{"id":81493,"date":"2025-06-04T11:15:28","date_gmt":"2025-06-04T19:15:28","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/06\/04\/gop-congressional-committee-proposes-ban-on-hemp-products-with-thc-that-advocates-say-would-have-devastating-impact-on-industry\/"},"modified":"2025-06-04T19:47:12","modified_gmt":"2025-06-05T03:47:12","slug":"gop-congressional-committee-proposes-ban-on-hemp-products-with-thc-that-advocates-say-would-have-devastating-impact-on-industry","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/06\/04\/gop-congressional-committee-proposes-ban-on-hemp-products-with-thc-that-advocates-say-would-have-devastating-impact-on-industry\/","title":{"rendered":"GOP Congressional Committee Proposes Ban On Hemp Products With THC That Advocates Say Would Have \u2018Devastating\u2019 Impact On Industry"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2025\/06\/MM_Bill_Tracker_V5_blank-1.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>A GOP-led House committee has unveiled a spending bill that contains provisions that hemp stakeholders say would devastate the industry, prohibiting most consumable cannabinoid products that were federally legalized during the first Trump administration.<\/p>\n<p>The House Appropriations Subcommittee on Agriculture, Rural Development, Food and Drug Administration, and Related Agencies published the text of the legislation covering fiscal year 2026 just one day ahead of a scheduled Thursday markup.<\/p>\n<p>The 138-page bill covers a wide range of issues, but for the hemp industry, there\u2019s a section of particular concern that would redefine hemp under federal statute in a way that would prohibit cannabis products containing any \u201cquantifiable\u201d amount of THC or \u201cany other cannabinoids that have similar effects (or are marketed to have similar effects) on humans or animals\u201d as THC.<\/p>\n<p>That would effectively eliminate the most commonly marketed hemp products within the industry, as even non-intoxicating CBD items that are sold across the country typically contain trace amounts of THC. Under current law, those products are allowed if they contain no more than 0.3 percent THC by dry weight.<\/p>\n<p>But the proposed policy being taken up by the subcommittee helmed by anti-marijuana Rep. Andy Harris (R-MD) would drastically change that. It would instead maintain the legal status of \u201cindustrial hemp\u201d under a revised definition that allows for the cultivation and sale of hemp grown for fiber, whole grain, oil, cake, nut, hull, microgreens or \u201cother edible hemp leaf products intended for human consumption.\u201d<\/p>\n<p>A press release from Harris\u2019s committee <a href=\"https:\/\/appropriations.house.gov\/news\/press-releases\/committee-releases-fy26-agriculture-rural-development-fda-bill\" target=\"_blank\" rel=\"noopener\">says<\/a> the legislation \u201csupports the Trump Administration and mandate of the American people by\u2026closing the hemp loophole that has resulted in the proliferation of unregulated intoxicating hemp products, including Delta-8 and hemp flower, being sold online and in gas stations across the country.\u201d<\/p>\n<p>The prohibitionist organization Smart Approaches to Marijuana cheered the move.<\/p>\n<p>\u201cThis is a huge win for families, kids, and public health,\u201d the group said in a social media post.<\/p>\n<div class=\"embed-twitter\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">A Delta-8 THC ban is officially included in the base text of a must-pass Appropriations bill.<\/p>\n<p>House Appropriators say the ban \u201csupports the mandate of the American people.\u201d<\/p>\n<p>This is a huge win for families, kids, and public health. <a href=\"https:\/\/t.co\/KdLsLsLeqg\" target=\"_blank\" rel=\"nofollow noopener\">https:\/\/t.co\/KdLsLsLeqg<\/a> <a href=\"https:\/\/twitter.com\/hashtag\/Delta8?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#Delta8<\/a> <a href=\"https:\/\/twitter.com\/hashtag\/Congress?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">#Congress<\/a>\u2026<\/p>\n<p>\u2014 SAM (@learnaboutsam) <a href=\"https:\/\/twitter.com\/learnaboutsam\/status\/1930330169530626457?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">June 4, 2025<\/a><\/p>\n<\/blockquote>\n<p \/><\/div>\n<p>The hemp <a href=\"https:\/\/docs.house.gov\/Committee\/Calendar\/ByEvent.aspx?EventID=118353\" target=\"_blank\" rel=\"noopener\">language<\/a> is largely consistent with appropriations and agriculture legislation that was introduced, but not ultimately enacted, under the last Congress.<\/p>\n<p>Hemp industry stakeholders rallied against that proposal, which was also included in the base bill from the subcommittee last year. It\u2019s <a href=\"https:\/\/www.marijuanamoment.net\/house-committee-approves-farm-bill-amendment-to-ban-most-hemp-derived-cannabinoid-products-like-delta-8-thc\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">virtually identical to a provision of the 2024 Farm Bill that was attached by a separate committee<\/a> last May via an amendment from Rep. James Comer (R-KY) also inquired about FDA inaction around regulations, sarcastically asking if it\u2019d require \u201ca gazillion bureaucrats that work from home\u201d to regulate cannabinoids such as CBD.<\/p>\n<p>The consumable hemp product crackdown isn\u2019t exclusive to the federal government, as multiple states\u2014from\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/cheech-and-chongs-company-sues-to-overturn-new-california-hemp-product-ban-that-took-effect-this-week\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">California<\/a>\u00a0to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-bill-to-restrict-hemp-products-like-delta-8-thc-heads-to-the-senate-floor\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">Florida<\/a>\u2014have moved to ban intoxicating cannabinoids in recent months.<\/p>\n<p>In Texas, the legislature recently delivered a bill to the governor that would <a href=\"https:\/\/www.marijuanamoment.net\/texas-governor-refuses-to-say-whether-hell-sign-or-veto-hemp-ban-bill-amid-intense-pushback\/\" target=\"_blank\" rel=\"nofollow noopener\">outlaw all consumable hemp-derived cannabinoid products<\/a> containing any detectable THC. Gov.
