{"id":79256,"date":"2024-12-04T11:27:04","date_gmt":"2024-12-04T19:27:04","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/12\/04\/marijuana-case-being-argued-this-week-in-federal-court-could-have-major-impact-on-governments-ability-to-enforce-prohibition-op-ed\/"},"modified":"2024-12-04T19:45:49","modified_gmt":"2024-12-05T03:45:49","slug":"marijuana-case-being-argued-this-week-in-federal-court-could-have-major-impact-on-governments-ability-to-enforce-prohibition-op-ed","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/12\/04\/marijuana-case-being-argued-this-week-in-federal-court-could-have-major-impact-on-governments-ability-to-enforce-prohibition-op-ed\/","title":{"rendered":"Marijuana Case Being Argued This Week In Federal Court Could Have Major Impact On Government\u2019s Ability To Enforce Prohibition (Op-Ed)"},"content":{"rendered":"<\/p>\n<p><em>\u201cAttorney David Boies is known for taking cases that \u2018have legs\u2019\u2014that is, the potential to be heard by the Supreme Court.\u201d<\/em><\/p>\n<p><strong>By Christine Baily, C Bailey Law LLC<\/strong><\/p>\n<p>A case heading for oral argument in a federal appeals court on Thursday challenges the government\u2019s authority to enforce the Controlled Substances Act\u2019s (CSA) application to\u00a0economic activity of licensees and registrants who are complying with state marijuana laws.<\/p>\n<p>The <a href=\"https:\/\/www.marijuanamoment.net\/federal-appeals-court-schedules-oral-argument-in-case-seeking-to-overturn-u-s-marijuana-prohibition\/\" target=\"_blank\" rel=\"noopener\">U.S. Circuit Court of Appeals for the First Circuit is scheduled to hear oral argument<\/a> in an appeal brought by the plaintiffs, owners of cannabis and cannabis-adjacent businesses operating in Massachusetts. The plaintiffs maintain that Congress lacks the authority to regulate their economic activity conducted in compliance with state marijuana laws.<\/p>\n<p>Prior to this appeal, a federal <a href=\"https:\/\/www.marijuanamoment.net\/federal-court-dismisses-marijuana-companies-lawsuit-challenging-prohibition-but-says-cannabis-laws-warrant-reexamination\/\" target=\"_blank\" rel=\"noopener\">district court judge granted the federal government\u2019s motion to dismiss<\/a>. The judge relied on the U.S. Supreme Court\u2019s 2005 opinion, <em>Gonzales v. Raich<\/em> (<em>Raich<\/em>). In <em>Raich<\/em>, the Supreme Court held that local economic activity, including the cultivation of marijuana solely for personal use, had a substantial effect on interstate commerce. As such, Congress had the authority to regulate this activity.<\/p>\n<p>While the judge acknowledged that circumstances have changed since that decision, including changes in views about marijuana, state regulation and federal enforcement, he was nevertheless bound by the Supreme Court\u2019s holding in <em>Raich<\/em>. The plaintiffs <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-companies-appeal-case-challenging-federal-prohibition-following-district-court-dismissal\/\" target=\"_blank\" rel=\"noopener\">appealed the lower court\u2019s decision<\/a> to the First Circuit.<\/p>\n<p>At Thursday\u2019s oral argument, the First Circuit likely will focus on whether the federal district court judge erred by relying on <em>Raich<\/em> and dismissing the plaintiffs\u2019 complaint. Attorney David Boies of the law firm Boies Schiller Flexner LLP and his colleagues represent the plaintiffs. Boies is known for taking cases that \u201chave legs\u201d\u2014that is, the potential to be heard by the Supreme Court.<\/p>\n<p>On appeal, the plaintiffs argue that the lower court judge erred in the analysis of the Commerce Clause and ignored the Necessary and Proper Clause. They contend that the continued ban on marijuana is not necessary and proper to achieving Congress\u2019s current goals under the CSA.<\/p>\n<p>They demonstrate that since <em>Raich<\/em> was decided in 2005, the federal government has abandoned its goal to regulate interstate commerce of marijuana, citing evidence that Congress allows medical marijuana to be sold in Washington, D.C., and passes the Rohrabacher\u2013Farr Amendment, which prohibits the Department of Justice from interfering with the states\u2019 implementation of their medical marijuana laws. The plaintiffs maintain that as a result of these changes, Congress\u2019s continued regulation of state legalized activity is unconstitutional.<\/p>\n<p>The plaintiffs\u2019 first objective before the First Circuit is to overturn the lower court\u2019s decision to dismiss their complaint. However, this is not their only objective.<\/p>\n<p>Neither the plaintiffs nor court-watchers expect to be surprised if the First Circuit affirms the lower court\u2019s dismissal. For that reason, the plaintiffs have another objective: that the First Circuit issue a decision that will attract the attention of and ultimately, a review by, the U.S. Supreme Court.<\/p>\n<p>For these reasons, both parties will also be directing their arguments beyond the courtroom to the higher court.<\/p>\n<p>This case matters to the extent that it will have important implications for how the federal government responds to state legalization.<\/p>\n<p>If the First Circuit reverses the lower court\u2019s decision, it could set a precedent that limits Congress\u2019s authority to regulate state-legalized marijuana activity under the CSA. However, if the panel affirms the federal district court\u2019s decision, it could strengthen the federal government\u2019s ability to enforce the CSA.<\/p>\n<p>Regardless of the outcome, this case is worth watching given its potential impact on the future of cannabis policy across the United States.<\/p>\n<p><em>Christine Baily focuses on providing personalized legal advice to businesses and individuals operating in regulated industries.
