{"id":82493,"date":"2025-07-30T06:45:52","date_gmt":"2025-07-30T14:45:52","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/07\/30\/delaware-recreational-marijuana-sales-start-friday-as-medical-cannabis-operators-open-stores-to-adults-21-and-older\/"},"modified":"2025-07-30T19:49:35","modified_gmt":"2025-07-31T03:49:35","slug":"delaware-recreational-marijuana-sales-start-friday-as-medical-cannabis-operators-open-stores-to-adults-21-and-older","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/07\/30\/delaware-recreational-marijuana-sales-start-friday-as-medical-cannabis-operators-open-stores-to-adults-21-and-older\/","title":{"rendered":"Delaware Recreational Marijuana Sales Start Friday As Medical Cannabis Operators Open Stores To Adults 21 And Older"},"content":{"rendered":"<\/p>\n<p>Sales of cannabis to adults will kick off in Delaware on Friday following the state\u2019s <a href=\"https:\/\/www.marijuanamoment.net\/delaware-governor-will-allow-marijuana-legalization-and-sales-bills-to-become-law\/\" target=\"_blank\" rel=\"nofollow noopener\">enactment of a legalization law in 2023<\/a>, with <a href=\"https:\/\/www.marijuanamoment.net\/heres-where-to-buy-legal-recreational-marijuana-in-delaware-next-month\/\" target=\"_blank\" rel=\"nofollow noopener\">a number of stores operated by existing medical marijuana operators<\/a> expected to be open for business to people 21 and older.<\/p>\n<p>The launch of the legal market comes amid some controversy, however, with <a href=\"https:\/\/www.marijuanamoment.net\/critics-say-delawares-retail-marijuana-sales-launch-is-unfair-prioritizing-existing-medical-operators\/\" target=\"_blank\" rel=\"nofollow noopener\">critics alleging that allowing medical operators to start adult-use sales ahead of other license applicants is unfair<\/a>. There\u2019s also <a href=\"https:\/\/www.marijuanamoment.net\/delaware-governor-weighs-competing-priorities-as-marijuana-zoning-bill-sits-on-his-desk\/\" target=\"_blank\" rel=\"nofollow noopener\">ongoing tension between state and local officials over who will ultimately control zoning rules for the new industry<\/a>\u2014a dispute that could have major implications for the rollout of future stores.<\/p>\n<p>Dozens of other would-be retailers that have either already received licenses or are still awaiting issuance will need to wait for further regulatory approvals until they can open their doors\u2014a situation that\u2019s frustrated some advocates.<\/p>\n<p data-autoattached=\"true\">\u201cThe state had more than enough time to set up this program,\u201d Morgan Fox, political director for the group NORML, <a href=\"https:\/\/www.marijuanamoment.net\/critics-say-delawares-retail-marijuana-sales-launch-is-unfair-prioritizing-existing-medical-operators\/\" target=\"_blank\" rel=\"nofollow noopener\">told the local news outlet Spotlight Delaware last month<\/a>.<\/p>\n<p data-autoattached=\"true\">Eventually 30 stores are planned across the state,\u00a0including 14 in New Castle County, 10 in Sussex County and six in Kent County.<\/p>\n<p data-autoattached=\"true\">As for zoning restrictions for the stores, Gov. Matt Meyer (D) said earlier this month that there\u2019s a tension between two competing priorities when it comes to a marijuana-related zoning proposal, SB 75, that\u2019s currently awaiting action on his desk.<\/p>\n<div class=\"embed-twitter\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Recreational marijuana sales in Delaware begin THIS Friday, August 1. On the other, as a former county executive, he said it\u2019s important municipal governments retain control over local land use decisions.<\/p>\n<p>\u201cWe\u2019re talking to stakeholders to evaluate,\u201d he told Delaware Public Media (DPM). \u201cI\u2019ve been very clear as someone who led the largest local government in Delaware for eight years that we believe strongly in local control, local government control.\u201d<\/p>\n<p>Meyer could sign the bill into law, veto it or allow it to become law without his signature. Notably in 2023, then-Gov. John Carney (D)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/delaware-governor-will-allow-marijuana-legalization-and-sales-bills-to-become-law\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">let HB 1 and HB 2\u2014which legalized and regulated adult-use cannabis in Delaware\u2014to become law without his signature<\/a>.<\/p>\n<p>Asked by DPM whether he might take a similar approach with SB 75, Carney replied: \u201cIt\u2019s always an option.\u201d<\/p>\n<p>The bill is sponsored by Sen. Trey Paradee (D), who also backed the state\u2019s legalization legislation. If it becomes law, the measure would set state zoning standards for cannabis facilities, overriding rules set by Delaware\u2019s three counties. Proponents say the change is necessary to prevent local bans from limiting consumer access to legal marijuana.<\/p>\n<p>The governor was asked during a radio appearance this month why the rollout of the state\u2019s legal market has taken so long\u2014and also why the state allowed existing medical providers to go \u201cup in the front of the line\u201d and start sales before new adult-use licensees.