Andrew Clyde (R-GA) and Ben Cline (R-VA) expressed their \u201cgrave concern\u201d about the official\u2019s <a href=\"https:\/\/www.marijuanamoment.net\/dea-head-tells-lawmakers-it-would-be-inappropriate-to-comment-on-marijuana-rescheduling-proposal-due-to-ongoing-administrative-process\/\" target=\"_blank\" rel=\"noopener\">\u201crefusal to respond to questions from multiple members\u201d about the scheduling review<\/a> at a recent House Appropriations subcommittee hearing earlier this month.<\/p>\n<p>They challenged the administrator\u2019s position that it would be \u201cinappropriate\u201d to weigh in on that review under the Administrative Procedure Act (APA), arguing that there are exemptions built into the law that compel disclosures in a congressional committee setting.<\/p>\n<p>The lawmakers said \u201cyou were legally compelled to testify and answer questions related to marijuana reclassification despite your refusal and your incorrect legal interpretation of the APA.\u201d<\/p>\n<p>\u201cAccordingly, we expect to receive answers to the questions asked by members during the hearing,\u201d they said, adding that they also expect Milgram to respond to any written Questions for the Record (QFRs) from subcommittee members related to the issue.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">I\u2019m demanding that DEA Administrator Milgram answer questions related to the Biden Administration\u2019s recent marijuana reclassification\u2014including why AG Garland broke precedent by signing the order rather than Milgram.<\/p>\n<p>Americans deserve transparency on this serious matter. <a href=\"https:\/\/t.co\/7MMPsgxP9h\" target=\"_blank\" rel=\"nofollow noopener\">pic.twitter.com\/7MMPsgxP9h<\/a><\/p>\n<p>\u2014 Rep. Andrew Clyde (@Rep_Clyde) <a href=\"https:\/\/twitter.com\/Rep_Clyde\/status\/1793395024584905007?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">May 22, 2024<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>At issue for the lawmakers is the fact that Attorney General Merrick Garland signed the proposed rule to move marijuana from Schedule I to Schedule III of the Controlled Substances Act (CSA). Conventionally, the DEA administrator signs off on scheduling proposals, and so some have interpreted the break in precedent to mean DEA or Milgram disagreed with the rescheduling decision. However, it\u2019s not clear that\u2019s the case.<\/p>\n<p>Milgram did say at the subcommittee hearing this month that, \u201cstepping out of marijuana,\u201d she was unaware of any instance where a DEA administrator hasn\u2019t signed a scheduling order.<\/p>\n<p>In the new letter, Clyde and Cline requested that the administrator answer two questions by June 5, so that they have at least one week to review the response before their subcommittee markup of the budget bill covering DEA:<\/p>\n<ol>\n<li>In the FY25 DEA Budget Hearing, you testified that the DEA is the final authority to schedule, reschedule, or deschedule a drug under the Controlled Substances Act. So, why did you NOT sign the Notice of Proposed Rulemaking to reschedule marijuana released by the Drug Enforcement Administration on May 16, 2024?<\/li>\n<li>Additionally, in the FY25 DEA Budget Hearing, you testified that you were not aware of any instance in which a rulemaking that schedules, reschedules, or deschedules a drug under the Controlled Substances Act is not signed by the Administrator of the DEA. So, did the Department of Justice provide the DEA with justification to break decades of precedent to have the Attorney General ultimately sign the Notice of Proposed Rulemaking? If so, please describe in detail the Department of Justice\u2019s justification to you or the DEA for this decision.<\/li>\n<\/ol>\n<p>They also <a href=\"https:\/\/clyde.house.gov\/news\/documentsingle.aspx?DocumentID=1495\" target=\"_blank\" rel=\"noopener\">asked<\/a> for a copy of a DEA response to the Justice Department\u2019s Office of Legal Council (OLC) that was cited in their analysis of the rescheduling issue and which seemed to signal DEA pushed back against certain justifications for the reform.<\/p>\n<p>The Biden administration\u2019s drug czar said this week that <a href=\"https:\/\/www.marijuanamoment.net\/biden-drug-czar-says-marijuana-rescheduling-is-based-on-science-and-evidence-but-misstates-impact-on-prescription-access\/\" target=\"_blank\" rel=\"noopener\">the Justice Department\u2019s rescheduling determination is \u201cbased on science and evidence,\u201d<\/a> adding that the change will ease research restrictions around the use of cannabis to treat \u201cchronic illnesses, chronic pain and diseases like cancer.