{"id":83205,"date":"2025-09-10T10:44:54","date_gmt":"2025-09-10T18:44:54","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/09\/10\/trump-administration-moves-to-cancel-pending-marijuana-and-hemp-rules\/"},"modified":"2025-09-10T19:57:14","modified_gmt":"2025-09-11T03:57:14","slug":"trump-administration-moves-to-cancel-pending-marijuana-and-hemp-rules","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/09\/10\/trump-administration-moves-to-cancel-pending-marijuana-and-hemp-rules\/","title":{"rendered":"Trump Administration Moves To Cancel Pending Marijuana And Hemp Rules"},"content":{"rendered":"<\/p>\n<p>The Department of Justice (DOJ) has announced it\u2019s withdrawing dozens of proposed rules\u2014including one to implement a law expanding marijuana research and another on hemp analytic testing that curiously shares the same identifier number as hearings for a cannabis rescheduling proposal that President Donald Trump said he\u2019d be deciding on imminently.<\/p>\n<p>The Justice Department said in a notice set to be published in the Federal Register on Thursday that the cancellation of the proposed rules is \u201cpart of the Federal Government\u2019s deregulatory initiative and because of ongoing assessments of agency needs, priorities, and objectives.\u201d<\/p>\n<p>But there\u2019s significant uncertainty about the impact of the cannabis-related measures that DOJ is set to withdraw.<\/p>\n<p>It\u2019s unclear, for example, how procedurally the department could back away from implementing <a href=\"https:\/\/www.marijuanamoment.net\/biden-signs-marijuana-research-bill-a-historic-first-for-federal-cannabis-reform\/\" target=\"_blank\" rel=\"nofollow noopener\">the bipartisan Medical Marijuana and Cannabidiol Research Expansion Act<\/a> that Congress passed and former President Joe Biden signed into law in late 2022.<\/p>\n<p>A description for the <a href=\"https:\/\/www.reginfo.gov\/public\/do\/eAgendaViewRule?pubId=202504&amp;RIN=1117-AB83\" target=\"_blank\" rel=\"noopener\">rule<\/a> states that, pursuant to the law, DEA intended to modify regulations \u201crelated to the new application process and submission of supporting materials by electronic means only, through the Diversion Control Division secure online portal, for those who are manufacturing marijuana or cannabidiol for medical research and those who are conducting medical marijuana and cannabidiol research.\u201d<\/p>\n<p>While some lawmakers previously <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-lawmakers-deeply-troubled-by-unacceptable-marijuana-research-barriers-that-persist-under-new-law\/\" target=\"_blank\" rel=\"nofollow noopener\">expressed disappointment with the implementation of the law<\/a>, it\u2019s unclear why DEA would back away from its proposal to facilitate the streamlined research process for cannabis.<\/p>\n<p>But another point of confusion concerns DOJ\u2019s <a href=\"https:\/\/www.federalregister.gov\/public-inspection\/2025-17526\/withdrawal-of-rulemaking-actions\" target=\"_blank\" rel=\"noopener\">proposed<\/a> withdrawal of a <a href=\"https:\/\/www.reginfo.gov\/public\/do\/eAgendaViewRule?pubId=202504&amp;RIN=1117-AB77\" target=\"_blank\" rel=\"noopener\">rule<\/a> titled \u201cAnalytical Labs and Hemp.\u201d That rule, according to the abstract, would \u201cwaive registration requirements for analytical labs that perform chemical analysis solely on hemp samples produced pursuant to an approved USDA Hemp Production plan.\u201d<\/p>\n<p>Adding to the uncertainty, the Regulation Identifier Number (RIN) for that rule has also been <a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/08\/29\/2024-19370\/schedules-of-controlled-substances-rescheduling-of-marijuana\" target=\"_blank\" rel=\"noopener\">used<\/a> for hearings on separate proposed rule to move marijuana from Schedule I to Schedule III of the Controlled Substances Act (CSA). Trump said late last month that he\u2019d be making a decision on that reform within weeks.<\/p>\n<p>A White House official told Marijuana Moment after this story was initially published that the new action \u201cshould not be interpreted as a withdrawal of the rescheduling proposal but rather a withdrawal of the Analytical Labs and Hemp [notice of proposed rulemaking] as listed.