<\/p>\n<p>Meyer replied that either the state could \u201cdelay further\u201d the market opening or \u201cmove forward with medical marijuana retailers who are readily able to open, to turn the lights on.\u201d<\/p>\n<p>Two lawmakers who led the push to legalize marijuana are separately seeking input from consumers and businesses about the market launch. Paradee, the sponsor of SB 75, and House Majority Whip Rep. Ed Osienski (D)\u2014the primary sponsor of the state\u2019s 2023 legalization bills\u2014<a href=\"https:\/\/www.marijuanamoment.net\/delaware-lawmakers-seek-marijuana-consumer-and-business-input-ahead-of-states-legal-sales-launch-next-month\/\" target=\"_blank\" rel=\"nofollow noopener\">put out a new online form this month for residents to share thoughts and feedback about the cannabis program anonymously<\/a>.<\/p>\n<p>The idea is to identify any hiccups that lawmakers might need to address when they return for next year\u2019s legislative session.<\/p>\n<p>The state\u2019s Office of the Marijuana Commissioner (OCM) initially projected that recreational sales would start by March, but complications related to securing an FBI fingerprint background check service code delayed the implementation. Lawmakers passed a bill in April to resolve the issue, and the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/fbi-grants-delaware-marijuana-officials-a-fingerprint-service-code-allowing-launch-of-legal-market-to-proceed\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">FBI subsequently issued the code that the stat\u2019s marijuana law requires<\/a>.<\/p>\n<p>Late last year, OMC held a series of\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/delaware-officials-will-hold-first-marijuana-license-lottery-this-week-ahead-of-adult-use-market-launch\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">licensing lotteries for cannabis business<\/a>\u00a0to start serving adult consumers.<\/p>\n<p>A total of 125 licenses will ultimately be issued, including 30 retailers, 60 cultivators, 30 manufacturers and five testing labs. Last year, regulators also detailed what portion of each category is reserved for social equity applicants, microbusinesses and general open licenses.<\/p>\n<p>Regulators have also been\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/delaware-officials-release-third-round-of-draft-rules-for-marijuana-testing-disposal-and-more-as-state-works-to-launch-legal-market\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">rolling out a series of proposed regulations to stand up the forthcoming adult-use cannabis industry<\/a>.<\/p>\n<p>Meanwhile, Carney raised eyebrows in January after making a questionable claim that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/delaware-governor-who-allowed-marijuana-legalization-to-become-law-claims-nobody-wants-dispensaries-in-their-communities\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">\u201cnobody\u201d wants cannabis shops in their neighborhoods<\/a>, even if there\u2019s consensus that criminalization doesn\u2019t work.<\/p>\n<p>The then-governor\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/delaware-governor-signs-marijuana-bills-including-one-to-let-medical-dispensaries-begin-recreational-sales-early\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">last year signed several additional marijuana bills into law<\/a>, including measures that would allow existing medical cannabis businesses in the state to begin recreational sales on an expedited basis, transfer regulatory authority for the medical program and make technical changes to marijuana statutes.<\/p>\n<p>The dual licensing legislation is meant to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/delaware-bill-to-let-medical-marijuana-dispensaries-begin-recreational-sales-early-heads-to-governors-desk\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">allow recreational sales to begin months earlier than planned<\/a>, though critics say the legislation would give an unfair market advantage to larger, more dominant businesses already operating in multiple states.<\/p>\n<p>In October, Carney also gave final approval to legislation to enact state-level protections for\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/delaware-governor-signs-bill-to-protect-banks-that-work-with-marijuana-businesses-ahead-of-adult-use-market-launch\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">banks that provide services to licensed marijuana businesses<\/a>.<\/p>\n<p>Delaware\u2019s\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/delaware-medical-marijuana-expansion-takes-effect-as-state-prepares-for-adult-use-market-launch\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">medical marijuana program is also being significantly expanded<\/a>\u00a0under a law that officially took effect last July.<\/p>\n<p>The policy change removes limitations for patient eligibility based on a specific set of qualifying health conditions.
