{"id":75563,"date":"2024-05-23T09:34:42","date_gmt":"2024-05-23T17:34:42","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/05\/23\/california-senate-approves-bill-to-remove-marijuana-employment-protections-for-some-law-enforcement-jobs\/"},"modified":"2024-05-23T12:45:38","modified_gmt":"2024-05-23T20:45:38","slug":"california-senate-approves-bill-to-remove-marijuana-employment-protections-for-some-law-enforcement-jobs","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/05\/23\/california-senate-approves-bill-to-remove-marijuana-employment-protections-for-some-law-enforcement-jobs\/","title":{"rendered":"California Senate Approves Bill To Remove Marijuana Employment Protections For Some Law Enforcement Jobs"},"content":{"rendered":"<\/p>\n<p>The California Senate this week passed a bill would roll back\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-governor-signs-bill-blocking-most-employers-from-asking-about-past-marijuana-use-during-interview-process\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">existing employment protections for people who legally use marijuana while away from work<\/a>, removing them for sworn law enforcement positions that involve certain specified duties.<\/p>\n<p>Senators passed the measure on third and final reading Wednesday on a 31\u20133 margin, sending the bill next to the Assembly for consideration.<\/p>\n<p>The bill, SB 1264, from Sen. Shannon Grove (R), was initially introduced in February as a minor technical fix to the state\u2019s employment protection law, which took effect at the beginning of this year and prevents employers for discriminating against workers for pre-hire or off-the-clock marijuana use. In March, the measure was <a href=\"https:\/\/www.marijuanamoment.net\/california-bill-would-roll-back-marijuana-employment-protections-for-law-enforcement-jobs\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">significantly amended to roll back those protections for a wide range of public service jobs<\/a>, including not only police and sheriffs\u2019 deputies but also positions in animal control, law enforcement communications and public administration.<\/p>\n<p>Last month, a subsequent amendment revised the list of exempted positions to include only five categories of sworn law enforcement employees: those involved in the apprehension, incarceration or correction of criminal offenders; those who handle civil enforcement matters; workers involved in evidence gathering and processing; and those providing coroner functions.<\/p>\n<p>That version of the <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billStatusClient.xhtml?bill_id=202320240SB1264\" target=\"_blank\" rel=\"noopener\">bill<\/a> advanced out of the Senate Appropriations Committee on a 7\u20130 vote last week and was approved on the floor Wednesday with no additional changes.<\/p>\n<p>The legislation \u201cis narrowly drawn to provide a targeted exemption for just those sworn law enforcement applicants and employees who are undertaking difficult duties directly associated related to law enforcement,\u201d Grove said on the Senate floor ahead of the latest vote.<\/p>\n<p>\u201cThis is the same exemption that the building trades and construction trades currently have in statute,\u201d she said. \u201cThe work of both of these professions is important and has important implications for the public\u2019s safety. Peace officers are expected to overcome intense physical challenges and make split-second decisions in life-or-death situations and these responsibilities are generally incompatible with the effects of cannabis use.\u201d<\/p>\n<p>\u201cSB 1264 will ensure departments retain the ability to test employees for cannabis use to ensure the highest professional standards are met,\u201d she <a href=\"https:\/\/www.senate.ca.gov\/media\/senate-floor-session-20240522\" target=\"_blank\" rel=\"noopener\">said<\/a>.<\/p>\n<p>The legislation has the support law enforcement groups, such as the California State Sheriffs\u2019 Association and the California Police Chiefs Association, but was broadly opposed by labor unions.<\/p>\n<p>Cory Salzillo, a lobbyist for the California State Sheriffs\u2019 Association, said earlier this month that the bill would provide needed clarity on whether law enforcement agencies can test applicants and workers for cannabis.<\/p>\n<p>\u201cWe believed we were exempt under the language of that bill,\u201d Salzillo said of the employment protection bill that took effect in January. \u201cAnd since its passage and implementation and some more refined legal analysis, there is a little bit less clarity than we initially had. So we think this is a very targeted exemption.\u201d<\/p>\n<p>Opponents have included labor groups such as the United Food and Commercial Workers International Union (UFCW); the Service Employees International Union (SEIU); the California School Employees Association; the American Federation of State, County and Municipal Employees (AFSCME); and the California Employment Lawyers Association.<\/p>\n<p>Drug advocacy groups such as the Drug Policy Alliance and California NORML also opposed the rollback bill.<\/p>\n<p>Kristin Heidelbach, a cannabis workforce development advisor and legislative advocate for UFCW, said at an earlier hearing that the union is worried the change could lead to a slippery slope.<\/p>\n<p>\u201cWe have major concerns with this bill even in its amended condition,\u201d she\u00a0said, \u201cbecause we feel that what this does is carve out a huge group of workers [and] that, next year, we\u2019re going to be fighting another group of workers, and the following year we could be carving out another group of workers.\u201d<\/p>\n<p>During her 13 years in a labor union, \u201cI\u2019ve watched multiple workers harassed or discriminated against\u2026or threatened with a cannabis test,\u201d Heidelbach said. \u201cOur Black and brown brothers and sisters are disproportionately impacted by this, because they are subject to higher rates of testing.