The vote came a day after a House committee advanced a companion bill in that chamber.<\/p>\n<p>Senators voted 27\u20139 to approve SB 700, from Sen. Keith Truenow (R). HB 651 is moving through the House, meanwhile, having advanced out of the Commerce Committee on Tuesday.<\/p>\n<p>The proposed ban on spores of mushrooms that create psilocybin or psilocin is a small part of the roughly 150-page legislation, which would make a variety of adjustments to Florida\u2019s agricultural laws, including around agricultural lands, utilities and wildlife management.<\/p>\n<p>With respect to psychedelic mushrooms, both measures would outlaw transporting, importing, selling or giving away \u201cspores or mycelium capable of producing mushrooms or other material which will contain a controlled substance, including psilocybin or psilocyn, during its lifecycle.\u201d<\/p>\n<p>Violating the proposed law would be a first-degree misdemeanor, carrying a maximum one year in jail and $1,000 fine.<\/p>\n<p>While lawmakers on the Senate floor and House committee spent considerable time debating various other portions of the bills\u2014especially a proposed ban on fluoride in local water supplies\u2014there was no mention of the provision concerning psychedelic mushroom spores.<\/p>\n<p>\u201cThis bill at its core is meant to help farmers and consumers and students who want to become farmers one day,\u201d Truenow said ahead of the floor vote.<\/p>\n<p>Psilocybin and psilocin are the two main psychoactive compounds in psychedelic mushrooms. Although spores themselves typically do not contain psilocybin or psilocin, they eventually produce fruiting bodies\u2014mushrooms\u2014that do contain the psychedelic compounds.<\/p>\n<p>Because the spores don\u2019t contain any controlled substances, the federal government deems them legal.<\/p>\n<p><a href=\"https:\/\/www.marijuanamoment.net\/dea-confirms-that-psychedelic-mushroom-spores-are-federally-legal-prior-to-germination\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">\u201cIf the mushroom spores (or any other material) do not contain psilocybin or psilocin (or any other controlled substance or listed chemical), the material is considered not controlled,\u201d<\/a>\u00a0Terrence Boos, the Drug Enforcement Administration\u2019s (DEA) Drug and Chemical Evaluation Section chief, said in a memo last year. (Using a similar rationale, Boos has said that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/dea-says-marijuana-seeds-are-considered-legal-hemp-as-long-as-they-dont-exceed-thc-limit\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">marijuana seeds are considered federally legal hemp because they themselves don\u2019t contain THC<\/a>.)<\/p>\n<p>In Florida, a legislative report for\u00a0<a href=\"https:\/\/flhouse.gov\/Sections\/Bills\/billsdetail.aspx?BillId=81263\" target=\"_blank\" rel=\"noopener\">HB 651<\/a>\u00a0similarly notes that \u201cspores do not contain any psilocybin properties themselves and therefore could be considered legal under current law.\u201d<\/p>\n<p>To prevent that, the proposal would clarify as illegal any spores or mycelium that could produce psilocybin or psilocin at any time in their development.<\/p>\n<p>A legislative report for the <a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2025\/700\" target=\"_blank\" rel=\"noopener\">Senate version<\/a> of the\u00a0bill\u00a0notes that psychedelic mushrooms \u201cbecame popular in the United States during the 1960s when American researchers first studied their healing properties and medical applications. Now, they are listed as a Schedule I controlled substance by the U.S. government, meaning they have no accepted medical use.\u201d<\/p>\n<p>It further says that \u201cany material, compound, mixture, or preparation that contains the hallucinogenic substance known as Psilocybin has high potential for abuse and is not currently accepted as medical treatment in the United States.\u201d<\/p>\n<p>As for psilocybin and psilocin themselves, the substances are already illegal in Florida. Simple possession is a third-degree felony, carrying up to five years in prison and a $5,000 fine.<\/p>\n<p>On Tuesday of this week, a separate House committee voted unanimously to <a href=\"https:\/\/www.marijuanamoment.net\/florida-lawmakers-unanimously-approve-bill-to-make-medical-marijuana-cards-free-for-military-veterans\/\" target=\"_blank\" rel=\"nofollow noopener\">advance a recently amended bill that would allow military veterans to skip the state registration fee for medical marijuana cards<\/a> and obtain the certifications for free.<\/p>\n<p>That measure, HB 555, was filed in February by Rep. Alex Andrade (R) and originally would have made more significant changes to the state\u2019s existing medical cannabis program, for example allowing home cultivation as well as reciprocity for out-of-state patients. The amount of delta-9 THC in hemp-derived products, meanwhile, couldn\u2019t be more than five milligrams per serving or 50 milligrams per container.<\/p>\n<p>The amount of THC in hemp-infused drinks to just five milligrams per container, and the beverages could be sold only by retailers with liquor licenses\u2014a provision backed by lobbyists representing the beer and wine industries.<\/p>\n<p>Meanwhile, a state judge last month\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-judge-dismisses-marijuana-companys-defamation-lawsuit-against-state-republican-party-over-legalization-campaign\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">dismissed a lawsuit from the cannabis company Trulieve against the state Republican Party<\/a>\u00a0over last year\u2019s failed constitutional amendment that sought to legalize adult-use marijuana.<\/p>\n<p>The company had argued that the GOP\u2019s opposition campaign was \u201cintentionally deceptive,\u201d with \u201cdemonstrably false\u201d claims that were \u201ctrying to fool Florida voters\u201d into opposing the reform, but a the judge disagreed.<\/p>\n<p>The campaign behind the failed legalization effort, Smart and Safe Florida is already gearing up for another ballot fight next year, having so far submitted just over 7,500 valid signatures of the 891,523 needed to make the 2026 ballot, according to the Florida Division of Elections.<\/p>\n<p>The\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-campaign-files-new-marijuana-legalization-initiative-for-2026-ballot-after-reform-failed-in-last-election\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">campaign\u2019s 2026 iteration includes several changes<\/a>\u00a0that seem responsive to issues raised by critics about the 2024 version.<\/p>\n<p>State officials recently sent a cease-and-desist letter to the campaign, however, <a href=\"https:\/\/www.marijuanamoment.net\/florida-officials-say-marijuana-legalization-campaign-committed-multiple-election-law-violations\/\" target=\"_blank\" rel=\"nofollow noopener\">alleging the group \u201ccommitted multiple election law violations.\u201d<\/a><\/p>\n<p>A recent survey from the University of North Florida found that, despite last year\u2019s ballot proposal failing, there\u2019s\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-florida-voters-overwhelmingly-back-marijuana-legalization-as-campaign-pushes-2026-reform-measure-poll-finds\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">overwhelming, bipartisan voter support for the reform<\/a>. It showed\u00a0that 67 percent of Florida voters now back legalization, including 82 percent of Democrats, 66 percent of independents and 55 percent of Republicans.<\/p>\n<p>The results conflict with another recent poll from the Florida Chamber of Commerce, a proactive opponent of legalization, that found majority support for the reform among likely voter (53 percent)\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-legalization-has-majority-support-in-florida-but-not-enough-to-be-enacted-new-poll-from-opposition-group-finds\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">but not enough to be enacted under the 60 percent requirement<\/a>.<\/p>\n<p>Meanwhile, Gov.
