{"id":75572,"date":"2024-05-23T05:31:49","date_gmt":"2024-05-23T13:31:49","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/05\/23\/new-york-bill-would-legalize-psilocybin-service-centers-where-adults-could-have-supervised-psychedelic-sessions\/"},"modified":"2024-05-23T12:45:58","modified_gmt":"2024-05-23T20:45:58","slug":"new-york-bill-would-legalize-psilocybin-service-centers-where-adults-could-have-supervised-psychedelic-sessions","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/05\/23\/new-york-bill-would-legalize-psilocybin-service-centers-where-adults-could-have-supervised-psychedelic-sessions\/","title":{"rendered":"New York Bill Would Legalize Psilocybin Service Centers Where Adults Could Have Supervised Psychedelic Sessions"},"content":{"rendered":"<p><img loading=\"lazy\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2024\/05\/MM_Bill_Tracker_V5_blank-115.jpg\" width=\"1500\" height=\"1500\"> <\/p>\n<p>A top New York lawmaker has introduced a bill to legalize psilocybin service centers where adults could access the psychedelic in a medically supervised setting, while significantly reducing penalties associated with non-authorized psilocybin activities.<\/p>\n<p>The legislation, sponsored by Assembly Health Committee Chair Amy Paulin (D), is one of the latest examples of New York legislators moving to enact psychedelics reform amid a growing state-by-state movement across the country.<\/p>\n<p>The intent of the measure is to promote \u201cthe health and well-being of the citizens of the state of New York by establishing a comprehensive framework supporting public health and safety through regulated adult use, support services, and cultivation of psilocybin-containing fungi,\u201d it says.<\/p>\n<p>Under the bill, the state Department of Health would regulate the program, licensing psilocybin cultivators and certifying facilities to provide psychedelic services to adults. It includes an extensive list of possible conditions that could be treated such as post-traumatic stress disorder (PTSD), but it also says eligibility is \u201cnot limited\u201d to those conditions. A person would have to undergo a health screening prior to participating in psilocybin services, however.<\/p>\n<p>The use, cultivation and sale of psilocybin without a license or permit would be treated as a \u201cviolation\u201d under state statute, meaning the maximum penalty would be a $250 fine and up to 15 days in jail. To that end, it would not broadly decriminalize the psychedelic as other bills have sought, but it would reduce the penalty.<\/p>\n<p>The <a href=\"https:\/\/assembly.state.ny.us\/leg\/?default_fld=&amp;leg_video=&amp;bn=A10375&amp;term=2023&amp;Summary=Y&amp;Actions=Y&amp;Memo=Y&amp;Text=Y\" target=\"_blank\" rel=\"noopener\">legislation<\/a> also calls for the establishment of a \u201cRegulated Psilocybin Advisory Board\u201d under the health department to \u201cadvise and issue recommendations\u201d related to the program.<\/p>\n<p>Among the board\u2019s responsibilities would be a mandate to \u201cdevelop a long-term strategic plan for ensuring that psilocybin services in the state will become and remain a safe, accessible and affordable therapeutic option, including in therapeutic and medical treatments, for all persons eighteen years of age and older for whom psilocybin services may be appropriate.\u201d<\/p>\n<p>Members would additionally be tasked with monitoring and studying \u201cfederal laws, regulations and policies regarding psilocybin.\u201d<\/p>\n<p>The department would need to create a tax scheme for businesses that derive revenue from the psilocybin services, which would be deductible under the state tax code. Taxes and fees would cover the administrative costs, \u201cincluding but not limited to education and risks of using psilocybin.\u201d<\/p>\n<p>The bill has been referred to the Assembly Health Committee, which is chaired by the sponsor.<\/p>\n<p>In February, bicameral New York lawmakers said at a briefing that <a href=\"https:\/\/www.marijuanamoment.net\/new-york-lawmakers-say-bill-to-legalize-psilocybin-assisted-therapy-has-a-real-chance-to-advance-this-year\/\" target=\"_blank\" rel=\"noopener\">there\u2019s a \u201creal chance\u201d that legislation to legalize psilocybin-assisted therapy will advance<\/a> through committee this session, emphasizing that delaying action would \u201cneglect\u201d many \u201cpeople who need help\u201d with certain mental health conditions.<\/p>\n<p>\u201cWe\u2019re in a mental health crisis, and so we need every tool that\u2019s available to us,\u201d Assemblymember Pat Burke (D), who is sponsoring a separate bill to <a href=\"https:\/\/www.marijuanamoment.net\/new-york-bill-would-create-psilocybin-therapy-pilot-program-for-10000-military-veterans-and-first-responders\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">create a psilocybin therapy pilot program for 10,000 people<\/a>, said.