\u201d<\/p>\n<p>\u201cThe original notice of proposed rulemaking for the marijuana rescheduling notice that was published in the Federal Register does not contain a RIN and the regulations.gov docket says \u2018RIN Not Assigned,&#8217;\u201d they said, without addressing the fact that the RIN was used for the separate filing announcing the cannabis rescheduling hearings.<\/p>\n<p>Other pending rulemaking actions being cancelled by DOJ concern the pardon process, destruction of controlled substances and Bureau of Prisons policies.<\/p>\n<p>Marijuana Moment also reached out to the Justice Department and Drug Enforcement Administration (DEA) for clarification, but officials were not immediately available.<\/p>\n<p>The development adds to speculation about the fate of the rescheduling proposal, which was initiated under the Biden administration. And it comes amid increasingly vocal competing voices in the president\u2019s circle around the issue.<\/p>\n<p>For example, Ben Carson, Trump\u2019s former secretary of the Department of Housing and Urban Development (HUD), said on Monday that a <a href=\"https:\/\/www.marijuanamoment.net\/former-trump-cabinet-member-says-marijuana-rescheduling-would-help-to-destroy-this-country\/\" target=\"_blank\" rel=\"nofollow noopener\">move to reschedule marijuana would play into plots to \u201cdestroy this country.\u201d<\/a><\/p>\n<p>The Fox Business interview came about a week after the former HUD secretary published an op-ed where he\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/former-trump-cabinet-official-claims-marijuana-rescheduling-would-worsen-the-crisis-of-crime\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">also spoke out against the marijuana rescheduling proposal<\/a>.<\/p>\n<p>Meanwhile, Trump\u2019s former press secretary Sean Spicer and his long-time advisor Roger Stone recently traded diverging takes on\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/trumps-longtime-advisor-and-former-press-secretary-discuss-marijuana-rescheduling-prospects\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">the prospect of the administration moving forward on marijuana rescheduling<\/a>.<\/p>\n<p>Stone\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/trump-should-reschedule-cannabis-on-the-way-to-fully-descheduling-it-roger-stone-says-op-ed\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">separately made the case for reform in an op-ed for Marijuana Moment<\/a>\u00a0last month.<\/p>\n<p>Retired boxer Mike Tyson, meanwhile, recently spoke about the need for federal marijuana rescheduling on a podcast hosted by the wife of White House Deputy Chief of Staff for Policy Stephen Miller\u2014<a href=\"https:\/\/www.marijuanamoment.net\/mike-tyson-expects-good-news-on-marijuana-rescheduling-he-says-on-podcast-hosted-by-top-trump-officials-wife\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">saying he\u2019s expecting \u201cgood news\u201d on the issue soon<\/a>.<\/p>\n<p>In June, the retired boxer also took to Fox News and delivered a message to the president,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/mike-tyson-tells-trump-to-reschedule-marijuana-and-free-prisoners-in-fox-news-appearance\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">urging him to reschedule, and ultimately legalize, marijuana<\/a>.<\/p>\n<p>That interview came days after Tyson led a letter alongside\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/mike-tyson-and-other-celebs-push-trump-to-go-further-on-marijuana-than-biden-by-expanding-clemency-and-enacting-rescheduling\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">other professional athletes and celebrities promoting cannabis reform<\/a>\u00a0that was sent to Trump, calling for rescheduling marijuana, expanding clemency and allowing licensed cannabis businesses to access the banking system.<\/p>\n<p>Meanwhile, Trump\u2019s former senior advisor\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/former-trump-advisor-kellyanne-conway-is-the-biggest-champion-of-marijuana-rescheduling-in-presidents-inner-circle-gop-congressman-says\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">Kellyanne Conway has been the \u201cbiggest champion\u201d of marijuana rescheduling<\/a>\u00a0within the president\u2019s \u201cinner circle,\u201d a GOP congressman recently told Marijuana Moment.<\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"xks7M4WKKR\">\n<p><a
