Lawmakers in the chamber voted 24\u201313 to block the legislation on Wednesday, with opposition led by the governing Labor party and opposition coalition Liberal and National parties.<\/p>\n<p>The plan\u2019s backer, Sen. David Shoebridge, said the vote nevertheless marked progress in the country\u2019s shift away from the war on drugs. A Greens press release noted that it\u2019s the first time Australia\u2019s federal parliament voted on a nationwide cannabis legalization bill.<\/p>\n<p>\u201cWe took a big step today from treating cannabis as part of the failing \u2018war on drugs\u2019 and instead putting forward a model that is safer, reduces harms and delivers for the millions of Australians who just want us to legalize it!\u201d Shoebridge said in a <a href=\"https:\/\/greens.org.au\/news\/media-release\/media-release-cannabis-bill-sees-labor-and-coalition-stuck-1950s-and-failing-see\" target=\"_blank\" rel=\"noopener\">statement<\/a>, adding: \u201cThe Labor and Coalition parties joined together to try and hold Australia back in the 1950\u2019s by blocking this desperately needed reform.\u201d<\/p>\n<p>In a post on social media, Shoebridge vowed that despite vote\u2019s outcome, \u201cwe\u2019re not giving up on legalising cannabis.\u201d<\/p>\n<p>The proposal would have legalized, regulated and taxed cannabis at the national level, establishing the Cannabis Australia National Agency, or CANA, to license and oversee the commercial industry and maintain a national register of marijuana strains.<\/p>\n<p>Home cultivation for personal use, as well as home processing of edibles, would have been explicitly allowed under the bill.<\/p>\n<p>It would have also authorized the creation of cannabis cafes, where adults could use marijuana in a social setting.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Liberals and Labor just teamed up to vote against legalising cannabis in the Senate.<\/p>\n<p>This is yet another example of the major parties working together to refuse any sort of progress.<\/p>\n<p>But we promise you this: we\u2019re not giving up on legalising cannabis.<\/p>\n<p>\u2014 David Shoebridge (@DavidShoebridge) <a href=\"https:\/\/twitter.com\/DavidShoebridge\/status\/1861588581049082083?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">November 27, 2024<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>Outreach to the public while crafting the bill, the Greens said in a report published before the vote, found \u201cstrong agreement that cannabis growing and sales should not be overly corporatized and agreement that big alcohol, tobacco and pharmaceutical industries should not control the industry.\u201d<\/p>\n<p>\u201cThe support for this bill across the community is enormous and it\u2019s why we know cannabis legalisation in this country is inevitable,\u201d Shoebridge said on Wednesday.<\/p>\n<p>The ongoing criminalization of cannabis in Australia, he argued, has failed to curb use in the country.<\/p>\n<p>\u201cGovernment data shows 8.8 million of adult Australians have consumed cannabis. The Labor and Liberal parties are happy to call all of these people criminals. That\u2019s a bloody disgrace,\u201d Shoebridge said. \u201cThey keep pretending the war on drugs is working and that we all live in a world where drug use almost never happens.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Here is the final vote on Legalising Cannabis 13\/24. Don Farrell (Labor), deputy leader of the government in the Senate, called the plan \u201ca stunt by Sen. Shoebridge and the Greens,\u201d asserting it had \u201ca flimsy legal basis.\u201d<\/p>\n<p>\u201cThe Senate committee inquiry into this bill could not determine with any confidence that the bill was constitutional,\u201d Farrell said. \u201cLaws dealing with recreational possession and use of cannabis are matters for the states and territories. Sen. Shoebridge\u2019s bill cannot change that basic fact.\u201d<\/p>\n<p \/>\n<p>The legal change would generate about $28.2 billion in government tax revenue over the next 10 years if products were to be taxed at 15 percent, according to a 73-page legislative report on the <a href=\"https:\/\/www.aph.gov.au\/Parliamentary_Business\/Bills_Legislation\/Bills_Search_Results\/Result?bId=s1353\" target=\"_blank\" rel=\"noopener\">bill<\/a>. Revenue would rise to roughly $36.8 billion if the tax rate were set at 25 percent.<\/p>\n<p>Currently the Greens control 11 of 76 seats in the Australian Senate.<\/p>\n<p>Cannabis remains illegal federally in Australia outside of the country\u2019s highly restrictive medical marijuana program, though some reforms have been adopted at the local level.<\/p>\n<p>In the Australian Capital Territory, for example\u2014which includes the national capital of Canberra and surrounding areas\u2014a policy took effect in October of last year\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/drug-decriminalization-law-takes-effect-in-australian-capital-territory\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">decriminalizing the possession of small amounts of illicit drugs<\/a>. That reform built on\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/local-australian-marijuana-legalization-law-takes-effect-this-week\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">an existing marijuana decriminalization policy<\/a> that took effect in 2020.<\/p>\n<p>In terms of other substances at the national level, the Australian government last year\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/australia-legalizes-psilocybin-and-mdma-prescriptions-as-u-s-patients-seek-similar-authorization\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">rescheduled the psychedelics psilocybin and MDMA<\/a>\u00a0to provide access to people with post-traumatic stress disorder (PTSD) and treat-resistant depression.<\/p>\n<p>Placing the substances in Schedule 8 for therapeutic use under the country\u2019s drug code allows psychiatrists who meet the required standards to prescribe the psychedelics.
