{"id":76634,"date":"2024-06-27T10:09:08","date_gmt":"2024-06-27T18:09:08","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/06\/27\/california-lawmakers-withdraw-bill-to-authorize-psilocybin-therapy-pilot-program-for-veterans-and-former-first-responders\/"},"modified":"2024-06-28T03:21:13","modified_gmt":"2024-06-28T11:21:13","slug":"california-lawmakers-withdraw-bill-to-authorize-psilocybin-therapy-pilot-program-for-veterans-and-former-first-responders","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/06\/27\/california-lawmakers-withdraw-bill-to-authorize-psilocybin-therapy-pilot-program-for-veterans-and-former-first-responders\/","title":{"rendered":"California Lawmakers Withdraw Bill To Authorize Psilocybin Therapy Pilot Program For Veterans And Former First Responders"},"content":{"rendered":"<p><html><body><\/p>\n<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2024\/06\/MM_Bill_Tracker_V5_blank-115.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>California lawmakers have pulled from consideration a bipartisan bill that would have authorized a pilot program to <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-california-senators-file-bill-to-create-psilocybin-therapy-pilot-program-for-veterans-and-first-responders\/\" target=\"_blank\" rel=\"noopener\">provide psilocybin treatment to military veterans and former first responders<\/a>.<\/p>\n<p>The legislation, sponsored by Senate Minority Leader Brian Jones (R) and Sen. Josh Becker (D), was effectively killed about a week after it was amended to narrow eligibility criteria for participants and facilitators who could administer the psychedelic. The sponsors decided at a Tuesday hearing against seeking to advance it further after the chair of the Assembly Health Committee recommended a \u201cno\u201d vote and there wasn\u2019t enough support in the panel to move it forward, advocates said.<\/p>\n<p>The \u201cHeal Our Heroes Act\u201d was introduced as an amendment to an unrelated Senate-passed bill that was on the Assembly floor at the time. It would have allowed the counties of San Francisco, Santa Cruz and San Diego to establish pilot programs where military veterans and former first responders could receive psilocybin treatment with a licensed facilitator.<\/p>\n<p>As filed, the measure said more broadly that \u201cfirst responders\u201d would have been eligible, without the \u201cformer\u201d caveat. The legislation has also been updated to clarify that active duty military cannot participate.<\/p>\n<p>The bill was <a href=\"https:\/\/www.marijuanamoment.net\/california-lawmakers-revise-psilocybin-pilot-program-bill-to-limit-eligibility-for-participants-and-facilitators\/\" target=\"_blank\" rel=\"noopener\">further revised to limit who could qualify as a psilocybin facilitator<\/a>. Only physicians and surgeons could administer the psychedelic under the current proposal, whereas it previously also included clinical psychologists, licensed clinical social workers, nurse practitioners, physician assistants, licensed professional clinical counselors or naturopathic doctors.<\/p>\n<p>The\u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240SB803\" target=\"_blank\" rel=\"noopener\">bill<\/a> called for the pilot program to sunset after three years, with requirements to collect data and submit reports on the impact of the reform after two years. There were also provisions mandating certain safety standards such as screening participants to ensure that they can safely benefit from the psychedelic treatment.<\/p>\n<p>In an analysis of the legislation, the Assembly Public Health Committee listed a series of concerns, arguing that the proposal lacks a sufficient regulatory framework, has \u201csparse\u201d health and safety standards and comes with an \u201cunclear urgency\u201d for the reform.<\/p>\n<p>\u201cThis narrative does not encompass all of the Committee\u2019s concerns in these regards, but demonstrates the significant lack of parameters and guardrails in this bill,\u201d it said. \u201cThe proponents of this bill have stated that local control is a key element for a pilot program, arguing that locals need to be able to make it work for their own community. But local control cannot come at the expense of patient safety.\u201d<\/p>\n<p style=\"padding-left: 40px\">\u201cThis bill is authorizing the therapeutic use of psychedelic substances that are not being utilized under the strict parameters of clinical research have nor have they been subjected to the rigorous drug approval process of the FDA. Safeguards need to be in place to ensure that each pilot program is established and run in a manner that is safe for participants, scientifically sound, meeting local and state health standards, and is producing conclusions of value for the state.