{"id":80850,"date":"2025-04-09T06:03:50","date_gmt":"2025-04-09T14:03:50","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/04\/09\/hemp-industry-expert-tells-congress-businesses-are-begging-for-federal-regulations-at-fda-focused-committee-hearing\/"},"modified":"2025-04-09T19:47:03","modified_gmt":"2025-04-10T03:47:03","slug":"hemp-industry-expert-tells-congress-businesses-are-begging-for-federal-regulations-at-fda-focused-committee-hearing","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2025\/04\/09\/hemp-industry-expert-tells-congress-businesses-are-begging-for-federal-regulations-at-fda-focused-committee-hearing\/","title":{"rendered":"Hemp Industry Expert Tells Congress Businesses Are \u2018Begging\u2019 For Federal Regulations At FDA-Focused Committee Hearing"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2025\/04\/MM_Bill_Tracker_V5_blank-13.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>Members of a congressional committee <a href=\"https:\/\/www.marijuanamoment.net\/congressional-committee-invites-hemp-industry-expert-to-testify-at-hearing-on-how-fda-failed-to-regulate-products\/\" target=\"_blank\" rel=\"nofollow noopener\">held a hearing on the Food and Drug Administration (FDA)<\/a> on Wednesday\u2014with a hemp industry expert explaining how the market is \u201cbegging\u201d for federal regulations around cannabis products and a staunch prohibitionist congressman invoking musician Elton John\u2019s opposition to marijuana legalization.<\/p>\n<p>The House Oversight and Government Reform Committee heard from a wide range of experts at the meeting, titled \u201cRestoring Trust in FDA: Rooting Out Illicit Products.\u201d<\/p>\n<p>FDA \u201cfailed to approve products and take necessary enforcement actions resulting in a flood of illicit and counterfeit products entering the country,\u201d a memo that the committee released last week says.<\/p>\n<p>The meeting didn\u2019t exclusively focus on cannabis issues. But among the five listed witnesses selected to testify was Jonathan Miller of the U.S. Hemp Roundtable, an organization that has long criticized FDA\u2019s inaction on CBD and other cannabinoid regulations since the crop was federally legalized under the 2018 Farm Bill.<\/p>\n<p>\u201cWe as an industry are begging for that regulation,\u201d Miller said in response to a question from Chairman James Comer (R-KY).<\/p>\n<p>Asked about instances of youth accessing intoxicating hemp-derived cannabinoid products, the witness stressed that \u201cwe as an industry strongly oppose the sale of these products, or the marketing of these products, to children and really are looking for the FDA help to make sure that that doesn\u2019t happen.\u201d<\/p>\n<p>Comer inquired about FDA\u2019s inaction to date, sarcastically asking if it\u2019d require \u201ca gazillion bureaucrats that work from home\u201d to regulate cannabinoids such as CBD.<\/p>\n<p \/>\n<p>Miller said that existing statutes prohibit manufacturers and distributors to sell \u201cmislabeled or adulterated products,\u201d so taking enforcement action against those that violate the law is one way FDA could regulate hemp.<\/p>\n<p>\u201cThe law also requires reporting of serious adverse events, and it mandates strict labeling\u2014including, if FDA desires, warning against the use of products by children,\u201d he said, adding that FDA \u201ccould require child proof packaging.\u201d<\/p>\n<p>\u201cSo there are existing laws out there that they can take advantage of,\u201d he said.<\/p>\n<p>Rep. Pete Sessions (R-TX), whose been vocal in his opposition to marijuana reform, used the hearing as an opportunity to air his grievances around cannabis\u2014at one point referencing comments Elton John made last year describing legalization as a grave policy mistake.<\/p>\n<p>Sessions said that ahead of the meeting he went to the online medical site WebMD, which he said linked THC to \u201cbrain effects like lower IQ, slower processing, speed, memory and attention issues.\u201d<\/p>\n<p>The congressman complained that delta-8 THC products that are derived or synthesized from hemp were not explicitly addressed in the 2018 Farm Bill that he had a hand in passing.<\/p>\n<p>\u201cI was told it was [hemp] ropes, things that are used by Americans every day\u201d that would be legalized, he said. But due to a \u201cloophole,\u201d intoxicating consumable hemp products have proliferated on a largely unregulated basis.<\/p>\n<p>\u201cI think one of the telling things is comes from a guy whose name is Elton John, a well-known musician who has stated that, of all the things that he\u2019s seen in his life, one of the worst things that he\u2019s seen is America\u201d is cannabis legalization, Sessions said. \u201cMarijuana is THC, and so gentlemen, I will be watching you.\u201d<\/p>\n<p>\u201cWe\u2019ve got to understand it is a dangerous product that causes IQ problems,\u201d he added. \u201cIt causes problems with slowness of adults, and it causes problems that are harmful to children.\u201d<\/p>\n<p>Rep. Tim Burchett (R-TN) also weighed in on the hemp side of the FDA-centered hearing, expressing his own concerns about children being accidentally exposed to intoxicating products.<\/p>\n<p>\u201cIt seems the rules and regulations are kind of all over the place,\u201d he said.<\/p>\n<p>The congressman also pointed out that some of his colleagues, including \u201csome in this room actually\u201d support legalizing marijuana but \u201cdo not support it in the hands of children.\u201d<\/p>\n<p>In written testimony to the committee, Miller of the U.S. Hemp Roundtable stressed that \u201chemp\u2019s policy success has always been a bipartisan hallmark.