I feel like we\u2019re not headed in the right direction.\u201d<\/em><\/p>\n<p><strong>By Sophie Nieto-Munoz, New Jersey Monitor<\/strong><\/p>\n<p><span data-preserver-spaces=\"true\">For the last\u00a0<\/span><span data-preserver-spaces=\"true\">two years<\/span><span data-preserver-spaces=\"true\">, people have been able to stroll into New Jersey dispensaries to buy weed. But growing your own cannabis plant remains a third-degree felony.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Despite a growing number of\u00a0<\/span><a href=\"https:\/\/www.marijuanamoment.net\/new-york-officials-approve-marijuana-home-grow-rules-and-new-business-licenses-amid-rocky-start-for-legal-market\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">nearby<\/span><span data-preserver-spaces=\"true\">\u00a0<\/span><span data-preserver-spaces=\"true\">states<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0legalizing the growing of marijuana plants at home, bills to do the same in New Jersey have languished every session since cannabis was legalized.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">A state senator and chief sponsor of a bill to\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.njleg.state.nj.us\/bill-search\/2024\/S1393\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">allow<\/span><\/a><span data-preserver-spaces=\"true\"> medical marijuana patients<\/span><span data-preserver-spaces=\"true\">\u00a0to grow cannabis, plus\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.njleg.state.nj.us\/bill-search\/2024\/S1985\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">another<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0bill that would expand that to 10 plants for medical patients and six plants for recreational users, said the fight for home grow is \u201cat a standstill.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cWe said we were doing this bill for criminal justice purposes, and to partially correct the very failed multi-billion war on drugs campaign that happened for decades in New Jersey, so this is frustrating. I feel like we\u2019re not headed in the right direction,\u201d said Sen. Vin Gopal (D-Monmouth).<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Under the state\u2019s cannabis laws, the only people allowed to grow marijuana are those with cultivator licenses. Lawmakers, particularly Senate President Nicholas Scutari (D-Union), have previously voiced hesitancy over a home grow program, saying it would stunt the growth of the legal industry and allow the underground market to flourish without regulations. Scutari long pushed to make marijuana legal and sponsored the recreational legalization law.<\/span><\/p>\n<p><a class=\"editor-rtfLink\" href=\"https:\/\/www.marijuanamoment.net\/one-year-into-new-jerseys-recreational-marijuana-market-senate-president-eyes-changes-including-limited-home-grow\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">In an interview last April<\/span><\/a><span data-preserver-spaces=\"true\">, he said discussions had started about \u201cperhaps allowing for a very, very slim amount of home grow applicants, some of the more significant or medical patients.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Scutari did not respond to a request for comment for this story. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Marijuana advocates say lawmakers opposed to home grow are misinformed about its financial impact on the cannabis industry, and have stressed the importance of a home cultivation program for medical marijuana users. Growing cannabis at home would be beneficial to patients who have trouble getting to a dispensary or who can\u2019t afford the high prices of medical marijuana. The average cost of an eighth ounce of recreational weed is around $60.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Plus, they argue, Scutari\u2019s argument is moot\u2014the cannabis industry in New Jersey is thriving.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">More than 100 dispensaries have opened their doors since sales first began April 21, 2022. Hundreds of licenses have been awarded for cultivation, manufacturing, and retail. Recreational sales exceeded $675 million in 2023, nearly double the year prior. And\u00a0<\/span><span data-preserver-spaces=\"true\">in February<\/span><span data-preserver-spaces=\"true\">, the Cannabis Regulatory Commission said <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-will-reach-and-surpass-1-billion-in-marijuana-sales-in-2024-even-as-federal-legalization-stalls-top-state-regulator-says\/\" target=\"_blank\" rel=\"noopener\">the state surpassed $2 billion in recreational and marijuana sales<\/a> since 2018. The agency predicted that sales could exceed $1 billion alone this year.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">At that meeting,<\/span><span data-preserver-spaces=\"true\">\u00a0officials noted that while <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-will-reach-and-surpass-1-billion-in-marijuana-sales-in-2024-even-as-federal-legalization-stalls-top-state-regulator-says\/\" target=\"_blank\" rel=\"noopener\">legalizing home cultivation is not in their purview<\/a>, they would encourage the Legislature to look into it.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Chris Goldstein is an organizer with the National Organization for the Reform of Marijuana Laws and a longtime cannabis activist in New Jersey. He questioned where Scutari \u201cgets this idea that he needs to protect the industry from home cultivation.\u201d He said it\u2019s ironic that Scutari helped get the cannabis industry off the ground but now continues to stifle it.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cThe small business owners I talk to, the consumers, the patients, they say he\u2019s off base,\u201d said Goldstein. \u201cAnd again, the delay has been really terrible for New Jersey. We\u2019ve seen nothing but the highest prices as well.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Goldstein noted that<\/span><em><span data-preserver-spaces=\"true\">\u00a0<\/span><\/em><span data-preserver-spaces=\"true\">six senators from both sides of the aisle have cosponsored Gopal\u2019s and Sen. Troy Singleton\u2019s (D) bill to allow medical marijuana patients to grow their own cannabis.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cI\u2019m not sure what Scutari\u2019s new excuse will be, but I think this is a sort of critical mass on home cultivation coming up pretty fast,\u201d he said. He said support from the governor\u2019s office would help put a spotlight on the issue.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">A spokeswoman for Gov. Phil Murphy (D), who campaigned in 2017 on legalizing marijuana, noted that in 2023 <a href=\"https:\/\/www.marijuanamoment.net\/new-jersey-governor-is-very-much-open-minded-to-legalizing-marijuana-home-grow-but-says-market-needs-to-mature-first\/\" target=\"_blank\" rel=\"noopener\">Murphy said he\u2019s \u201cvery much open-minded\u201d to home grow<\/a>.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cI\u2019d love to see the governor and the governor\u2019s office get louder on this,\u201d Gopal said. \u201cI\u2019d love to see him play a more active role in this.
