Ron DeSantis (R) this week.<\/p>\n<p>DeSantis on Monday signed SB 2514, a broad budget bill that touches on cancer, dentistry and other health-related matters. But it also contains a provision that directs the state Department of Health (DOH) to cancel registrations of medical marijuana patients and caregivers if they\u2019re convicted of\u2014or plead guilty or no contest to\u2014criminal drug charges.<\/p>\n<p>The measure says a patient or caregiver would have their registration immediately suspended upon being charged with a state drug crime, and the suspension would remain in place until the criminal case reaches a final disposition.<\/p>\n<p>DOH officials would have authority to reinstate the registration, revoke it entirely or extend the suspension if needed.<\/p>\n<p>Authorities would be required to revoke a person\u2019s registration if the patient or caregiver \u201cwas convicted of, or pled guilty or nolo contendre to, regardless of adjudication, a violation [of state drug law] if such violation was for trafficking in, the sale, manufacture, or delivery of, or possession with intent to sell, manufacture, or deliver a controlled substance.\u201d<\/p>\n<p>The enacted version of the legislation focuses specifically on production and distribution. It does not contain an earlier restriction from prior versions that would have also revoked registrations for people who merely purchased illegal drugs, including more than 10 grams of marijuana for their own use.<\/p>\n<p>It also clarifies that patients and caregivers would have a process to request their registrations be reinstated. That would involve submitting a new application \u201caccompanied by a notarized attestation by the applicant that he or she has completed all the terms of incarceration, probation, community control, or supervision related to the offense.\u201d<\/p>\n<p>It\u2019s not clear from the plain language of the revised\u00a0<a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2025\/2514\" target=\"_blank\" rel=\"noopener\">bill<\/a>\u00a0whether it would impact only future criminal cases involving medical marijuana patients and caregivers or whether DOH would need to review the records of existing program registrants and revoke registrations of an untold number of Floridians with past drug convictions.<\/p>\n<p>Notably, lawmakers\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-lawmakers-kill-medical-marijuana-expansion-bills-including-one-to-let-military-veterans-register-for-free\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">defeated several proposals to expand the medical cannabis program<\/a>\u00a0during this year\u2019s regular legislation session\u2014including by allowing home cultivation, adding new qualifying conditions, protecting employment and parental rights of patients and letting military veterans register for free.<\/p>\n<p>Separately in Florida, advocates are working toward putting a new adult-use marijuana legalization measure on the 2026 state ballot following\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-voters-reject-marijuana-legalization-ballot-measure-endorsed-by-trump-and-opposed-by-desantis\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">the failure of Amendment 3 at the polls last November<\/a>.<\/p>\n<p>After filing the measure and launching a signature drive earlier this year, the campaign Smart &amp; Safe Florida\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-marijuana-activists-collect-enough-signatures-on-2026-legalization-ballot-measure-to-trigger-fiscal-and-judicial-review\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">has collected 377,832 valid signatures\u2014about 150,000 more than required to kick off the review process<\/a>, according to Division of Elections numbers from last month.<\/p>\n<p><strong>\u2014<br \/>\nMarijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking hundreds of cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2025\/07\/MM_Bill_Tracker_V5_blank-4.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/p>\n<p>The state is now statutorily obligated to conduct a judicial and financial review of the measure that will determine its legal eligibility and inform the electorate about its potential economic impact.<\/p>\n<p>Smart &amp; Safe Florida is hoping the revised version will succeed in 2026. The campaign\u2014which in the last election cycle received tens of millions of dollars from cannabis industry stakeholders, principally the multi-state operator Trulieve\u2014incorporated certain changes into the new version that seem responsive to criticism opponents raised during the 2024 push.<\/p>\n<p>For example, it now specifically states that the \u201csmoking and vaping of marijuana in any public place is prohibited.\u201dAnother section asserts that the legislature would need to approve rules dealing with the \u201cregulation of the time, place, and manner of the public consumption of marijuana.\u201d<\/p>\n<p>Gov. DeSantis had repeatedly condemned the 2024 initiative over that issue, claiming there were not parameters to prevent public smoking, while expressing his distaste for the smell of cannabis.<\/p>\n<p>The governor said in February that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-florida-marijuana-initiative-faces-big-time-trouble-in-supreme-court-desantis-says-predicting-itll-be-blocked-from-2026-ballot\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">the newest measure is in \u201cbig time trouble\u201d with the state Supreme Court<\/a>, predicting it will be blocked from going before voters next year.<\/p>\n<p>Last year, the governor accurately predicted that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/desantis-says-marijuana-legalization-will-be-on-florida-ballot-following-court-review\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">the 2024 cannabis measure from the campaign would survive a legal challenge<\/a>\u00a0from the state attorney general. It\u2019s not entirely clear why he feels this version would face a different outcome.<\/p>\n<p>While there\u2019s uncertainty around how the state\u2019s highest court will navigate the measure, a poll released in February\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-florida-voters-overwhelmingly-back-marijuana-legalization-as-campaign-pushes-2026-reform-measure-poll-finds\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">showed overwhelming bipartisan voter support for the reform<\/a>\u2014with 67 percent of Florida voters backing legalization, including 82 percent of Democrats, 66 percent of independents and 55 percent of Republicans.<\/p>\n<p>However, the results conflict with another recent poll from the Florida Chamber of Commerce, a proactive opponent of legalization, that found majority support for the reform among likely voter (53 percent)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-legalization-has-majority-support-in-florida-but-not-enough-to-be-enacted-new-poll-from-opposition-group-finds\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">but not enough to be enacted under the 60 percent requirement<\/a>.<\/p>\n<p>In the background of the campaign\u2019s signature development, DeSantis signed a GOP-led bill to <a href=\"https:\/\/www.marijuanamoment.net\/florida-lawmakers-approve-bill-making-it-harder-to-put-initiatives-on-ballot-as-marijuana-legalization-campaign-pursues-2026-effort\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">impose significant restrictions on the ability to put initiatives on the ballot<\/a>\u2014a plan that could impair efforts to let voters decide on marijuana legalization next year.<\/p>\n<p>Separately, a\u00a0Florida GOP senator claimed recently that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/trump-was-tricked-into-endorsing-florida-marijuana-legalization-initiative-gop-senator-says\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">the legalization campaign \u201ctricked\u201d Trump into supporting the 2024 measure<\/a>\u00a0by misleading him and the general public about key provisions.<\/p>\n<p>Ahead of the election, Trump said in September that he felt\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/trump-says-florida-marijuana-legalization-ballot-measure-will-be-very-good-for-the-state-adding-that-medical-use-is-absolutely-amazing-for-patients\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">Amendment 3 was \u201cgoing to be very good\u201d for the state<\/a>.<\/p>\n<p>Before making the comments,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/trump-met-with-top-marijuana-company-ceo-and-florida-gop-senator-before-supporting-legalization-measure\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">Trump met with the CEO of Trulieve, Kim Rivers<\/a>, as well as with a GOP state senator who is in favor of the reform.<\/p>\n<p>While Trump endorsed the Florida cannabis initiative\u2014as well as federal rescheduling and industry banking access\u2014he has since been silent on cannabis issues.