\u201d But he appeared to have oversimplified what the change will mean for legal prescription access to medical marijuana.<\/p>\n<p><strong>\u2014<br \/>\n<strong>Marijuana Moment is <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">tracking more than 1,500 cannabis, psychedelics and drug policy bills<\/a> in state legislatures and Congress this year. <a href=\"https:\/\/www.patreon.com\/marijuanamoment\" target=\"_blank\" rel=\"noopener\">Patreon supporters<\/a> pledging at least $25\/month get access to our interactive maps, charts and hearing calendar so they don\u2019t miss any developments.<\/strong><br \/>\n<a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" class=\"alignnone wp-image-9128 size-medium\" src=\"https:\/\/cannabiscultivatornews.com\/home\/wp-content\/uploads\/2024\/05\/MM_Bill_Tracker_V5_blank-112.jpg\" alt=\"\" width=\"300\" height=\"300\" \/><\/a><br \/>\n<strong>Learn more about our <a href=\"https:\/\/www.marijuanamoment.net\/bills\/\" target=\"_blank\" rel=\"noopener\">marijuana bill tracker<\/a> and become a <a href=\"https:\/\/www.patreon.com\/marijuanamoment\/\" target=\"_blank\" rel=\"noopener\">supporter on Patreon<\/a> to get access.<br \/>\n\u2014<\/strong><\/strong><\/p>\n<p>A report published by the Congressional Research Service (CRS) earlier this month said <a href=\"https:\/\/www.marijuanamoment.net\/congressional-researchers-update-lawmakers-on-legal-consequences-of-federal-marijuana-prohibition-in-light-of-rescheduling-effort\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">further action from the Food and Drug Administration (FDA) would be needed<\/a>\u00a0before marijuana products become available by prescription.<\/p>\n<p>CRS has also noted that rescheduling\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-rescheduling-would-not-bring-state-markets-into-compliance-with-federal-law-congressional-researchers-say\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">would not legalize cannabis or bring state-regulated markets<\/a>\u2014including medical marijuana systems\u2014\u201cinto compliance\u201d with federal law.<\/p>\n<p>The proposed rule to federally reschedule marijuana was officially posted last week, kicking off a <a href=\"https:\/\/www.marijuanamoment.net\/feds-begin-accepting-marijuana-rescheduling-comments-with-key-reform-groups-previewing-how-they-plan-to-influence-the-process\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">public comment period that\u2019s expected to elicit a major response<\/a>\u00a0from supporters and opponents of cannabis reform.<\/p>\n<p>Marijuana reform advocates and stakeholders have made clear that they intend to leverage the opportunity, with some planning to support the reclassification while others intend to call for descheduling cannabis altogether. Prohibitionists are expected to oppose the incremental policy change and seek to keep marijuana in Schedule I, and there\u2019s also a looming threat of litigation.<\/p>\n<p>While DOJ will take all public comments submitted by July 22 into consideration as it weighs the reform, it said in the notice that one of the topics its especially interested in hearing about is\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/doj-seeks-input-on-unique-economic-impacts-of-marijuana-rescheduling-for-multibillion-dollar-industry\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">the \u201cunique economic impacts\u201d of the rescheduling proposal<\/a>\u00a0given that state-level legalization has created a \u201cmultibillion dollar industry\u201d that stands to benefit from possible federal tax relief under the reform.<\/p>\n<p>When\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/biden-makes-historic-marijuana-rescheduling-announcement-applauding-monumental-move-to-reverse-longstanding-inequities\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">Biden announced the administration\u2019s rescheduling action<\/a>\u00a0last week, he described it as consistent with his belief that nobody should be jailed over cannabis possession. As a statutory matter, that wouldn\u2019t necessarily apply with simple rescheduling because it\u2019d remain federally illegal.