\u201d<\/p>\n<p style=\"font-weight: 400\">Jesse Gould, founder of Heroic Hearts Project, said in a press release that the \u201cLegislature has again failed veterans, first responders, and the 130,000 veteran families that have lost a loved one to suicide.\u201d<\/p>\n<p style=\"font-weight: 400\">\u201cWe applaud the legislators that supported SB 803 and its previous iterations, and are undeterred in our fight to find effective solutions to reduce Veteran suicide and the Veteran mental health crisis,\u201d he said.<\/p>\n<p>Amber Capone, CEO of VETS, said the decision \u201cmarks a significant setback in our fight to provide veterans with effective treatments for PTSD and other severe mental health crises.\u201d<\/p>\n<p>\u201cSB 803 promised a new pathway to healing for those who have served our country,\u201d she said. \u201cVoting down legislation that provides access to healing is a missed opportunity that denies hope to our veterans. We won\u2019t give up.\u201d<\/p>\n<p>The measure\u2019s introduction came weeks after a Senate committee also effectively <a href=\"https:\/\/www.marijuanamoment.net\/california-psychedelics-bill-stalls-out-in-final-senate-committee-despite-governors-openness-to-reform\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">killed a broader bill that would have legalized psychedelic service centers<\/a>\u00a0where adults 21 and older could have accessed psilocybin, MDMA, mescaline and DMT in a supervised environment with trained facilitators.<\/p>\n<p>The revised bill was also coauthored by Assemblymember Marie Waldron (R), who is also sponsoring a separate psychedelics bill focused on promoting research and creating a framework for the possibility of regulated therapeutic access that has\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-assembly-unanimously-approves-bill-to-create-psychedelics-workgroup-and-prepare-for-legal-therapeutic-access\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">already moved through the Assembly this year with unanimous support<\/a>.<\/p>\n<p>Advocates also remain disappointed that a broader psychedelics measure from Sen. Scott Wiener (D) stalled out during its final Senate committee stop last month.<\/p>\n<p>It had been drafted in a way that was meant to be responsive to concerns voiced by Gov. Gavin Newsom (D) last year when he\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-governor-newsom-vetoes-psychedelics-legalization-bill-despite-leading-on-marijuana-reform\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">vetoed a broader proposal that included provisions to legalize low-level possession of substances<\/a>\u00a0such as psilocybin.<\/p>\n<p>Instead, the revised bill would have\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-senator-plans-to-file-therapeutic-psychedelics-bill-with-republican-support-following-governors-veto-of-broader-legalization\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">provided regulated access to psychedelics in a facilitated setting<\/a>, without removing criminal penalties for possession outside of that context. People could buy them for therapeutic use with a doctor\u2019s recommendation. Advocates for that measure still have time to gather and turn in signatures.<\/p>\n<p>The California Legislative Analyst\u2019s Office (LAO) has since released its review of that proposal, outlining not only the plan\u2019s policy implications but\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-psychedelics-ballot-measure-could-undermine-marijuana-taxes-state-officials-say\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">also its potential fiscal impacts on the state<\/a>\u2014which the report calls \u201cvarious\u201d and \u201cuncertain.\u201d<\/p>\n<p>Some California municipalities, meanwhile, are pushing forward with reform on the local level. The city of Eureka, for example, adopted a resolution in October to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/after-california-governors-psychedelics-bill-veto-another-city-council-approves-decriminalization-resolution\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">decriminalize psychedelic plants and fungi and make enforcement of laws against personal use, cultivation and possession a low priority for police<\/a>. It\u2019s at least the fifth local jurisdiction in the state to embrace the policy change.
