Liz Conmy (D). If enacted, it would have made the state penalty for possession of up to half an ounce of marijuana a $150 civil fine.<\/p>\n<p>North Dakota in 2019 <a href=\"https:\/\/www.marijuanamoment.net\/north-dakota-governor-signs-marijuana-decriminalization-bill\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">enacted what advocacy groups generally refer to as a marijuana decriminalization law<\/a>, which removed the risk of jail time for possessing under a half-ounce of cannabis. Possession nevertheless remains a criminal infraction and carries a fine of up to $1,000.<\/p>\n<p>HB 1596, would have instead made simple possession of up to half an ounce of marijuana a civil citation. That change would remove the need for courtroom appearances, which proponents said would help decongest the state\u2019s clogged court system and free up prosecutorial resources for more pressing concerns.<\/p>\n<p><a href=\"https:\/\/ndlegis.gov\/assembly\/69-2025\/regular\/bill-overview\/bo1596.html\" target=\"_blank\" rel=\"nofollow noopener\">HB 1596<\/a>\u00a0passed the state\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/north-dakota-house-passes-bill-to-expand-marijuana-decriminalization-making-low-level-possession-a-150-citation\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">House of Representatives in late February, on a 76\u201317 vote<\/a>. Earlier that month, the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/north-dakota-lawmakers-approve-bill-to-expand-marijuana-decriminalization-making-low-level-possession-a-150-citation\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">House Judiciary Committee advanced the legislation on an 11\u20131\u20132 vote<\/a>.<\/p>\n<p>Speaking for the Senate Judiciary Committee on the floor Wednesday, Sen. Janne Myrdal (R) said that \u201c<span style=\"font-weight: 400\">we came to the conclusion that even recently, the people in North Dakota have said no to to legalizing recreational marijuana. This bill would decriminalize it.\u201d<\/span><\/p>\n<p>State voters have not weighed in on simple marijuana decriminalization, though last year they <a href=\"https:\/\/www.marijuanamoment.net\/north-dakota-voters-defeat-marijuana-legalization-at-the-ballot\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">rejected a broader adult-use legalization ballot initiative<\/a>\u00a0that would have created a commercial cannabis market. Voters also\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/north-dakota-voters-reject-marijuana-legalization-ballot-initiative\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">rejected an earlier legalization proposal<\/a>\u00a0at the ballot box in 2022.<\/p>\n<p>\u201cS<span style=\"font-weight: 400\">hould we deny the vote of the people and crack that door open\u2014no pun intended\u2014for decriminalizing marijuana?\u201d Myrdal asked colleagues.<\/span><\/p>\n<p>Sen. Diane Larson (R), \u201cand the people have voted on this and want to keep this on the books.\u201d<\/p>\n<p>Lawmakers and advocates who oppose the measure have repeatedly claimed that voters\u2019 rejection of commercial legalization measures means they want to keep criminalizing cannabis.<\/p>\n<p>\u201cThe voters have spoken on this issue,\u201d Stephanie Ingebretsen, a representative of the Chiefs of Police Association of North Dakota, said at a hearing earlier this week. \u201cThey\u2019re not interested in legalization and would like it to stay a criminal offense.\u201d<\/p>\n<p>\u201cIn this case, I have to stand behind the voters,\u201d Sen. Bob Paulson (R) said at the time, ostensibly reasoning that because voters rejected commercial legalization, they would similarly oppose any reduction to criminal penalties for simple possession.<\/p>\n<p>Despite pushback from police and sheriffs\u2019 departments, the proposal has support from some county prosecutors and defense attorneys.<\/p>\n<p>In written testimony submitted in support of the bill, Cass County State\u2019s Attorney Kimberlee Hegvik said that \u201ccases involving small amounts of marijuana and paraphernalia used to prepare and ingest it take time from dockets that are also handling serious violent crimes.\u201d<\/p>\n<p class=\"p1\">\u201cMaking these offenses functionally equivalent to traffic tickets and giving offenders the option to pay fines in lieu of appearing in court cuts down on criminal justice system resources significantly,\u201d Hegvik wrote. \u201cThis bill promotes judicial efficiency and economy, allowing the criminal justice system to focus on more serious crimes and behaviors that impact the safety of our communities while still holding people accountable for possessing small amounts of marijuana and marijuana paraphernalia.\u201d<\/p>\n<p>Comments from Jason Kraft, a Ward County Sheriff\u2019s Department captain, said his county has already arrived at a simplified approach that eases court congestion.<\/p>\n<p>\u201cThe way we currently handle these infractions in our jurisdiction imposes a minimal burden on the courts for simple possession,\u201d he explained. \u201cWhen they are cited for the infraction, we provide the arrestee a copy of what\u2019s called Rule 43 paperwork. This is paperwork from our State\u2019s Attorney that sets forth an agreement between the arrestee and the State\u2019s Attorney to accept a written guilty plea in exchange for a $150 fine.
