www.texastribune.org\/directory\/greg-abbott\/\" target=\"_blank\" rel=\"nofollow noopener\">Greg Abbott<\/a> (R).<\/p>\n<p>Abbott on Wednesday directed the Texas Department of State Health Services and the Alcoholic Beverage Commission to ban the sales of THC products to minors, require ID verification of all customers before a purchase and revoke the permit of retailers that violate the rule.<\/p>\n<p>\u201cSafety for kids, freedom for adults,\u201d the governor said in a post on X.<\/p>\n<p>Abbott\u2019s order requires DSHS and TABC to immediately start their rule-making processes to create the age limit, but does not prescribe when the restriction must take effect. Abbott\u2019s order also doesn\u2019t specify the age threshold and leaves that detail up to the agencies, though the governor has repeatedly called on lawmakers to prohibit such products for those under 21.<\/p>\n<p>DSHS then has to start reviewing current rules within 10 business days to possibly add stricter labeling and testing requirements, improve recordkeeping to facilitate oversight, as well as increase licensing fees to support enforcement. The Tribune has also reached out to DSHS and DPS for comment.<\/p>\n<p>Additionally, the governor requires DSHS, TABC, the Texas A&amp;M AgriLife Extension Service and other relevant agencies to jointly look at how to create a comprehensive \u201cregulatory framework.\u201d He pointed to <a href=\"https:\/\/capitol.texas.gov\/BillLookup\/history.aspx?LegSess=892&amp;Bill=HB309\" target=\"_blank\" rel=\"nofollow noopener\">House Bill 309<\/a> from the second special session as a model. Authored by Rep.<a href=\"https:\/\/www.texastribune.org\/directory\/briscoe-cain\/\" target=\"_blank\" rel=\"nofollow noopener\"> Briscoe Cain<\/a>, R-Deer Park, the proposal would have created a Texas Hemp Council to study and develop rules for THC products and establish hemp testing and licensing requirements.<\/p>\n<p>As part of its 149-page proposal, HB 309 also included restrictions like banning the sale of hemp products within 1,000 feet of a church or school and on Sundays, similar to restrictions on liquor. It also outlawed manufacturers from selling smokeable flower hemp, something Abbott asked the Legislature to do in his call for the second special session that ended last week. Texas banned the sale of <a href=\"https:\/\/www.texastribune.org\/2025\/09\/02\/texas-thc-vape-pen-sale-ban\/\" target=\"_blank\" rel=\"nofollow noopener\">THC vape pens<\/a> this month.<\/p>\n<p>It is unclear if these proposals would be included in the agencies\u2019 final regulations once they are issued.<\/p>\n<p>\u201cTexas will not wait when it comes to protecting children and families,\u201d Abbott said in a news release. \u201cWhile these products would still benefit from the kind of comprehensive regulation set by the Texas Legislature for substances like alcohol and tobacco, my executive order makes sure that kids are kept safe and parents have peace of mind now, and that consumers know the products they purchase are tested and labeled responsibly.\u201d<\/p>\n<p>Industry members said they are happy with the order, which aligns more with what they have advocated for \u2014 more regulations, but not an outright ban \u2014 during the monthslong fight between lawmakers to rein in a market that now has more than 8,000 retailers.<\/p>\n<p>\u201cWe want to express gratitude to Gov. Abbott for listening to his people and doing the right thing,\u201d said Jim Higdon, co-founder of Cornbread Hemp, a Kentucky-based company that sells in Texas.<\/p>\n<p>Kyle Bingham, a farmer on the South Plains and vice president of the National Hemp Growers Association, said he believes the regulations will weed out bad actors and allow for high quality, local manufacturers to flourish.<\/p>\n<p>\u201cI know there\u2019s going to be extra paperwork, there\u2019s going to be more things to do for compliance, but I think that\u2019s just part of the industry becoming more professional,\u201d Bingham said.<\/p>\n<p>Texas Agriculture Commissioner <a href=\"https:\/\/www.texastribune.org\/directory\/sid-miller\/\" target=\"_blank\" rel=\"nofollow noopener\">Sid Miller<\/a> (R) has also expressed support in a news release, calling the order \u201ccommon-sense solutions.