Greg Albritton (R-Atmore), the chair of the Senate\u2019s Finance and Taxation General Fund Committee, said the ongoing litigation over the commission\u2019s licensing process had turned it into a \u201cmoney pit.\u201d<\/p>\n<p>\u201cRight now, we are putting money into it,\u201d he said. \u201cRight now, we are having more and more and more suits coming in. I don\u2019t know what the problems are, but we need to get that resolved over there or we are going to have to do something legislatively to correct this.\u201d<\/p>\n<p>Brittany Peters, a spokeswoman for the AMCC, said in a statement Monday that the commission\u2019s \u201clongstanding position\u201d was seeing the state medical cannabis program \u201cbecome fully operational as soon as possible.\u201d<\/p>\n<p>\u201cWith the priority of serving patients in the state who would benefit from medical cannabis, the commission is committed to defending against the lawsuits filed by disappointed applicants,\u201d the statement said. \u201cThe commission is hopeful that the Legislature shares this same commitment to patient needs, and it welcomes further conversation with lawmakers\u201d<\/p>\n<p>The senator directed his comments to Gunter Guy, general counsel with Alabama Department of Agriculture and Industries, who presented the committee with a legal contract for a firm to represent the commission.<\/p>\n<p>The Department presented legislators with a new contract for $100,000 funded by the state for years at a rate of $195 per hour to Gregg B. Everett, Esq.; Gilpin &amp; Givhan, PC, a firm based out of Montgomery.<\/p>\n<p>According to the accompanying agenda packet, attorneys for the firm will represent Commissioner Rick Pate and the Department of Agriculture and Industries in \u201cseveral lawsuits\u201d regarding the commission.<\/p>\n<p>The Department justified the contract by stating that it is \u201ccomplex litigation which requires legal services not available within the Department.\u201d<\/p>\n<p>The Alabama Legislature passed a bill in 2021 to establish a medical cannabis program to help address several illnesses, from cancer and depression to Parkinson\u2019s Disease and PTSD.<\/p>\n<p>The Commission first awarded licenses back in June, but the body had to reclaim the licenses after members <a href=\"https:\/\/www.marijuanamoment.net\/divided-alabama-medical-cannabis-commission-votes-to-delay-licenses-as-application-scoring-process-is-reviewed\/\" target=\"_blank\" rel=\"noopener\">found scoring inconsistencies<\/a> in the evaluation of applications. Commissioners awarded a second round of licenses in August, but those were delayed amid litigation alleging the AMCC <a href=\"https:\/\/www.marijuanamoment.net\/alabama-medical-marijuana-company-sues-state-regulators-over-alleged-open-meetings-law-violations-in-licensing-votes\/\" target=\"_blank\" rel=\"noopener\">violated the Open Meetings Act<\/a>. Another suit has halted some licenses <a href=\"https:\/\/alabamareflector.com\/2024\/01\/04\/alabama-cannabis-lawsuits-stall-licenses-but-industry-officials-remain-hopeful\/\" target=\"_blank\" rel=\"noopener\">getting awarded in December<\/a>.<\/p>\n<p>\u201cI am expressing my frustration over how adults can seem to find our way into a hole such as this without a clear path to where we thought we were going,\u201d said Albritton, who voted for the 2021 measure.<\/p>\n<p>Sen. In April, the Senate Agriculture, Conservation, and Forestry Committee approved <a href=\"https:\/\/alison.legislature.state.al.us\/files\/pdfdocs\/SearchableInstruments\/2024RS\/SB306-int.pdf\" target=\"_blank\" rel=\"noopener\">SB 306<\/a>, sponsored by Sen. Tim Melson (R-Florence), who sponsored the 2021 bill. The legislation would <a href=\"https:\/\/www.marijuanamoment.net\/alabama-senate-panel-advances-legislation-to-restart-medical-marijuana-licensing-process\/\" target=\"_blank\" rel=\"noopener\">restart the licensing process<\/a> and give up some of its powers to judge applications. Under the legislation, the Alabama Securities Commission will verify and evaluate applicants\u2019 proposals, then send the results to the AMCC to select the candidates.<\/p>\n<p>The commission would oversee regulation and enforcement.<\/p>\n<p>The bill has not come out for a vote in the Senate. With only three days left in the 2024 session, the legislation has a very tight window to pass. <a href=\"https:\/\/alison.legislature.state.al.us\/files\/pdfdocs\/SearchableInstruments\/2024RS\/SB276-int.pdf\" target=\"_blank\" rel=\"noopener\">SB 276<\/a>, a bill sponsored by Sen.
