Charles Perry (R) is responsive to those local reforms, and it passed the chamber on Wednesday in a 23-8 vote. It now heads to the House of Representatives.<\/p>\n<p>Under the proposal, state law would be amended to say that local entities \u201cmay not place an item on a ballot, including a municipal charter or charter amendment, that would provide that the local entity will not fully enforce\u201d state drug laws.<\/p>\n<p>The latest version of the <a href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=89R&amp;Bill=SB1870\" target=\"_blank\" rel=\"noopener\">legislation<\/a> as amended in the Senate Criminal Justice Committee would also specifically bar localities from putting initiatives on the ballot that would contravene the state\u2019s consumable hemp laws.<\/p>\n<p>It would also require the attorney general to create a form for people to report violations of the law. And it\u2019d expedite legal proceedings to challenge any city, mandating that an appellate court \u201crender its final order or judgment with the least possible delay,\u201d a legislative analysis says.<\/p>\n<p>Cities found to be in violation of the law by placing a decriminalization initiative\u2014or any measure that conflicts with state or federal drug laws\u2014would be subject to a $25,000 civil fine for a first offense and a $50,000 fine for any subsequent offense.<\/p>\n<p>\u201cIn the last few years several local governments have adopted policies and ordinances that are designed to decriminalize controlled substances or instruct law enforcement or prosecutors not to enforce our state drug laws,\u201d Perry said in a statement of intent.<\/p>\n<p>\u201cIn 2024, the attorney general launched lawsuits against multiple cities for adopting non-prosecution policies that violate Texas laws concerning marijuana possession and distribution,\u201d he said. \u201cAlthough these lawsuits are still pending, this is a growing trend across our state.\u201d<\/p>\n<p>It\u2019s not clear why, if the attorney general\u2019s lawsuits assert that local decriminalization laws are already prohibited under statute, the proposed amendments to the code are necessary. But the legislation does appear to escalate enforcement and penalties.<\/p>\n<p>A House companion <a href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=89R&amp;Bill=HB5082\" target=\"_blank\" rel=\"noopener\">version<\/a> of the bill, sponsored by Rep. Jeff Leach (R), is scheduled for a hearing in the State Affairs Committee on Friday.<\/p>\n<p>The Senate vote comes about a week after a Texas appellate court sided with the state in its lawsuit challenging the city of San Marcus over <a href=\"https:\/\/www.marijuanamoment.net\/texas-court-sides-with-state-to-block-voter-approved-marijuana-decriminalization-law-in-san-marcos\/\" target=\"_blank\" rel=\"nofollow noopener\">the implementation of a local marijuana decriminalization law approved by voters<\/a>.<\/p>\n<p>That marked a setback for activists who\u2019ve led the charge to enact local marijuana policy changes through the ballot, <a href=\"https:\/\/www.marijuanamoment.net\/texas-gop-attorney-general-sues-to-overturn-marijuana-decriminalization-anarchy-in-five-cities-despite-local-voter-approval\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">many of which have been contested by Texas Attorney General Ken Paxton (R)<\/a>.<\/p>\n<p>Meanwhile, despite the ongoing litigation and Senate bill\u2019s advancement, Texas activists have their targets set on yet another city, Kyle, where <a href=\"https:\/\/www.marijuanamoment.net\/texas-activists-rally-support-for-another-local-marijuana-decriminalization-ballot-initiative-for-2025\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">they hope put an initiative before voters to enact local marijuana reform<\/a>\u00a0at the ballot this coming November.<\/p>\n<p>Despite the state\u2019s resistance and the latest development in San Marcos, advocates have seen several courts rule in their favor amid the legal challenges.<\/p>\n<p>For example, in February, a Texas judge has ruled that a cannabis decriminalization law approved by Dallas voters last year can continue to be implemented\u2014<a href=\"https:\/\/www.marijuanamoment.net\/texas-judge-rejects-attorney-generals-attempt-to-reverse-dallas-marijuana-decriminalization-law-approved-by-voters\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">denying a request from the state attorney general<\/a>\u00a0that sought to temporarily block the reform as a lawsuit proceeds.<\/p>\n<p>This doesn\u2019t mean the lawsuit from Paxton is dead altogether. But, at least for the time being, the judge has determined that the decriminalization policy can continue as the litigation unfolds.<\/p>\n<p>Dallas Police Department had previously instructed officers to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/dallas-police-instructed-not-to-arrest-people-for-marijuana-following-voter-approval-of-decriminalization\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">stop arresting or citing people for possession of up to four ounces of marijuana<\/a>, in accordance with the voter-approved ballot initiative.<\/p>\n<p>Gov. Greg Abbott (R) has lashed out against the municipal cannabis reform efforts.<\/p>\n<p>\u201cLocal communities such as towns, cities and counties, they don\u2019t have the authority to override state law,\u201d\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/texas-governor-condemns-local-marijuana-decriminalization-efforts-as-lubbock-voters-decide-on-reform-at-the-ballot\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">the governor said last May<\/a>\u00a0\u201cIf they want to see a different law passed, they need to work with their legislators. Let\u2019s legislate to work to make sure that the state, as a state, will pass some of the law.\u201d<\/p>\n<p>He said it would lead to \u201cchaos\u201d and create an \u201cunworkable system\u201d for voters in individual cities to be \u201cpicking and choosing\u201d the laws they want abide by under state statute.<\/p>\n<p>Abbott has previously said that he\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/gop-texas-governor-says-people-shouldnt-be-jailed-over-marijuana-possession-but-misstates-current-law\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">doesn\u2019t believe people should be in jail over marijuana possession<\/a>\u2014although he mistakenly suggested at the time that Texas had already enacted a decriminalization policy to that end.<\/p>\n<p>In 2023, Ground Game released a report that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/ahead-of-lubbock-decriminalization-vote-texas-marijuana-reform-group-examines-impacts-of-similar-measures-in-five-other-cities\/?fbclid=IwAR2louOco4op7bC2tfZL7KLApcdhz1Hz5NglrcR5KWIV1FvNsqn3o39CSW8\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">looked at the impacts of the marijuana reform laws<\/a>. It found that the measures will keep hundreds of people out of jail, even as they have led to blowback from law enforcement in some cities. Joe Moody (D) to decriminalize cannabis statewide, is one of the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/texas-lawmakers-are-considering-nearly-two-dozen-marijuana-and-hemp-bills-this-legislative-session\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">latest of nearly two dozen cannabis-related proposals filed so far in Texas<\/a>\u00a0for the current legislative session. Various other measures would legalize adult-use marijuana, remove criminal penalties for cannabis possession and adjust the state\u2019s existing medical marijuana laws, among others.<\/p>\n<p>Moody\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/texas-house-passes-marijuana-decriminalization-and-expungements-bill-sending-it-to-the-senate\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">sponsored a similar marijuana decriminalization bill last legislative session<\/a>, in 2023. That measure, HB 218, passed the House on an 87\u201359 vote but later died in a Senate committee.<\/p>\n<p>The House had already\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/texas-house-votes-to-decriminalize-marijuana-and-expand-medical-cannabis-system\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">passed earlier cannabis decriminalization proposals<\/a>\u00a0during the two previous legislative sessions, in 2021 and 2019.
