Jeff Steinborn (D), which passed the full Senate last week and cleared a House committee on Monday, advanced on the House floor in a 56-8 vote on Tuesday. It now heads to the governor.<\/p>\n<p>If signed into law, the Medical Psilocybin Act would allow patients with certain qualifying conditions to access the psychedelic and use it under the guidance of a licensed healthcare provider.<\/p>\n<p>Ahead of the vote, Rep. Stefani Lord (R) spoke about \u201chow well this works with PTSD, OCD, drug addiction [and] depression.\u201d<\/p>\n<p>\u201cThere\u2019s many different ways that this medication will help people,\u201d she said.<\/p>\n<p>Rep. Andrea Romero (D) said the new law would put \u201cNew Mexico on the map as essentially one of the first and best in care when it comes to PTSD, anxiety and really at the cutting edge of all the opportunities that we have to treat some of the most difficult long-term interests that we see within our veterans communities, with those who have carried everything from trauma to great tragedy.\u201d<\/p>\n<p>\u201cThis is an incredible opportunity for us,\u201d she said.<\/p>\n<p>Rep. Catherine Cullen (R) <a href=\"https:\/\/sg001-harmony.sliq.net\/00293\/Harmony\/en\/PowerBrowser\/PowerBrowserV2\/20250318\/-1\/77101\" target=\"_blank\" rel=\"noopener\">said<\/a> she believes psilocybin \u201cis something that can really help our veterans, people that are severely depressed and also have certain addictions.\u201d<\/p>\n<p>The measure says the purpose \u201cis to allow the beneficial use of psilocybin in a regulated system for alleviating qualified medical conditions,\u201d including major treatment-resistant depression, PTSD, substance use disorders and end-of-life care. The state Department of Health would be able to approve additional conditions.<\/p>\n<p>Under the\u00a0<a href=\"https:\/\/www.nmlegis.gov\/Legislation\/Legislation?chamber=S&amp;legtype=B&amp;legno=219&amp;year=25\" target=\"_blank\" rel=\"noopener\">legislation<\/a>, psilocybin therapy would consist of a preparation session, an administration session and a follow-up integration session.<\/p>\n<p>The state health department would be responsible for establishing guidelines around training for clinicians and producers, including dosage, approved settings for administration, production and storage protocols and other best practices. State officials would also license producers to grow mushrooms and process psilocybin.<\/p>\n<p>Synthetic psilocybin and synthetic analogs of the substance would not be allowed under the proposal.<\/p>\n<p>A nine-member advisory board would recommend additional qualifying conditions as well as rules around preparation and dosage. The board would also review outside petitions for additional qualifying conditions.<\/p>\n<p>SB 219 would also create two new state funds. A medical psilocybin treatment equity fund would help offset costs of treatment for qualified patients who meet income requirements that would be set by the health department. And a medical psilocybin research fund would issue grants to support research into \u201cany facet of the medical use of psilocybin.\u201d<\/p>\n<p>In terms of costs, the bill initially would have appropriated $2 million from the state general fund to the Department of Health in order to administer the program, while an additional $1 million each would go to the new research and equity funds.<\/p>\n<p>An amendment adopted in a Senate committee stripped the appropriation amount from the bill, however. Steinborn noted that a separate bill contains $2 million for the plan if it becomes law.<\/p>\n<p>The Senate Judiciary Committee, meanwhile, approved an amendment intended to clarify that while psilocybin service providers would be shielded from criminal prosecution for their work related to psychedelics, they could still be subject to medical malpractice claims.<\/p>\n<p>On the Senate floor last week, members adopted an amendment to clarify that the use of federally approved psilocybin would be allowed under the state law, but that such products would not be further regulated by the state.<\/p>\n<p>The amendment also removed a requirement that the department develop \u201cqualifying conditions\u201d for producers and clinicians, add a health care provider to the advisory board that would be created by the bill and strike language the sponsor described as \u201credundant.\u201d<\/p>\n<p>In 2023, the House Health and Human Services Committee also passed a bill that called for the creation of a state body to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-mexico-lawmakers-approve-psilocybin-study-bill\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">study the possibility of launching a psilocybin therapy program for certain patients<\/a>. That measure did not advance further in the 2023 session, however.<\/p>\n<p>When announcing this latest legislation late January, the sponsor said that the proposal \u201ccreates a carefully designed framework for the Department of Health to establish a medical program for psilocybin use.\u201d<\/p>\n<p>\u201cEnsuring New Mexicans have access to every available treatment for serious behavioral health challenges is critical, and this proven therapy offers new hope for those in need,\u201d he said.<\/p>\n<p>Meanwhile, cosponsor Sen. Michelle Lujan Grisham (D) endorsed, a resolution\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-mexico-governor-signs-psilocybin-therapy-and-research-resolution\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">requesting that state officials research the therapeutic potential of psilocybin<\/a>\u00a0and explore the creation of a regulatory framework to provide access to the psychedelic.<\/p>\n<p>Meanwhile in New Mexico, the U.S. Department of Homeland Security (DHS) and Customs and Border Protection (CBP) are urging a federal court to dismiss a\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-mexico-marijuana-businesses-sue-biden-administration-over-border-patrol-seizures-of-state-legal-products\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">lawsuit from licensed marijuana businesses<\/a>\u00a0that claim the agencies have been unconstitutionally seizing state-regulated marijuana products and detaining industry workers at interior checkpoints.<\/p>\n<p>Separately, late least year commissioners of New Mexico\u2019s most populous county approved policy details of a plan to stop testing and punishing most government employees for off-hours marijuana use. Bernalillo County, where Albuquerque is located, appears to be the first public body in the state to implement such a reform following the\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-mexico-governor-signs-marijuana-legalization-bill-making-state-third-to-enact-reform-within-days\/\" rel=\"noopener\" data-google-interstitial=\"false\" target=\"_blank\">state\u2019s legalization of cannabis in 2021<\/a>.<\/p>\n<p>Meanwhile in New Mexico, a House committee recently passed a bill that would further protect medical marijuana patients in the state from being\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-mexico-house-and-senate-lawmakers-approve-bills-to-strengthen-employment-protections-for-medical-marijuana-patients\/\" data-google-interstitial=\"false\" target=\"_blank\" rel=\"nofollow noopener\">penalized at work for off-duty use of cannabis<\/a>.
