{"id":75019,"date":"2024-05-06T15:26:36","date_gmt":"2024-05-06T23:26:36","guid":{"rendered":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/05\/06\/dea-administrator-did-not-sign-off-on-marijuana-rescheduling-order-prohibitionist-group-says\/"},"modified":"2024-05-07T00:45:21","modified_gmt":"2024-05-07T08:45:21","slug":"dea-administrator-did-not-sign-off-on-marijuana-rescheduling-order-prohibitionist-group-says","status":"publish","type":"post","link":"https:\/\/cannabiscultivatornews.com\/home\/index.php\/2024\/05\/06\/dea-administrator-did-not-sign-off-on-marijuana-rescheduling-order-prohibitionist-group-says\/","title":{"rendered":"DEA Administrator \u2018Did Not Sign Off\u2019 On Marijuana Rescheduling Order, Prohibitionist Group Says"},"content":{"rendered":"<\/p>\n<p>The leader of a marijuana prohibitionist organization that <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-rescheduling-announcement-coming-very-soon-as-early-as-this-week-opposition-group-says\/\" target=\"_blank\" rel=\"noopener\">accurately predicted<\/a> last week\u2019s <a href=\"https:\/\/www.marijuanamoment.net\/dea-agrees-to-reschedule-marijuana-under-federal-law-in-historic-move-following-biden-directed-health-agencys-recommendation\/\" target=\"_blank\" rel=\"noopener\">cannabis rescheduling recommendation<\/a> now says that sources inside the Drug Enforcement Administration (DEA) are telling him that Anne Milgram, the agency\u2019s administrator, \u201cdid not sign off\u201d on the landmark decision.<\/p>\n<p>\u201cI can now say with full confidence that the Administrator of DEA, Anne Milgram, did NOT sign the rescheduling order,\u201d Kevin Sabet, president of the advocacy group Smart Approaches to Marijuana (SAM), posted on social media Monday, citing \u201ctwo confidential sources inside DEA and another outside DEA with intimate knowledge.\u201d<\/p>\n<p>He said in a further statement, relayed on The Drug Report, a news site published by the Foundation for Drug Policy Solutions\u2014which was co-founded by Sabet\u2014that \u201cit\u2019s hard to overstate how deeply political and flawed this makes the rescheduling process look.\u201d<\/p>\n<p>\u201cDEA Administrator Anne Milgram should be commended for standing up for science and truth, over the profit-driven pot industry,\u201d said Sabet, who served under three presidents as an Office of National Drug Control Policy advisor. \u201cHer courage will show she was on the right side of history. It\u2019s equally hard to overstate what a botched process the Biden Administration\u2019s rescheduling review has been from the outset. This unprecedented action by the Attorney General reflects a process poisoned by political considerations and conducted with a pre-determined outcome.\u201d<\/p>\n<p>SAM recently <a href=\"https:\/\/www.marijuanamoment.net\/marijuana-legalization-opponents-raise-money-for-potential-lawsuit-against-federal-rescheduling-move\/\" target=\"_blank\" rel=\"noopener\">sent out a fundraising email following the rescheduling announcement<\/a>, saying explicitly that the group is looking into taking legal action in an effort to halt the federal reform.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BIG: I can now say with full confidence that the Administrator of DEA, Anne Milgram, did NOT sign the rescheduling order, breaking with five decades of precedent and established law and regulations (two confidential sources inside DEA and another outside DEA with intimate\u2026<\/p>\n<p>\u2014 Kevin Sabet (@KevinSabet) <a href=\"https:\/\/twitter.com\/KevinSabet\/status\/1787569052782846142?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener\">May 6, 2024<\/a><\/p>\n<\/blockquote>\n<p \/>\n<p>If true, the significance of Sabet\u2019s claim that Milgram didn\u2019t sign off on the rescheduling decision isn\u2019t immediately clear. Asked one <a href=\"https:\/\/twitter.com\/KevinSabet\/status\/1787569052782846142\" target=\"_blank\" rel=\"noopener\">reply<\/a> on social media: \u201cDo you have confirmation this was done in protest or just that Anne Milgram wasn\u2019t the one to sign it?\u201d<\/p>\n<p>If Milgram did not in fact sign the reform document, it\u2019s also not clear who did. It could be the case that a lower-ranking DEA official is the signatory. Alternatively, it could be signed by U.S. Attorney General Merrick Garland, perhaps signaling how high of a priority for the administration the marijuana move is.<\/p>\n<p>In a statement to Marijuana Moment last week, Department of Justice (DOJ) Director of Public Affairs Xochitl Hinojosa said that \u201cthe Attorney General circulated a proposal to reclassify marijuana from Schedule I to Schedule III.\u201d<\/p>\n<p>\u201cOnce published by the Federal Register,\u201d Hinojosa added, \u201cit will initiate a formal rulemaking process as prescribed by Congress in the Controlled Substances Act.\u201d<\/p>\n<p>The next step in the rescheduling process would be for the White House Office of Management and Budget (OMB) to review the rule. If approved, it would go to public comment before potentially being finalized.<\/p>\n<p>DEA did not provide comment regarding Sabet\u2019s assertions in response to a request from Marijuana Moment.<\/p>\n<p>Milgram is scheduled to appear at a congressional budget <a href=\"https:\/\/appropriations.house.gov\/events\/hearings\/budget-hearing-fiscal-year-2025-request-drug-enforcement-administration\" target=\"_blank\" rel=\"noopener\">hearing<\/a> on Tuesday morning to discuss the agency\u2019s funding request for fiscal year 2025.<\/p>\n<p>The Drug Report <a href=\"https:\/\/thedrugreport.org\/2024\/05\/06\/sources-inside-dea-say-administrator-did-not-sign-off-on-marijuana-rescheduling-decision\/\" target=\"_blank\" rel=\"noopener\">post<\/a> anticipates that she\u2019ll \u201clikely be met with questions from lawmakers about the DEA\u2019s decision to reschedule marijuana and her agency\u2019s process for coming to that conclusion.\u201d<\/p>\n<p>Later this year, another DEA representative, William Heuett, is set to present on the agency\u2019s \u201cprocessing of schedule I research applications\u201d at a <a href=\"https:\/\/www.marijuanamoment.net\/dea-fda-and-other-agencies-to-discuss-marijuanas-potential-to-treat-pain-at-upcoming-federal-research-meeting\/\" target=\"_blank\" rel=\"noopener\">federal research meeting on the potential for marijuana to treat pain<\/a>. It\u2019s not clear how that presentation might be updated in light of the ongoing rescheduling process.<\/p>\n<p>Meanwhile in the wake of the DEA rescheduling announcement, a former head of the agency said the proposal is \u201cunderstandable\u201d because it \u201creflects the reality\u201d of public opinion toward the medical value of cannabis.<\/p>\n<p>In an interview with Fox News last week week, former <a href=\"https:\/\/www.marijuanamoment.net\/former-dea-head-says-marijuana-rescheduling-reflects-the-reality-of-public-support-for-reform\/\" target=\"_blank\" rel=\"noopener\">DEA Administrator Asa Hutchinson said it \u201cabsolutely looks like\u201d the agency will follow through<\/a> with moving marijuana from Schedule I to Schedule III under the Controlled Substances Act (CSA).<\/p>\n<p>\u201cWhenever we see over a dozen states now have medical marijuana, clearly there\u2019s a movement for reclassification,\u201d he said. \u201cAnd so it\u2019s not a surprise to me.\u201d<\/p>\n<p>\u201cI think it reflects the reality of today\u2019s both culture but also the public sentiment.
