Ron DeSantis (R) has signaled that he intends to sign a wide-ranging agriculture bill passed by the legislature that contains, among other provisions, a <a href=\"https:\/\/www.marijuanamoment.net\/florida-legislature-passes-bill-to-outlaw-psychedelic-mushroom-spores-sending-it-to-desantiss-desk\/\" target=\"_blank\" rel=\"nofollow noopener\">new prohibition on the spores of psychedelic mushrooms<\/a>.<\/p>\n<p>In comments on Tuesday, DeSantis announced his support for the measure, SB 700, sponsored by Sen. Keith Truenow (R). The bill is currently on its way to the governor\u2019s desk after being passed by the House of Representatives last week. It was <a href=\"https:\/\/www.marijuanamoment.net\/florida-senate-passes-bill-to-ban-psychedelic-mushroom-spores-as-companion-measure-also-advances-in-house\/\" target=\"_blank\" rel=\"nofollow noopener\">previously passed by the Senate on a 27\u20139 vote<\/a>.<\/p>\n<p>DeSantis\u2019s statement didn\u2019t address the legislation\u2019s psychedelic mushroom spore ban or most other provisions of the roughly 150-page bill. Instead he zeroed in on a part of the bill that would ban local governments from adding fluoride to public drinking water\u2014an issue that dominated debate as the proposal made its way through the legislature.<\/p>\n<p>\u201cThe Free State of Florida means freedom from governments or private actors unilaterally applying chemicals or geoengineering to people or public spaces,\u201d he said in a <a href=\"https:\/\/www.flgov.com\/eog\/news\/press\/2025\/governor-ron-desantis-celebrates-action-protect-floridians-chemical-and\" target=\"_blank\" rel=\"noopener\">release<\/a>.<\/p>\n<p>With respect to psychedelic mushrooms, the bill would outlaw transporting, importing, selling or giving away \u201cspores or mycelium capable of producing mushrooms or other material which will contain a controlled substance, including psilocybin or psilocyn, during its lifecycle.\u201d<\/p>\n<p>Violating the proposed law would be a first-degree misdemeanor, carrying a maximum one year in jail and $1,000 fine.<\/p>\n<p>SB 700 would also make a variety of adjustments around Florida\u2019s agricultural lands, utilities and wildlife management.<\/p>\n<p>Psilocybin and psilocin are the two main psychoactive compounds in psychedelic mushrooms. Although spores themselves typically do not contain psilocybin or psilocin, they eventually produce fruiting bodies\u2014mushrooms\u2014that do contain the psychedelic compounds.<\/p>\n<p>Because the spores don\u2019t contain any controlled substances, the federal government deems them legal.<\/p>\n<p><a href=\"https:\/\/www.marijuanamoment.net\/dea-confirms-that-psychedelic-mushroom-spores-are-federally-legal-prior-to-germination\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">\u201cIf the mushroom spores (or any other material) do not contain psilocybin or psilocin (or any other controlled substance or listed chemical), the material is considered not controlled,\u201d<\/a>\u00a0Terrence Boos, the Drug Enforcement Administration\u2019s (DEA) Drug and Chemical Evaluation Section chief, said in a memo last year. (Using a similar rationale, Boos has said that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/dea-says-marijuana-seeds-are-considered-legal-hemp-as-long-as-they-dont-exceed-thc-limit\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">marijuana seeds are considered federally legal hemp because they themselves don\u2019t contain THC<\/a>.)<\/p>\n<p>In Florida, a legislative report for\u00a0<a href=\"https:\/\/flhouse.gov\/Sections\/Bills\/billsdetail.aspx?BillId=81263\" target=\"_blank\" rel=\"noopener\">HB 651<\/a>\u2014a House companion bill to the measure now heading to DeSantis\u2014similarly notes that \u201cspores do not contain any psilocybin properties themselves and therefore could be considered legal under current law.\u201d<\/p>\n<p>To prevent that, the proposal would clarify as illegal any spores or mycelium that could produce psilocybin or psilocin at any time in their development.<\/p>\n<p>As for psilocybin and psilocin themselves, the substances are already illegal in Florida. Simple possession is a third-degree felony, carrying up to five years in prison and a $5,000 fine.<\/p>\n<p>A legislative report for\u00a0<a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2025\/700\" target=\"_blank\" rel=\"noopener\">SB 700<\/a>\u00a0notes that psychedelic mushrooms \u201cbecame popular in the United States during the 1960s when American researchers first studied their healing properties and medical applications. Now, they are listed as a Schedule I controlled substance by the U.S. government, meaning they have no accepted medical use.\u201d<\/p>\n<p>It further says that \u201cany material, compound, mixture, or preparation that contains the hallucinogenic substance known as Psilocybin has high potential for abuse and is not currently accepted as medical treatment in the United States.\u201d<\/p>\n<p>Late last week, meanwhile, DeSantis signed a separate bill into law will <a href=\"https:\/\/www.marijuanamoment.net\/with-florida-marijuana-legalization-measure-circulating-desantis-signs-bill-making-it-harder-to-qualify-ballot-initiatives\/\" target=\"_blank\" rel=\"nofollow noopener\">create new hurdles for advocates aiming to put legislative proposals before voters<\/a>\u2014including, potentially, the\u00a0renewed effort to legalize marijuana in the state.<\/p>\n<p>Among other requirements, the law mandates that supporters post a $1 million bond before commencing signature gathering, prohibits the use of out-of-state and noncitizen petitioners and narrows the window during which which signatures must be submitted to election officials.<\/p>\n<p>Its sponsor, Rep. Jenna Persons-Mulicka (R), contends the ballot initiative process \u201chas been taken over by out of state fraudsters looking to make a quick buck and by special interests intent on buying their way into our Constitution.\u201d<\/p>\n<p>Critics have said the new changes will impede Floridians\u2019 ability to have their voices heard. One group, hoping to qualify a measure that would expand Medicaid in the state, has already sued the DeSantis administration over the new law.<\/p>\n<p>The new obstacles to placing a proposal on the statewide ballot come on the heels of two contentious constitutional amendments that went before voters last year, including one\u2014Amendment 3\u2014that would have legalized marijuana for adults 21 and older, and another on abortion rights.<\/p>\n<p>The campaign for the marijuana measure, Smart &amp; Safe Florida, took in more than $150 million in campaign funds\u2014with most from large cannabis companies such as Trulieve, a multi-state operator that contributed tens of millions of dollars.<\/p>\n<p>It also clashed with DeSantis as well as the state Republican Party, the latter of which Smart &amp; Safe Florida later sued for allegedly deceiving voters about the measure.<\/p>\n<p>After Amendment 3 last year\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-voters-reject-marijuana-legalization-ballot-measure-endorsed-by-trump-and-opposed-by-desantis\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">failed to win the 60 percent voter support needed to pass a constitutional amendment<\/a>, Smart &amp; Safe Florida is\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-campaign-files-new-marijuana-legalization-initiative-for-2026-ballot-after-reform-failed-in-last-election\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">now aiming to put a revised legalization proposal on the 2026 state ballot<\/a>.<\/p>\n<p>Under the new\u00a0law, signatures collected before enactment would not be subjected to the revised restrictions.