\u201d<\/p>\n<p>The Tribune\u2019s <a href=\"https:\/\/www.texastribune.org\/theblast\/\" target=\"_blank\" rel=\"nofollow noopener\">Blast newsletter<\/a> first reported on Abbott\u2019s expected executive order, which came about a week after the Legislature <a href=\"https:\/\/www.texastribune.org\/2025\/09\/04\/texas-legislature-adjourns-special-session-sine-die\/\" target=\"_blank\" rel=\"nofollow noopener\">gaveled out<\/a> of this year\u2019s second special session, having neither banned nor further regulated consumable hemp goods in the state.<\/p>\n<p>Abbott put THC regulation on the agenda for two consecutive special sessions, but lawmakers failed to find a middle ground with the governor. Lt. Gov. <a href=\"https:\/\/www.texastribune.org\/directory\/dan-patrick\/\" target=\"_blank\" rel=\"nofollow noopener\">Dan Patrick<\/a> (R), who has called THC products a <a href=\"https:\/\/www.texastribune.org\/2025\/06\/22\/texas-thc-ban-bill-greg-abbott-veto-senate-bill-3\/\" target=\"_blank\" rel=\"nofollow noopener\">\u201cpoison in our public<\/a>,\u201d reiterated in a <a href=\"https:\/\/x.com\/ltgovtx\/status\/1963421835485229067?s=46&amp;t=ht96GmWRAfUT8sq2SWwBMA\" target=\"_blank\" rel=\"nofollow noopener\">post on X<\/a> earlier this month that he and the Texas Senate would not accept anything less than a total THC ban regardless of age. The Lubbock Republican, who authored all of the Senate\u2019s proposed THC bans this year, added that the only effective response is to prohibit \u201call synthetic cannabinoids, converted cannabinoids, and smokeables outright.\u201d<\/p>\n<p>\u201cThis debate isn\u2019t over,\u201d Perry said in <a href=\"https:\/\/x.com\/electcharles\/status\/1965526062898831574\" target=\"_blank\" rel=\"nofollow noopener\">a post on X<\/a>, \u201cand I will not stop fighting until we secure real protections for our communities and prevent Texas from repeating the mistakes of other states.\u201d<\/p>\n<p>The move to set age limits on who can purchase THC products has received significant backing from the hemp industry. Some retailers said they already check <a href=\"https:\/\/www.texastribune.org\/2025\/09\/05\/texas-thc-shops-retailers-ban-relief-age-limit\/\" target=\"_blank\" rel=\"nofollow noopener\">customers\u2019 identification<\/a> to ensure minors are not purchasing their products, though there exists no formal age restriction. Some industry leaders have even said the Legislature\u2019s failure to pass such a restriction was a missed opportunity.<\/p>\n<p>In particular, the Texas Hemp Business Council, an industry trade group, backed <a href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=892&amp;Bill=HB36\" target=\"_blank\" rel=\"nofollow noopener\">House Bill 36<\/a> during the second special session. The bill, which died in a House committee despite receiving some attention during a last-minute deal-making attempt, would have banned THC products for anyone under 21. In addition, the proposal would have created a Class C misdemeanor for buyers in most cases and a Class A misdemeanor for sellers. But some critics say the bill should have put the onus solely on sellers instead of adding more punishment for minors.<\/p>\n<p>Earlier this year, the Texas House also <a href=\"https:\/\/www.texastribune.org\/2025\/05\/01\/thc-hemp-regulations-senate-bill-3-texas-house\/\" target=\"_blank\" rel=\"nofollow noopener\">proposed<\/a> restricting THC sales to those 21 and older, similar to the regulatory approach Abbott later said he preferred. But the lower chamber later abandoned that plan and agreed with the Senate on a bill to ban THC, prompting the governor to <a href=\"https:\/\/www.texastribune.org\/2025\/06\/22\/texas-thc-ban-bill-greg-abbott-veto-senate-bill-3\/\" target=\"_blank\" rel=\"nofollow noopener\">veto it<\/a> in June.<\/p>\n<p>In his veto proclamation, Abbott said the proposed ban would go against federal law. He also called for more regulations instead.<\/p>\n<p>Cynthia Cabrera, president of the Texas Hemp Business Council, said she was happy overall with the governor\u2019s order on Wednesday and that the industry had avoided a total ban. The group had previously met with Abbott to discuss potential regulation.<\/p>\n<p>\u201cI\u2019m grateful to the governor for taking a thoughtful and reasonable approach to this,\u201d Cabrera said. \u201cThe executive order isn\u2019t everything we wanted, and maybe we will work on that.