\u201d<\/p>\n<p>\u201cIt\u2019s no wonder\u2014hemp products are made in the USA, harvested from crops grown by American farmers, manufactured by innovative U.S. entrepreneurs, and sold by small businesses dotting the nation,\u201d he said, adding that, over the past decade, \u201cU.S. farmers have rebuilt a domestic supply chain of hemp and hemp products.\u201d<\/p>\n<p>\u201cUnfortunately, however, the U.S. hemp industry continues to encounter avoidable bureaucratic headwinds in the marketplace,\u201d he said. \u201cAnd this turmoil is due in large part to statements, actions, and indecisions of [FDA].\u201d<\/p>\n<p style=\"padding-left: 40px\">\u201cWe\u2019ve watched in bewilderment as FDA has jerked back and forth with contradictory opinions. First, the agency affirmed its ability to regulate CBD under current law. And leaders at the agency clearly recognized that Congress wanted FDA to act quickly. But then, in the intervening years, FDA stalled, even ignoring congressional appropriations report directives to take expedited action. Meanwhile, federal regulatory uncertainty severely impacted the hemp and CBD market, with reduced manufacturing demand resulting in a more than 90 percent commodity price decline, crushing opportunities for U.S. farmers.\u201d<\/p>\n<p>He went on to say that FDA\u2019s inaction \u201cdoesn\u2019t just threaten the current and future CBD market for American farmers and consumers,\u201d as a \u201cnew industry focused on the adult market has emerged to meet strong consumer demand for hemp-derived cannabinoids like delta-8 THC, delta-9 THC and CBN.\u201d<\/p>\n<p>\u201cThese products provide plant-based options for adults seeking products with functional health and wellness benefits that have not been effectively addressed,\u201d Miller said. \u201cFurthermore, a promising new hemp beverage industry has soared into popularity, meeting adult consumer demand for non-alcoholic options through domestic inputs from our farmers.\u201d<\/p>\n<p style=\"padding-left: 40px\">\u201cWe are hopeful that new leadership at the FDA will reverse the past course of inaction and take deliberate action leveraging their current authorities to robustly regulate hemp products. This issue is precisely in line with the new Administration\u2019s focus on providing adult consumers the freedom to make health care choices on behalf of their own families, with holistic solutions that are grown on American farms. If that\u2019s the case, we ask Congress to ensure that the agency is properly resourced to implement good policy.\u201d<\/p>\n<p>\u201cThe hemp industry may be unique in that we are coming to Congress to ask: Please, regulate us!\u201d his testimony concludes. \u201cA rational, sensible regulatory framework for the hemp industry can also provide a needed financial jolt to our nation\u2014an economic stimulus package for the nation\u2019s farmers and small businesses without requiring one dime from the American taxpayer.\u201d<\/p>\n<p>Miller told Marijuana Moment last week that his testimony is meant to serve as an \u201cupdate\u201d on <a href=\"https:\/\/www.marijuanamoment.net\/watch-live-congressional-committee-addresses-fda-inaction-on-cbd-regulations\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">issues he outlined during a 2023 hearing before a subcommittee of the full panel<\/a>, where lawmakers raised concerns about FDA\u2019s refusal to establish rules allowing for the marketing of federally legal hemp as a food item or dietary supplement.<\/p>\n<p>In the two years since that initial meeting, the hemp market has faced repeated regulatory challenges\u2014with a growing number of states moving to enact bans on certain hemp products due to the lack of regulations around intoxicating cannabinoids such as delta-8 THC that have become widely available.<\/p>\n<p>\u201cNothing has happened at the FDA\u201d to resolve the issue, Miller said. \u201cAnd we think these ban efforts have a lot to do with the fact that we\u2019re not regulated. So if we can get regulated, hopefully people will drop the efforts to ban our products.\u201d<\/p>\n<p>One potential legislative solution that Miller said he planned to raise with the committee at the <a href=\"https:\/\/docs.house.gov\/Committee\/Calendar\/ByEvent.aspx?EventID=118131\" target=\"_blank\" rel=\"noopener\">hearing<\/a>\u00a0is a bipartisan bill Sen. Ron Wyden (D-OR) filed last year that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/hemp-and-cannabinoids-like-cbd-would-be-federally-regulated-under-new-senate-bill-filed-as-alternative-to-far-reaching-bans\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">create a federal regulatory framework for hemp-derived cannabinoids<\/a>.<\/p>\n<p>The legislation would empower states to set their own rules for products such as CBD while also empowering FDA to ensure that certain safety standards are met in the marketplace.<\/p>\n<p>In the absence of FDA rules, states from\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/cheech-and-chongs-company-sues-to-overturn-new-california-hemp-product-ban-that-took-effect-this-week\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">California<\/a>\u00a0to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/florida-bill-to-restrict-hemp-products-like-delta-8-thc-heads-to-the-senate-floor\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">Florida<\/a>\u00a0have pushed for sweeping changes to their own laws around consumable hemp products. But certain stakeholders had expressed concern that part of the intent of the legislation was to \u201celiminate a whole range of products\u201d that are now sold in the market.<\/p>\n<p>For the time being, the hemp industry continues to face unique regulatory hurdles that stakeholders blame for the crop\u2019s value plummeting in the short years since its legalization.