\u201d<\/p>\n<p>Even under existing law, \u201ctwo facts remain,\u201d she added: \u201cYou cannot be under the influence of cannabis and go to work. Nothing in current law allows that. Additionally, you have the right to test your workers now.\u201d<\/p>\n<p>Meanwhile in California, Assembly lawmakers this week <a href=\"https:\/\/www.marijuanamoment.net\/california-lawmakers-approve-bill-to-legalize-marijuana-cafes-months-after-governors-veto-of-earlier-measure\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">approved a bill to legalize cannabis cafes in the state<\/a>, months after the governor vetoed a previous iteration of the proposal. The plan now proceeds to the Senate.<\/p>\n<p>Assemblymember Matt Haney (D) is again sponsoring the proposal, which would allow on-site marijuana consumption at licensed businesses that could also offer non-cannabis food and non-alcoholic drinks and host live events such as concerts if they get permission from their local government.<\/p>\n<p>Gov. Gavin Newsom (D) vetoed the prior version, saying that while he appreciated that the intent was to \u201cprovide cannabis retailers with increased business opportunities and an avenue to attract new customers,\u201d he felt \u201cconcerned this bill could\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-governor-vetoes-cannabis-cafe-and-marijuana-labeling-bills-but-signs-others-into-law\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">undermine California\u2019s long-standing smoke-free workplace protections<\/a>.\u201d<\/p>\n<p>Separately, a California Senate committee earlier this month <a href=\"https:\/\/www.marijuanamoment.net\/california-psychedelics-bill-stalls-out-in-final-senate-committee-despite-governors-openness-to-reform\/\" target=\"_blank\" rel=\"noopener\">effectively killed a bill to legalize psychedelic service centers<\/a> where adults 21 and older could access psilocybin, MDMA, mescaline and DMT in a supervised environment with trained facilitators.<\/p>\n<p>The \u201cRegulated Therapeutic Access to Psychedelics Act\u201d was drafted in a way that was meant to be responsive to concerns voiced by Gov. Gavin Newsom (D) last year when he\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-governor-newsom-vetoes-psychedelics-legalization-bill-despite-leading-on-marijuana-reform\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">vetoed a broader proposal that included provisions to legalize low-level possession of substances<\/a>\u00a0such as psilocybin.<\/p>\n<p>Instead, the revised bill would have\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-senator-plans-to-file-therapeutic-psychedelics-bill-with-republican-support-following-governors-veto-of-broader-legalization\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">provided regulated access to psychedelics in a facilitated setting<\/a>, without removing criminal penalties for possession outside of that context. It did not lay out any specific qualifying medical conditions that a person would need to have in order to access the services.<\/p>\n<p>Assemblymember Marie Waldron (R), the lead on the Assembly side, is sponsoring a different psychedelics bill focused on promoting research and creating a framework for the possibility of regulated therapeutic access that has <a href=\"https:\/\/www.marijuanamoment.net\/california-assembly-unanimously-approves-bill-to-create-psychedelics-workgroup-and-prepare-for-legal-therapeutic-access\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">already moved through the Assembly this year with unanimous support<\/a>.<\/p>\n<p>An initiative campaign to put psilocybin legalization on the state\u2019s November ballot recently announced that it <a href=\"https:\/\/www.marijuanamoment.net\/california-psilocybin-initiative-wont-be-on-2024-ballot-after-activists-fall-short-in-signatures-for-third-cycle-in-a-row\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">did not secure enough signature to qualify in time for a deadline<\/a>. Another campaign filed and then abruptly withdrew an initiative to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-campaign-withdraws-2024-ballot-measure-to-create-state-psychedelics-research-agency\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">create a $5 billion state agency tasked with funding and promoting psychedelics research<\/a>\u00a0last year.<\/p>\n<p>A third campaign also entered the mix late last year,\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/californians-have-until-monday-to-comment-on-revised-psychedelics-ballot-proposal-with-final-update-expected-december-1\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">proposing to legalize the possession and cultivation of substances<\/a>\u00a0like psilocybin, LSD, MDMA, DMT, ibogaine and mescaline. People could buy them for therapeutic use with a doctor\u2019s recommendation. Advocates for that measure still have time to gather and turn in signatures.<\/p>\n<p>The California Legislative Analyst\u2019s Office (LAO) has since released its review of that proposal, outlining not only the plan\u2019s policy implications but\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/california-psychedelics-ballot-measure-could-undermine-marijuana-taxes-state-officials-say\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">also its potential fiscal impacts on the state<\/a>\u2014which the report calls \u201cvarious\u201d and \u201cuncertain.\u201d<\/p>\n<p>Some California municipalities, meanwhile, are pushing forward with reform on the local level. The city of Eureka, for example, adopted a resolution in October to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/after-california-governors-psychedelics-bill-veto-another-city-council-approves-decriminalization-resolution\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">decriminalize psychedelic plants and fungi and make enforcement of laws against personal use, cultivation and possession a low priority for police<\/a>. It\u2019s at least the fifth local jurisdiction in the state to embrace the policy change.
