{"id":81642,"date":"2025-06-11T03:39:54","date_gmt":"2025-06-11T11:39:54","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/06\/11\/mississippi-indian-tribe-approves-marijuana-referendum-making-it-first-jurisdiction-in-the-state-poised-to-legalize\/"},"modified":"2025-06-11T19:49:09","modified_gmt":"2025-06-12T03:49:09","slug":"mississippi-indian-tribe-approves-marijuana-referendum-making-it-first-jurisdiction-in-the-state-poised-to-legalize","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/06\/11\/mississippi-indian-tribe-approves-marijuana-referendum-making-it-first-jurisdiction-in-the-state-poised-to-legalize\/","title":{"rendered":"Mississippi Indian Tribe Approves Marijuana Referendum, Making It First Jurisdiction In The State Poised To Legalize"},"content":{"rendered":"<\/p>\n<p>Members of an Indian tribe in Mississippi have approved <a href=\"https:\/\/www.marijuanamoment.net\/mississippi-indian-tribe-schedules-hearings-ahead-of-vote-to-legalize-marijuana-within-its-territory-next-month\/\" target=\"_blank\" rel=\"nofollow noopener\">a referendum to legalize marijuana within its territory<\/a>.<\/p>\n<p>About a month after holding a series of public hearings on the proposal, the Mississippi Band of Choctaw Indians voted to enact the cannabis reform, 55 percent to 45 percent, according to unofficial results posted by the tribe on Tuesday evening.<\/p>\n<p>The question that tribal members saw on the ballots read: \u201cDo you support the Tribe developing legislation to decriminalize and regulate the possession, production, and distribution of marijuana on Tribal lands?\u201d With its approval, this makes the tribe the only source of legal adult-use cannabis in Mississippi.<\/p>\n<p>\u201cThis vote does not automatically authorize or legalize marijuana on Choctaw tribal trust land,\u201d Chief Cyrus Ben said at one of the hearings, <a href=\"https:\/\/www.mississippifreepress.org\/mississippi-choctaws-to-vote-on-decriminalizing-marijuana-on-tuesday\/\" target=\"_blank\" rel=\"noopener\">according<\/a> to The Mississippi Free Press.<\/p>\n<p>But now that the measure has been approved, the\u00a0Tribal Council is poised to engage consultants to conduct a feasibility study of legalization, along with research on potential regulations.<\/p>\n<p>This is one of the latest examples of increased interest among certain Native American communities to enact reform within their borders\u2014despite federal prohibition and, in cases like Mississippi, state law.<\/p>\n<p>More than a fourth of Indigenous communities in the continental United States are now <a href=\"https:\/\/www.marijuanamoment.net\/one-out-of-four-indian-tribes-in-the-u-s-is-now-involved-in-marijuana-or-hemp-programs-new-map-shows\/\" target=\"_blank\" rel=\"nofollow noopener\">involved with marijuana or hemp programs<\/a>, according to a map recently published by the Indigenous Cannabis Industry Association (ICIA) in collaboration with the law firm Vicente.<\/p>\n<div class=\"fb-post\" data-href=\"https:\/\/www.facebook.com\/MSBandofChoctawIndians\/posts\/pfbid0d3K7nozATjaTwXJkXvEoDQ94HZMh6RmCRNitAc3Fj9WL6WrxLJLTqqaj7aZTKSp2l\" data-width=\"552\" style=\"background-color: #fff\" \/>\n<p>In North Carolina, where cannabis remains illegal for medical and adult-use purposes, the Eastern Band of Cherokee Indians\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/indian-tribe-begins-first-recreational-marijuana-sales-to-adults-in-north-carolina-where-cannabis-remains-illegal\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">approved a legalization referendum in 2023, and sales began last year<\/a>.<\/p>\n<p>It\u2019s drawn attention from congressional lawmakers, including Sen. Thom Tillis (R-NC), who last month <a href=\"https:\/\/www.marijuanamoment.net\/trumps-pick-to-lead-dea-says-marijuana-rescheduling-review-will-be-one-of-my-first-priorities-in-the-job\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">asked President Donald Trump\u2019s pick to lead the Drug Enforcement Administration (DEA)<\/a>\u00a0to investigate the legal implications of the policy.<\/p>\n<p>In Montana, meanwhile, marijuana was legalized statewide through a ballot initiative in 2020, and the legislature recently passed a bill that would allow the governor to enter into compacts with Indian tribes to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/montana-lawmakers-pass-bill-allowing-cannabis-compacts-between-indian-tribes-and-the-governor\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">remove barriers to their participation in the industry<\/a>.<\/p>\n<p>A similar compact agreement system has been in place in Minnesota, where cannabis is also legal for adult use. Last month, Gov.
