If organizers collect enough valid signatures from registered voters, it could appear on the 2026 ballot.<\/p>\n<p>The one-sentence measure simply reads,\u00a0 \u201cAll persons twenty-one years of age or older have the right to use all plants in the genus Cannabis.\u201d<\/p>\n<p>The measure, filed by Bill Hawkins of the Nebraska Hemp Company, comes as state regulators are charged with implementing <a href=\"https:\/\/www.marijuanamoment.net\/nebraska-voters-approve-medical-marijuana-legalization-at-the-ballot-amid-legal-challenges\/\" target=\"_blank\" rel=\"nofollow noopener\">medical cannabis initiatives approved by voters in 2024<\/a>.<\/p>\n<p>Advocates have been critical of <a href=\"https:\/\/www.marijuanamoment.net\/nebraska-governor-approves-medical-marijuana-rules-banning-flower-access-for-patients\/\" target=\"_blank\" rel=\"nofollow noopener\">rules implemented so far by the Nebraska Medical Cannabis Commission<\/a>, however. For example, the regulations ban medical marijuana flower and products that can be smoked or vaped, as well as edibles or other products containing flavoring.<\/p>\n<p>The new proposed 2026 <a href=\"https:\/\/sos.nebraska.gov\/current-petitions-circulation\" target=\"_blank\" rel=\"noopener\">initiative<\/a> to create a broad right to use cannabis is the fifth proposal seeking to effectively legalize recreational marijuana since 2018, <a href=\"https:\/\/news.ballotpedia.org\/2025\/08\/29\/proponents-file-recreational-marijuana-initiative-in-nebraska-for-2026-ballot-the-fifth-initiative-attempt-since-2018\/\" target=\"_blank\" rel=\"noopener\">according<\/a> to Ballotpedia, which first reported its filing. None of those prior measures, which were also sponsored by Hawkins, have obtained enough valid signatures to appear on the ballot.<\/p>\n<p>In order to go before voters next year, the current initiative will need to collect signatures from 10 percent of registered voters. Organizers will also need to obtain signatures from\u00a05 percent of the registered voters in each of two-fifths of the state\u2019s 93 counties.<\/p>\n<p>The marijuana reform push also comes as the state attorney general is <a href=\"https:\/\/www.marijuanamoment.net\/nebraska-attorney-general-expands-intoxicating-hemp-and-delta-8-crackdown\/\" target=\"_blank\" rel=\"nofollow noopener\">cracking down on sales of intoxicating hemp-derived products<\/a>, including those containing delta-8 THC.<\/p>\n<p>Las year\u2019s approval of two medical marijuana ballot measures came after an earlier attempt in 2020 gathered enough signatures for ballot placement, but saw the <a href=\"https:\/\/www.marijuanamoment.net\/nebraska-supreme-court-hears-case-challenging-medical-marijuana-ballot-initiative\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">measure invalidated by the state Supreme Court<\/a>\u00a0following a single-subject challenge.
