{"id":76012,"date":"2024-06-06T12:21:43","date_gmt":"2024-06-06T20:21:43","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/06\/06\/bipartisan-lawmakers-demand-va-allow-its-doctors-to-recommend-medical-marijuana-in-light-of-rescheduling-move\/"},"modified":"2024-06-06T12:45:33","modified_gmt":"2024-06-06T20:45:33","slug":"bipartisan-lawmakers-demand-va-allow-its-doctors-to-recommend-medical-marijuana-in-light-of-rescheduling-move","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/06\/06\/bipartisan-lawmakers-demand-va-allow-its-doctors-to-recommend-medical-marijuana-in-light-of-rescheduling-move\/","title":{"rendered":"Bipartisan Lawmakers Demand VA Allow Its Doctors To Recommend Medical Marijuana In Light Of Rescheduling Move"},"content":{"rendered":"<\/p>\n<p>Bipartisan congressional lawmakers are demanding that the U.S. Department of Veterans Affairs (VA) rescind a directive preventing its doctors from recommending medical cannabis to veterans in legal states, arguing that the administration\u2019s recent rescheduling move underscores the need to withdraw the \u201cantiquated marijuana restrictions rooted in the racist drug policy.\u201d<\/p>\n<p>In a letter sent to VA Secretary Denis McDonough on Thursday, three co-chairs of the Congressional Cannabis Caucus\u2014Reps. Earl Blumenauer (D-OR), Dave Joyce (R-OH) and Barbara Lee (D-CA)\u2014said the \u201cnegative ramifications of VHA Directive 1315 expand far beyond prescriptions,\u201d as it \u201calso prohibits providers from giving recommendations, referrals, and forms in compliance with state medical marijuana regulations.\u201d<\/p>\n<p>\u201cWithout their VA provider\u2019s honest recommendations and option to provide referrals and registration forms, veterans are left to seek care outside of the VA system to participate in state-legal medical marijuana programs,\u201d the letter says. \u201cThis disrupts veterans\u2019 continuity of care and unfairly bars veterans from accessing treatment their states have legalized.\u201d<\/p>\n<p>To the frustration of advocates, VA released its updated directive <a href=\"https:\/\/www.marijuanamoment.net\/bidens-va-continues-policy-of-blocking-doctors-from-recommending-medical-marijuana-to-veterans-in-updated-directive\/\" target=\"_blank\" rel=\"noopener\">reaffirming its doctors are barred from issuing medical cannabis recommendations<\/a> to their military veterans patients late last year, <a href=\"https:\/\/www.marijuanamoment.net\/bipartisan-lawmakers-push-va-secretary-to-end-detrimental-policy-blocking-doctors-from-recommending-medical-marijuana-to-veterans\/\" target=\"_blank\" rel=\"noopener\">drawing initial criticism from the three bipartisan members<\/a>.<\/p>\n<p>In a response to the lawmakers\u2019 letter last year, VA told the members that they \u201cappreciate\u201d Blumenauer\u2019s \u201ccontinued efforts to ensure patients can participate in research specific to medical cannabis,\u201d noting the enactment of a bill he sponsored that\u2019s aimed at streamlining marijuana studies. However, the department said cannabis \u201cis still classified as a Schedule I controlled substances,\u201d and so \u201cVA cannot prescribe marijuana as a clinical treatment option.\u201d<\/p>\n<p>\u201cAlthough VA providers cannot currently prescribe marijuana as a treatment, VA is interested, consistent with existing authorities, in studying the effects of marijuana and cannabis products on health outcomes and exploring if the research points to a clear benefit for Veterans who have been diagnosed with PTSD,\u201d the department\u2019s letter said.<\/p>\n<p>The new letter from lawmakers to the VA secretary also comes on the heels of the House passage of an amendment to a large-scale spending bill that would <a href=\"https:\/\/www.marijuanamoment.net\/house-passes-veterans-focused-marijuana-and-psychedelics-amendments\/\" target=\"_blank\" rel=\"noopener\">prevent the agency from using its funds to enforce the directive<\/a>. That measure was led by the three signatories, as well as fellow Cannabis Caucus co-chair Rep. Brian Mast (R-FL).<\/p>\n<p>The amendment is based on a standalone bill, the Veterans Equal Access Act, that <a href=\"https:\/\/www.marijuanamoment.net\/military-veterans-could-get-medical-marijuana-recommendations-from-government-doctors-under-new-bipartisan-congressional-bill\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">Blumenauer has championed across multiple sessions<\/a>. It\u2019s advanced several times in committee and on the floor but has yet to be enacted into law.<\/p>\n<p>The lawmakers behind the letter emphasized that \u201cthe discussion has also shifted significantly\u201d since they first reached out about the latest directive last year in light of the U.S. Department of Health and Human Services (HHS) and Justice Department proposing to move cannabis from Schedule I to Schedule III of the Controlled Substances Act (CSA).<\/p>\n<p>\u201cWhile the rulemaking process is ongoing, the federal government has formally recognized that marijuana has an accepted medical use in the United States, which must be factored into VA\u2019s considerations,\u201d they <a href=\"https:\/\/blumenauer.house.gov\/media-center\/press-releases\/blumenauer-joyce-lee-demand-biden-administration-rescind-va-s-prohibitionist-health-directive\" target=\"_blank\" rel=\"noopener\">said<\/a>.<\/p>\n<p>\u201cContinuing to deny the medical use of marijuana in 38 states by prohibiting care for veterans that others access outside the VA system is an antiquated and harmful practice,\u201d the letter says. \u201cNo one is better qualified to make recommendations on care for veterans than veterans working with their VA health care providers. Placing arbitrary restrictions on those decisions is a disservice to our veterans.\u201d<\/p>\n<p style=\"padding-left: 40px\">\u201cHHS\u2019 and DOJ\u2019s formal recognition of marijuana\u2019s accepted medical benefit presents an opportunity to reevaluate the VA\u2019s prohibition on honest consideration of medical marijuana from VA health care providers. I hope you will take this opportunity in stride to end the VA\u2019s outdated restrictions on medical marijuana.\u201d<\/p>\n<p>If the department doesn\u2019t proactively end the policy, however, the amendment the signatories attached to the House-passed Military Construction, Veterans Affairs and Related Agencies (MilConVA) appropriations bill would force a change. Here\u2019s the text:<\/p>\n<p style=\"padding-left: 40px\"><strong>SEC. 419.<\/strong> None of the funds appropriated or other wise made available to the Department of Veterans Affairs in this Act may be used to enforce Veterans Health Directive 1315 as it relates to\u2014<\/p>\n<p style=\"padding-left: 40px\">(1) the policy stating that \u2018\u2018VHA providers are prohibited from completing forms or registering Veterans for participation in a State-approved marijuana program\u2019\u2019;<\/p>\n<p style=\"padding-left: 40px\">(2) the directive for the \u2018\u2018Deputy Under Secretary for Health for Operations and Management\u2019\u2019 to ensure that \u2018\u2018medical facility Directors are aware that it is VHA policy for providers to assess Veteran use of marijuana but providers are prohibited from recommending, making referrals to or completing paperwork for Veteran participation in State marijuana programs\u2019\u2019;
