Daryl Abbas (R), who chaired a failed state commission on legalization late last year.<\/p>\n<p>Legalization advocates said the action represents the proposal clearing a major hurdle on its way to the desk of Gov. Chris Sununu (R).<\/p>\n<p>\u201cThe odds of New Hampshire legalizing cannabis this year just dramatically increased,\u201d Karen O\u2019Keefe, director of state policies for the Marijuana Policy Project, told Marijuana Moment in an email. \u201cFor the first time ever, the Senate Judiciary Committee approved a legalization bill after first amending the bill in a way that addresses Gov. Sununu\u2019s parameters.\u201d<\/p>\n<p>The panel\u2019s vote in favor of advancing the bill fell 3\u20132, with Abbas joined by two Democrats in support. The two other Republican members of the committee cast votes in opposition.<\/p>\n<p \/>\n<p>Sununu, who\u2019s remained a skeptic of legalization, <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-governor-will-sign-marijuana-legalization-bill-if-senate-makes-changes-he-says\/\" target=\"_blank\" rel=\"noopener\">said recently that he\u2019ll only sign the bill if specific provisions are included<\/a>. Lawmakers, however, did not directly reference the governor or his required provisions when discussing proposed amendments Wednesday.<\/p>\n<p>\u201cFundamentally I don\u2019t really love this idea anyway,\u201d the governor added at the time, but he said he sees legalization as \u201cinevitable.\u201d<\/p>\n<p>The legalization proposal\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-house-passes-bill-to-legalize-marijuana-through-agency-store-model-that-senators-oppose\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">passed out of the House a month ago<\/a>.<\/p>\n<p>Though O\u2019Keefe and other advocates said they\u2019re pleased to see New Hampshire make progress toward legalization, they\u2019re also concerned about some of the changes made by Abbas\u2019s amendment, which, among other changes, would impose a \u201cfranchise fee\u201d\u2014essentially a tax\u2014on medical marijuana sales and step up penalties for public consumption of marijuana to include the possibility of jail time.<\/p>\n<p>\u201cWhile this is a huge step forward, we hope to see floor amendments to restore important provisions, including exempting patients from sin taxes,\u201d O\u2019Keefe said.<\/p>\n<p>The changes also adjust the proposal\u2019s approach to a legal cannabis market, shifting it to a franchise model under which the state would control the look, feel and operations of stores that are licensed to private operators. At least one possible successor, former U.S. Sen. Kelly Ayotte (R)\u2014one of a handful of gubernatorial candidates that\u2019s entered the race\u2014said recently\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-gop-gubernatorial-candidate-says-she-would-oppose-marijuana-legalization-if-elected\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">that she opposes legalizing marijuana for adults<\/a>.<\/p>\n<p>\u201cI don\u2019t think legalizing marijuana is the right direction for our state,\u201d said Ayotte, who represented New Hampshire in the Senate from 2011 to 2017 and was previously the state\u2019s attorney general from 2004 to 2009.<\/p>\n<p>As <a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-house-passes-bill-to-legalize-marijuana-through-agency-store-model-that-senators-oppose\/\" target=\"_blank\" rel=\"noopener\">approved by the House last month<\/a>, <a href=\"https:\/\/gencourt.state.nh.us\/bill_Status\/billinfo.aspx?id=1893\" target=\"_blank\" rel=\"noopener\">HB 1633<\/a> would allow 15 retail stores statewide and impose a 10 percent state charge on adult-use purchases. Medical marijuana would be exempt from the tax. Retailers would be regulated through the agency store model, with significant restrictions on marketing and advertising.<\/p>\n<p>Lawmakers worked extensively on marijuana reform issues last session and attempted to reach a compromise to enact legalization through a multi-tiered system that would include state-controlled shops, dual licensing for existing medical cannabis dispensaries and businesses privately licensed to individuals by state agencies. The legislature ultimately\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-lawmakers-punt-on-state-run-marijuana-legalization-proposal\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">hit an impasse on the complex legislation<\/a>.<\/p>\n<p>Bicameral lawmakers also convened the state commission tasked with studying legalization and proposing a path forward last year, though the group\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-marijuana-legalization-commission-fails-to-reach-consensus-votes-against-recommending-bill-for-2024\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">ultimately failed to arrive at a consensus or propose final legislation<\/a>.<\/p>\n<p>The Senate\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-hampshire-senate-rejects-house-passed-marijuana-legalization-bill\/\" target=\"_blank\" rel=\"noopener\" data-google-interstitial=\"false\">defeated a more conventional House-passed legalization bill last year, HB 639, despite its bipartisan support<\/a>.<\/p>\n<p>Last May, the House defeated marijuana legalization language that was included in a Medicaid expansion bill.
